HomeMy WebLinkAbout80-10Commissioner zaun then introduced the following resolution and called for its adoption: Resolution No. 80 -10 1, RESOLUTION AUTHORIZING THE EXECUTION OF CONTRACTS RELATING TO THE ACQUISITION AID SALE OF CERTAIN PROPERTY IN TAX INCREMENT FINANCING DISTRICT NO. 1, REQUESTING THE COUNTY AUDITOR TO CERTIFY AS TO THE ORIGINAL ASSESSED VALUE OF ALL';,TAXABLE PROPERTY IN THE DISTRICT, AND AUTHORIZING SECRETARY TO FILE FINANCING PLAN WITH THE STATE PLANNING AGENCY BE IT RESOLVED by the IIousing and Redevelopment Authority in and for the City of Lakeville (the Authority) as follows: Section 1. Recitals. 1.01. The Authority has established Redevelopment Project No. 1 (the Project) and Tax Increment Financing District No. 1 (the District) in the City, and has adopted a Redevelopment Plan for the Project (the Redevelopment Plan) and a Tax Increment Financing Plan for the District (the Financing Plan). The Redevelopment Plan and Financing Plan are sometimes collectively referred to herein as the "Plans." 1.02. By its resolution adopted November 17, 1980 the City Council of the City of Lakeville, Minnesota (the City), after public hearings on the Plans held in accordance. with Minnesota Statutes, Sections 462.521 and 273.74 Su bdivision 3, has approved the Plans. 1.03. The Authority by resoluti.01 adopted on November 3, 1980 called a public heai.i.ny �,ra the sale of certain real property in the District in :.accordance with a proposed form of Redevelopment Agreement and Assessment Agreement (described below) for Monday, November 17, 1.980. Notice of the hearing was published in a newspaper_ of general circulation in the City as required by law and said hearing was held on November 17, 1980, and all persons appearing thereat were permitted to present their views on such salt. 1.04. There has been prepared and presented to the Authority the following contracts, which will. be necessary for the Authority to accept or enter into in order to carry out the acquisition and disposition of certain real property in the District as described in the Plans: (a) relating to the purchase from the Authority and development of certain property in the District by Despatch Industries, Inc. (the Developer), a Contract for the sale of Land for Private Redevelopment, (b) relating to the establishment of a minimum market value of the taxable property in the District upon completion of the redevelopment by the Developer, an Assessment Agreement, and (c) relating to the issuance of bonds, acquisition of certain real property in the District, sale of certain real property in the District to the Authority and construction of certain hubLi_c i.mprovemnnts in the District by the City, a Cooperat iori Agror�nrrnt. (,I) (h) and (c) are collectively referred to herein as the "Contracts." Section 2. Authorization to Execute Contracts. 2.01. The Authority has reviewed and considered the Contracts, the facts and views presented at the public hearing and at other Authority meetings concerning the acquisition and disposition of certain real property in the District and hereby determines that the acquisition of the real property in the District other than the Despatch Site (as defined in the Plans) and the sale of certain property in the District to the Developer, is necessary to implement phase one of the Project, as described in, and for the reasons set forth in, the Redevelopment Plan. 2.02. The Authority hereby determines the "fair market value" of that property in the District described in the Plans as the "City Site," the "Access Site" and the vacated portion of Hughes Avenue, to be $43,000. 2.03. The form of Contracts, with such variations, insertions and additions as the City Attorney may hereafter deem appropriate, are hereby approved and are directed to be executed by the Chairman and Secretary of the Authority.
