THE HOUSING AND REDEVELOPMENT AUTHORITY IN AND FOR THE CITY OF LAKEVILLE, MINNESOTA RESOLUTION NO. 87 -8 CALLING FOR A PUBLIC HEARING ON THE SALE OF CERTAIN LAND WITHIN PROPOSED TAX INCREMENT FINANCING DISTRICT NO. 3 WITHIN REDEVELOPMENT PROJECT NO. 1 WHEREAS, The Housing and Redevelopment Authority in and for the City of Lakeville, Minnesota (the "Authority ") on the date hereof has adopted a Tax Increment Financing Plan (the "Plan ") establishing Tax Increment Financing District No. 3 (the "District ") within Redevelopment Project No. 1 (the "Project "); and WHEREAS, pursuant to the Plan the Authority proposes to acquire the real property legally described on Schedule A attached hereto (the "Land ") and to sell the Land to a developer pursuant to a Contract for Private Development which will require the purchaser to carry out or cause to be carried out the provisions of the plan for the Project and will provide that no use shall be made of the Land or any structure erected thereon which does not conform with the plan for the Project; and WHEREAS, pursuant to Minnesota Statutes, Section 462.525, the Authority is authorized to sell, without public bidding, its Land in a redevelopment project following a public hearing for which notice was published not less than 10 or more than 30 days before such hearing; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of The Housing and Redevelopment Authority in and for the City of Lakeville, Minnesota, as follows: 1. The Authority shall hold a public hearing regarding the sale of the Land on May 18, 1987. 2. The Executive Director of the Authority is authorized and directed to cause notice of such public hearing, substantially in the form of Schedule B attached hereto, to be published in a newspaper of general circulation in the City of Lakeville once, not less than 10 days or more than 30 days in advance of such hearing. 3. Neither the adoption of this resolution, the publication of notice of the public hearing or the approval by the Authority of such sale following the public hearing will compel the Authority to acquire or sell the Land. r Adopted this 4th day of May, 1987. aiYffian Atte Executive Director (SEAL) - 1 - 0; D SCHEDULE A Legal Description of Certain Land Located in the City of Lakeville, County of Dakota Property Identification Number 23- 02900 - 011 -02 Section 29, Township 114, Range 20 The NW 1/4 of the NE 1/4 except the South 671.35 feet of the East 395.17 feet of the NW 1/4 of NE 1/4 of Section 29, Township 114, Range 20, City of Lakeville, Minnesota. I• SCHEDULE B NOTICE OF PUBLIC HEARING REGARDING THE SALE OF CERTAIN LAND BY THE HOUSING AND REDEVELOPMENT AUTHORITY IN AND FOR THE CITY OF LAKEVILLE, MINNESOTA Notice is hereby given that The Housing and Redevelopment Authority in and for the City of Lakeville, Minnesota, will hold a public hearing on May 18, 1987 at 8:00 p.m., at 7773 - 214th Street, Lakeville, Minnesota, to consider the sale of the following legally described Land pursuant to Minnesota Statutes, Section 462.525: Property Identification Number 23- 02900- 011-02 Section 29, Township 114, Range 20 The NW 1/4 of the NE 1/4 except the South 671.35 feet of the East 395.17 feet of the NW 1/4 of NE 1/4 of Section 29, Township 114, Range 20, City of Lakeville, Minnesota. The Authority proposes to sell such Land pursuant to a development contract to be entered into with Arkell Development Company, having its principal offices in Minneapolis, Minnesota, which contract will require the purchaser to develop the Land pursuant to the redevelopment program for Redevelopment Project No. 1. In determining a purchase price for the Land the Authority will take into consideration the fair market value for the Land, subject to the development contract.
