JANUARY 18, 2011
Mayor Bellows called the meeting to order at 7:00 p.m. The pledge of
allegiance to the flag was given.

Citizens' Comments
Scott Nelson, 16630 Genesee Avenue, and former Chairman of the MN U.S.
Green Building Council (USGBC) Education Committee, encouraged the
City Council to consider implementing a LEED green building certification
program for city facilities. He stated the green building initiative saves an
average of 33% in energy costs. Mayor Bellows asked Mr. Nelson to
provide information to the City Administrator.
Presentations /Introductions
On behalf of the Lakeville Area Arts Center pottery instructors and
students, Mr. Michaud presented a donation in the amount of $803 to 360
Communities for the local food shelf. Steve Haschig, Sr. Director of
Development, accepted the donation on behalf of 360 Communities.
Mr. Michaud presented the December monthly report of the Parks &
Recreation Department.

Chief Vonhof presented the December Police Department monthly report.
Mayor Bellows asked the chief to provide, in future monthly reports,
statistics related to investigation case loads.
Keith Nelson provided an engineering project update.
Consent Agenda
11.05 Motion was made by Swecker, seconded by Little to approve the consent
agenda items as follows:
a. Claims for payment.
b. Minutes of the January 3, 2011 City Council meeting.
c. Mayor's appointment of Colleen LaBeau and Matt Little to the Housing
and Redevelopment Authority of Lakeville, MN.
d. Temporary on -sale liquor license for All Saints Catholic Church.
e. Pay Equity Compliance Report.
f. Audit Engagement Agreement with Malloy, Montague, Karnowski,
Radosevich & Co., P.A.
g. Resolution No. 1 1 -03 authorizing the sale of a forfeited vehicle.
h. Resolution No. 1 1 -04 accepting donation from Shakopee
Mdewakanton Sioux Community to the Fire Department.
i. Renewal of tree work licenses for Dave's Tree Service & Landscaping
and DR Tree & Landscape Service.
j. Resolution No. 1 1 -05 establishing 2011 Council Committees and Inter -
Agency Appointments and approving appointments thereto.
k. Resolution No. 11 -06 endorsing Wendy Wulff for reappointment to the
Metropolitan Council.

Item 7 - Public Hearing for 2011 Street Improvement Project
Mayor Bellows opened the public hearing on the 2011 street improvement
project. The City Clerk attested to legal notice publication.
Mr. Petree explained that the City's Pavement Management Program was
designed to identify roadways in need of reconstruction. This information
is included in the City's five year capital improvement plan.
Monica Heil, WSB & Associates, provided an overview of the project. The
proposed improvements in the Glenn Addition (205th Street, Idalia Avenue,
Iceland Avenue and 207th Street) will include construction of concrete
curb & gutter where bituminous curb currently exists, new storm sewer and
street reconstruction. Spot curb and gutter replacement, storm sewer
improvements and street reconstruction is proposed for all other streets
within the project area. The estimated project cost is $2,820,000. Based
on this estimate, the City will finance approximately $1,610,000, and
approximately $1,210,000 (40 %) will be assessed to the benefitting property
owners, consistent with the City's street assessment policy. The Glenn
Addition will be assessed 100% for the installation of concrete curb and
gutter.
Mr. Petree explained that questions were raised at the neighborhood
meeting last fall regarding the installation of additional street lights within
the Glenn Addition. He indicated that if the Council so chooses, a survey
could be sent to those property owners to determine whether the majority
would support the additional cost for street lights.
Council Member Little asked if the City has a policy that provides for
property owners who may be unable to pay the assessment due to an
economic hardship.
Mr. Feller stated the City does not currently have an assessment policy
specific to economic hardship. He explained that State Statute provides
an assessment deferral for qualifying senior citizens and property owners
with disabilities. The Assistant City Attorney stated he would review the
statute to determine whether such a policy is addressed.
At this time, Mayor Bellows invited public comments.

Gary Meyer, 20617 Idalia Avenue, asked if speed bumps could be
installed on 207th Street.
Dale Even, 8433 - 208th St. W., asked if the project will move forward if the
actual costs are higher than estimated and, if so, how the project will be
assessed.
Susan Hoffbeck, 20510 Dodd Blvd., expressed opposition to street lights
and concrete curb & gutter due to the additional costs.
Mike Ruhme, 8407 Lower 208th Street, asked if the City has specific
estimates as to the impact these improvements will have on property
values.
11.06 Motion was made by LaBeau, seconded by Little to close the public
hearing.
Roll call was taken on the motion. Ayes, unanimous.
City staff addressed the public comments as follows:
Speed bumps are typically difficult for maintenance vehicles to deal with;
however, there are other traffic calming measures that can be
considered.
The plans and specifications will outline in detail the components of the
project and the costs associated with each component. Staff is hopefu
that the bids will come in lower than estimated and assessments can be
adjusted accordingly.
City policy requires the installation of concrete curb and gutter to direct
the flow of storm water, which improves the life of the street.
It is not typical for the City to provide property value estimations; however,
the assessment against a parcel of property cannot exceed the benefit tc
that property. Allowing a street to deteriorate will likely have a negative
impact on property values.
Council Member LaBeau asked if the assessments may be higher than
anticipated if the bids come in higher than estimated due to a recent
increase in petroleum prices.

Mr. Petree explained that the Council would need to determine whether
to adjust its assessment policy or assess the project based on the current
policy, which is 400 of the total project cost. He reiterated that the costs
and assessments provided to date are only estimates.
Council Member Little asked how payments are calculated. Mr. Feller
stated he would provide individual amortization schedules to any of the
property owners upon request.
The Council directed staff to survey the Glenn Addition residents to
determine if there is majority support for additional street lights.
11.07 Motion was made by Swecker, seconded by Rieb to approve Resolution
No. 11-07 ordering the 2011 street improvement project and authorizing
preparation of plans and specifications.
Roll call was taken on the motion. Ayes, unanimous.
New Business -
Mayor Bellows stated that the City received 27 applications for
appointment to advisory committees. The council members will discuss
how to proceed with processing the applications at their January 24th
work session.
