ORDINANCE NO. s43
AN ORDINANCE AMENDING ORDINANCE N0. 167, THE LAKEVILLE ZONING
ORDINANCE, MODIFYING SECTION 13, OFF-STREET LOADING BY REMOVING THE
NEED FOR A CONDITIONAL USE PERMIT FOR LOADING .BERTHS ON THE FRONT
OR SIDE OF A BUILDING LOCATED ON A CORNER LOT WITHIN AN INDUSTRIAL
DISTRICT.
THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA DOES HEREBY
ORDAIN:
Section 1. Ordinance No. 167, Section 13.2.5 is hereby
amended to read as follows:
5) Loading berths located at the front or side of buildings
on a corner lot shall be reviewed and approved in the
following manner:.
a) Industrial Zoning Districts.. Within CBD-I, I-1 and
I-2 Zoning Districts, loading berths located at the
front of a building or side of a building located
on a corner may be allowed subject to the following
conditions.
1. Loading berths shall not conflict with
pedestrian movement.
2. Loading berths shall not. obstruct the view of
the public right-of-way from off-street
parking access.
3. Loading. berths shall comply with all other
requirements of this Section.
4. Loading berths .and associated staging areas
shall be screened from the abutting public
rights-of-way. Said screening shall consist
of either a screening fence or a green belt.

a. A green belt planting strip consisting of
evergreen and deciduous trees and shrubs
shall be of sufficient width and density
to provide an effective visual screen.
This planting strip shall be designed to
provide complete visual screening to a
minimum height of six (6) feet. Earth
mounding or-berms may be used but shall
not be used to achieve more than three
(3 ) feet of the .required screen. Green.
belt screening shall also. comply with
design standards outlined in Section 9.7
of this Ordinance. The planting plan and
type of plantings shall require the
approval of the Zoning. Administrator.
b. A required screening fence shall be
constructed of masonry, brick, wood or
metal. Such fence shall provide a solid
screening effect six (6) feet in height..
Screening fences shall also comply with
the design standards for fencing. outlined
in Section 9.6 of this Ordinance:. The
design and materials used in constructing
a required. screening fence shall be
subject to the approval of the Zoning
Administrator. Fences in excess of six
{6) feet in height shall require approval
of both the Zoning Administrator. and
Building Official.
c. Required screening shall be set back
thirty { 3 0 ) feet f rom the point where. a
site access curb cut line intersects with
the street right-of-way.:.
b) Commercial Zoning Districts. Within the B-1, B-2,
B-3, B-4, CBD-C, B-W, and B-C Zoning Districts,
loading berths shall be located in side or rear
lots away from public rights-of-way. Where
physical conditions unique to the site warrant,
loading berths may be located at the front or side
of a building located on a corner lot by
conditional use permit subject to the following
conditions:
1. Loading berths shall not conflict with
pedestrian movement.
2. Loading berths shall not. obstruct the view of
the public right-of-way from off-street
parking access.
3. Loading berths shall comply with all other
..requirements of this Section.
