HomeMy WebLinkAboutItem 07March 18, 2011 Item No. MARCH 21, 20110 CITY COUNCIL MEETING LAKEVILLE COURT APARTMENTS CONDITIONAL USE PERMIT AMENDMENT Proposed Action Staff recommends adoption of the following motion: Move to approve a conditional use permit amendment for the Lakeville Court Apartments and adopt the findings of fact as presented. Adoption of this motion will result in both interior and exterior improvements to each building and site modifications including a new storage building and trash storage structure, a new basketball court, additional landscaping throughout the property, and a new fence along the south property line. A small addition will be constructed on the south side of the rental office to provide a restroom for the office. Overview Lakeville Court Apartments includes 52 rental workforce housing units within seven buildings located at 20390 Dodd Blvd. The project was developed and is owned and managed by Sand Companies. A conditional use permit amendment is required to allow the proposed site improvements and modifications to the site plan approved by the City Council in 1994. The Planning Commission held a public hearing on the conditional use permit amendment at their March 3, 2011 meeting and recommended unanimous approval. There was public comment from two neighboring residents who commented about litter control, tenant behavior, fence repair, and trespassing. The Planning Commission added Stipulation 6 to require a new six foot tall fence on the south side of the property and the proper maintenance of the fence and property. Following the Planning Commission meeting, the applicant has submitted revised site and landscape plans addressing stipulations 5 and 6. Staff recommends approval of the conditional use permit amendment with the revised plans. Primary Issues to Consider Have the neighborhood concerns raised at the public hearing been addressed? The Planning Commission added a stipulation requiring a new fence to be two feet taller than the existing boundary fence along the south side of the property, dosure of the existing gap in the fence in the southeast corner of the property, and maintenance of the fence and grounds. Representatives of Sand Companies including the management group will be in attendance at the City Council meeting and can discuss tenant screening and on site management., which is not the purview of the Planning Commission. Permit. Subject to the terms and conditions set forth herein, the City of Lakeville approves a Conditional Use Permit Amendment for Sand Companies, Inc. to allow modifications to the approved site and development plans for the Lakeville Court Apartments. 2. Property. The permit is for the following described property located at 20293 Dodd Boulevard in the City of Lakeville, Dakota County, Minnesota: All that part of the Southeast Quarter of the Northwest Quarter of Section 29, Township 114, Range 20, Dakota County, Minnesota, Tying Southwesterly of the right - of -way of the Minneapolis, Northfield and Southern Railway and lying Northerly of the North line of Glenn Addition, according to the plat thereof on file and record. Snow shall be trucked off -site when no room is available to store the snow on the property. d) Building permits are required prior to commencing any construction or remodeling work. 4. Termination of Permit. The City may revoke the permit following a public hearing for violation of the terms of the permit. 5. Criminal Penalty. Violation of the terms of this conditional use permit amendment is a criminal misdemeanor. The Planning Commission conducted a public hearing on the proposed conditional use permit amendment preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following: FINDINGS OF FACT 1. The property is currently zoned RH -1, High Density Residential District. 2. The property is located in Planning District No. 7 of the 2008 Comprehensive Plan, which guides the property for high density residential land use. 3. The legal description of the property is: All that part of the Southeast Quarter of the Northwest Quarter of Section 29, Township 114, Range 20, Dakota County, Minnesota, lying Southwesterly of the right -of -way of the Minneapolis, Northfield and Southern Railway and lying Northerly of the North line of Glenn Addition, according to the plat thereof on file and record. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The existing high density residential development and the site plan modifications are consistent with the current RI-/-1 District zoning and guided high density residential use of the properly. b. The proposed use is or will be compatible with present and future land uses of the area. Provided compliance with the stipulations of the conditional use permit amendment, the existing high density residential development and the site plan modifications will be compatible with existing and future land uses in the area. c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. ANNOUNCEMENTS: CITY OF LAKEVILLE Planning Commission Meeting Minutes MARCH 3, 2011 Mr. Morey stated th the following`; items were distributed to - Planning Commission' at tonight's" meeting: Revised drainage plan - arid revised landscape plan for the Lakeville Co Apiartmcnts (Agenda Itcm 5). ITEM 5. LAKEVILLE COURTAPARTMENTS Chair Davis opened` the public hearing to consider the application of Sand Companies for a Conditional Use Permit Amendment to amend the approved site and development plans for the Lakeville Court Apartments, located at 20390 Dodd Boulevard. The Recording Secretary attested that the legal notice had been duly published in accordance with State Statutes and City Code. Richard Hennings, the architect for Sand Companies presented an overview of their request. Mr. Hennings stated that proposed plans include new siding, doors and windows, an increase of one additional parking space for each unit, relocating existing post lights where necessary to accommodate the expanded pavement area, constructing a new detached accessory building adjacent to the play area, a new basketball court in the play area, and a new trash enclosure to be constructed north of the play area. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that Lakeville Court Apartments was approved by Conditional Use Permit in 1994. He indicated that an expansion of the rental office to provide a restroom in the office is also proposed. He indicated on the plans the location for snow storage. The snow may have to be removed from the property in heavy snowfall years. Mr. Dempsey indicated that the Engineering Department is'' recommending a rain garden be constructed near the northeast building on the site to reduce runoff and improve erosion control in that area as shown on the =revised drainage and landscape plans. Mr. Dempsey mentioned that in his planning report he stated that each unit includes a two car garage, when, in fact, they are only one stall garages. He indicated that this will be corrected prior to City Council consideration of the CUP amendment. Mr. Dempsey stated that should the Planning Commission recommend approval of the CUP amendment for the Lakeville Court Apartments, Planning Department staff recommends the .5 stipulations listed in the February 25, 2011 planning report, and adoption of the Findingsof Fact dated March 3, 2011. Chair Davis opened the hearing to the public for comment. Her concerns were with garbage, including liquor bottles; being tossed onto or blowing onto their property and with drug dealing on the subject property. Ms. Rouen indicated that they have called the police and seems to get done to take care of the situation. She wanted to know if there'was going: to be any new fencing installed along the south property line to keep peo the garbage out of their yards. Mr. Freemark stated that the neighbors were promised a six foot tall privacy fence when the project was approved to separate the high density from the low density housing in the neighborhood. 11.14 Motion was made and seconded to close the public hearing at 6:17 p.m. Ayes: Maguire, Lillehei, Davis, Adler, Grenz, Drotning. Nays: 0 Chair Davis asked staff whether a privacy fence was a requirement when Lakeville Court Apartments was built. Mr. Dempsey indicated that he researched the original files, reports, and minutes and did not find any reference to a privacy fence. He stated there is a 4 foot chain link fence currently along the south property line. Chair Davis asked Mr. Hennings whether he could improve the litter situation. Mr. Hennings stated that he hoped the new centralized trash enclosure. would help the situation. He indicated that the garbageis' a management issue' and he would discuss it with the management of the complex. Mr. Morey stated that staff will follow up with the police department regarding Ms. Rouen's comments related to drug 'dealing on the site. : . Chair Davis asked for comments from the Planning Commission. Discussion points were: Planning Commission Meeting March 3, 2011 Page 3 • Fencing and : screening Was discussed including location, chain link versus wood, fence, versus landscape screening, height of fence, and replace or repair the existing Mr Dempsey indicated that the chain link fence currently located'.north of the row' of evergreen trees on the south side of the akeville Court Apartments property is 48 inches tall. The fence in the southeast corner needs' to be repaired to close an opening that exists adjacent ro the railroad. • Because Ms. Rouen's concerns regarding the drug problem was not part of the Planning Commission's purview, Commissioner Drotning suggested a narrative:;to the'_, City Council from the residents expressing their concerns about the screening process for the residents of Lakeville Court Apartments. • Commissioner Grenz asked about the phasing of the project. Mr. Hennings stated that unoccupied units will be targeted first. He indicated that they would ask for volunteers to move into finished units as the work continues. The updates are scheduled to be finished by the end of 2011. • Commissioner Grenz asked why staff is not requiring storm shelters to be installed with this renovation or make the proposed storage shed a storm shelter. Staff indicated that this is a remodel and not an expansion of the number of dwelling units. In addition, storm shelters are not a requirement in the RH -1 District. Mr. Morey stated that staff has not recommended the use of storage sheds as storm shelters because the residents would have to empty the contents of the storage shed prior to being able to use it as a storm shelter. • Vice Chair Lillehei asked staff what fence type and height has been required in the past in similar situations where high density residential abuts low density residential. Mr. Dempsey indicated that when screening is required, staff prefers these of landscaping rather than fencing. He stated that the purpose of the existing four foot chain link fence is more of a property line demarcation than a physical barrier. • Commissioner Drotning clarified that the railroad tracks are inactive and regulated by the Federal Government, not the City. • The Planning Commission suggested an additional stipulation, regarding the fencing. Mr. Morey suggested the following wording: ". 6. The existing chain link fence along the south property line shall be replaced with a 6 foot tall fence and shall connect with the existing chain link fence along the northeast property line. The connection shall not include a gate. "" .All. fences' and the property shall be maintained in compliance with Zoning Ordin requirements. 11.15 Motion was made and seconded to recommend to City Council approval of the Lakeville Court Apartments Conditional Use Permit amendment to amend the approved site and development plans, located at 20390 Dodd Boulevard, subject to the following 6 stipulations;: as amended, and adoption of the Findings of Fact dated March 3,'2011: Planning Commission Meeting March 3, 2011 Page 4 1 : The site and building improvements shall be developed according to the plans approved by the City-Council. 2. A new eight foot tall spruce tree shall be planted along the east side of the south property line in the location where a dead tree had been removed. 6. The existing chain link fence along the south property line shall be replaced with a 6 foot tall fence and shall connect with the existing chain link fence along the northeast property line. The connection shall not include a gate. All fences and the property shall be maintained in compliance with Zoning Ordinance requirements. Ayes: Lillehei, Davis, Adler, Grenz, Drotning, Maguire. Sand Companies, Inc. is the original developer and current owner of the property. Sand Companies plans to make improvements to the interior and exterior of each building including new siding, doors and windows, expanded off - street parking within the development as well as other on- site modifications such as a new storage building and exterior trash storage structure, basketball court and additional landscaping throughout the property. A small addition is proposed to the south side of the rental office to provide a restroom for the office. In 1994, the Zoning Ordinance required that multiple principal buildings constructed on a single parcel receive a Planned Unit Development/Conditional Use Permit. The Zoning Ordinance currently allows multiple buildings on one parcel by conditional use permit. A conditional use permit amendment is required to allow the proposed modifications to the site plan. Light Fixture Details and Photometric Plan (2 pages) PLAN ANALYSIS Surrounding Land Uses and Zoning North — Railroad and Commercial Development (C -3 District) South — Undeveloped Half Right -of -Way and Single Family Homes (RS -3 District) East — Railroad and Commercial Development (C -3 District) West — Dodd Boulevard and Single Family Homes (RS -2 District) Property. The Lakeville Court Apartments are located on a 6.5 acre metes and bounds described property zoned RH -1, High Density Residential District. The property is bounded by Dodd Boulevard (CSAH 9) on the west and the Canadian Pacific Railroad on the north and east. To the south are single family homes within the Glenn Addition, which was platted in 1951 with most homes built between the late 1950's and mid 1970's. A 30 foot wide undeveloped half street right -of -way from the Glenn Addition separates the single family homes from the Lakeville Court Apartments property. There are no plans to construct a future street within the partial right -of -way, which functions more as a buffer between the two uses. A 42 inch tall chain link fence was constructed along the south and east property boundaries in accordance with the approved PUD /CUP. Twenty seven, six foot tall spruce trees were planted by Sand Companies in 1994 along the south property line at the suggestion of the single family home owners. Buildings. There are seven apartment buildings on the property that include five, eight unit buildings and two, six unit buildings. The buildings are constructed with brick wainscot, prefinished steel exterior siding and asphalt roof shingles. Interior streets and driveways are surfaced with bituminous. 2 The rental office on the west side of the property is proposed to be expanded to provide a restroom in the office. The proposed office addition will total 5 foot x 17 foot (85 sf) and will match the exterior of the other rental units. Setbacks. The minimum building setback requirements are as follows: Front — 30 feet Sides — 10 feet Rear — 30 feet Parking Lot — 15 feet adjacent to all public streets, 5 feet from interior lot lines All buildings meet setback requirements. All new parking stalls, drive aisles and turn- around areas meet setback requirements. The existing driveway in the southeast corner of the site is set back only three feet from the shared property line with the railroad. Parking. The 52 unit apartment development currently includes a one car garage for each unit, 52 parking spaces in front of the unit garages and 30 guest parking spaces. The plans propose to increase the off - street parking by an additional 52 spaces. The new paving will provide one new off - street parking space for each unit. Bump -out turn - around areas will be extended approximately 5 feet to the south and east of each dead -end driveway to provide turn - around maneuvering space for the new parking areas. The new pavement setback will be 15 feet to the south property line for the south parking area improvements and five feet from the property line at the northeast side of the property. The turn - around areas shall not be used for parking. Green Space and Landscaping. Fifty -four percent of the site is currently green space. The expanded parking areas and other site improvements will increase the impervious surface area by 16,698 square feet resulting in a total green space area of 48 %. The Zoning Ordinance does not require a minimum green space area for the RH -1 District. There were 63 deciduous and conifer trees planted on the property with the apartment development. There were 27 spruce trees planted along the south property line to act as a buffer between the single family homes to the south. One of those trees located near the southeast corner of the site, fourth from the right, has died and must be replaced. Thirteen trees will be removed or relocated for the proposed site improvements. The proposed landscape plan includes 27 additional eight foot tall conifer trees, nine deciduous and 23 decorative (crabapple and dogwood) trees, and numerous new shrubs to be planted throughout the property. 3 Site Lighting. Existing post lights will be relocated where necessary to accommodate the expanded pavement area and four new post lights will be installed. The new light fixtures are 20 foot tall and 250 watt high pressure sodium fixtures. The existing and new light fixtures are downcast fixtures that restrict light to a fixed area. Fixture samples of the lights and a photometric plan have been submitted. The photometric plan shows that light intensity at the property line will not exceed one foot candle as required by the Zoning Ordinance. The photometric plan is included with the light fixture plan as Exhibit H. Accessory Building. A new detached accessory storage building located adjacent to the play area and basketball court will provide enclosed storage for maintenance equipment and will also provide an open sided covered outdoor shelter with a sitting area near the remodeled outdoor play area. The building will be 10 feet tall and 16 feet x 38 feet (608 sf) of which a 24 foot x 16 foot (384 sf) area will be enclosed for storage. The accessory building will be sided with a cement board exterior to match the principal buildings. Trash Enclosure. A new trash enclosure will be constructed north of the play area and will be used as the central trash and recycling enclosure. The centrally located trash enclosure will replace the individual residential trash containers that residents now place beside the curb on the pick -up day. Snow Storage. The Zoning Ordinance requires that all parking areas provide locations for snow storage. Snow is currently stored between the existing driveways and along the exterior perimeters of the interior driveways. The additional parking area will reduce space available for on -site snow storage. The plans show snow storage located in the southeast corner of the property. In those areas without adequate storage for snow, hauling the snow from the property is required. Grading and Drainage. The grading and drainage plans have been reviewed by the Engineering Department. A memorandum has been prepared by Mark Duchene, Development Design Engineer, dated February 25, 2011 and is attached. The Engineering Department recommends that a rain garden be constructed near the northeast building on the site to reduce site runoff and improve erosion control in that area. RECOMMENDATION Planning Department staff recommends approval of the Lakeville Court Apartments conditional use permit amendment subject to the following stipulations: 1. The site and building improvements shall be developed according to the plans approved by the City Council. 4 2. The turn - around areas shall not be used for parking. 3. Snow shall not be stored in the drive aisles, driveways or guest parking spaces. Snow shall be trucked off -site when no room is available to store the snow on the property. 4. Building permits are required prior to commencing any construction or remodeling work. 5. A new eight foot tall spruce tree shall be planted along the east side of the south property line in the location where a dead tree had been removed. The scope of work on the project includes updating site amenities, driveways and sidewalks, upgrading the exterior and the interior of the buildings. The majority of the work will be to update the interior of the units including new flooring, doors, trim work, cabinets, countertops and light fixtures. The exterior of the buildings will receive new fiber cement board siding as well as new doors and windows. The existing site consists of 5 eight -plex apartments and 2 six -plex apartments. The proposed site improvements will be completed by: SITE REVIEW Owner: Sand Companies, Inc. Engineer: Sand Companies, Inc. Surveyor: Westwood Professional Services, Inc. The existing apartment buildings are located along private drives with two access drives to Dodd Boulevard. They are bordered along the west by Dodd Boulevard (CSAH 9), the north and east by the railroad and to the south by single family homes. The Owner is proposing to expand the dead end drive turn around areas, add additional on street parking spaces, add additional driveway space to the individual units and add additional landscaping. The current playground area will also be modified with updated equipment, a basketball court and a 992 sf accessory building. PUBLIC STREETS AND ACCESS City of Lakeville Engineering The parcel is currently provided access via two driveways along Dodd Boulevard. No change in access is proposed with the CUP Amendment. LAKEVILLE COURT - CONDITIONAL USE PERMIT FEBRUARY 25, 2011 PAGE 2 OF 3 UTILITIES SANITARY SEWER AND WATERMAIN The existing parcels are connected to public sanitary sewer and water. There are no proposed sanitary sewer or watermain improvements associated with the CUP Amendment. DRAINAGE AND GRADING The subject parcel is located within subdistrict SC -42 of the South Creek drainage district as identified in the City's Water Resources Management Plan. The Owner is proposing to add an additional 16,698 sf of impervious surface area with the proposed improvements. Currently the site mostly drains overland to catch basins that are part of the private storm sewer. The private storm sewer connects to public storm sewer within the Dodd Boulevard right -of -way and discharges into a regional stormwater basin located in the southwest corner of the intersection of 207 Street and Dodd Boulevard. Consistent with the South Creek Management Plan and the City of Lakeville's Water Resources Management Plan, the Engineering Department is recommending the Owner establish a rain garden in the existing low area to the east of the northernmost apartment building. This area appears to have some erosion concerns now as the current drainage patterns for the site direct runoff through this low area into a storm sewer apron. A rain garden in this area will provide treatment and infiltration for the added impervious surfaces as well as reduce erosion in this area and sediment entering the storm sewer system. Engineering will work with the Owner to develop a design for the rain garden. STORM SEWER There are no proposed public storm sewer improvements associated with the CUP Amendment. WETLANDS There are no wetlands within the subject parcel.
