PLANNING COMMISSION MINUTES
MARCH 17, 1988
The meeting. was called to order by Terry Langhorst, Vice
Chairman at 7:00 p.m. in the Airlake Council Chambers.
,Roll call of members was .taken. Present: Whitehouse, Sizer,
Langhorst, Whittingham and Walters. Absent: Miller and
MacGibbon.
Also present was. David Licht, City Plannex, Roger Knutson, City
Attorney, Jim Robinette, Community Development Director, Curt
Gutoske of Northwest'Associated Consultants and Mira Holliday,
Recording Secretary.
88.51 Motion was made by Walters, seconded by Whittingham to approve
the minutes of the March 3, 1.988 Planning Commission meeting.
Roll call was taken°on the motion.. Ayes.: .Sizer, Langhorst,
Whittingham, Walters.. Abstain: Whitehouse.
88.52 Motion .was made by Sizer, seconded by Walters to approve. the
minutes of the March 10, 1988 Planning .Commission meeting.
Roll calf was taken on the motion. Ayes.: .Whitehouse, Sizer,
Whittingham, Walters. Abstain: Langhorst.
The public hearing to consider the application of Stewart
Properties for the-preliminary plat of Marion Village By The
Lake, a subdivision of 131 single family lots, a rezoning from
R-7 to R-2 and vacation of .certain platted streets was opened..
The City'Attorney attested that all"legal notices had been duly
published and mailed.
Curt-Gutoske of Northwest Associated Consultants gave a review
of the-plat and made recommendations as outlined in the
Planner's report of Marchll,.1988.and.March 14, 1988. Harry
Johnson, representing Stewart Properties addressed the
recommendations made in the reports. He stated that a
feasibility study is currently underway by City. staff. He
discussed the street vacations and stated than the first phase
would consist of 41 lots.
The.. Commission discussed the project including.:
- Bike paths
-.Soil borings
- Ponding
- Price .range of homes ($150,000 - $200,000)
Public comment consisted of questions concerning street access
and. easements. City staff and Mr. Johnson responded.

88.53 Motion was. made. by Walters, seconded by Whittingham to close .the.
public hearing.
Roll call was taken on the motion.: Ayess Unanimous.
88.54 Motion was. made. by Sizes, seconded by Whittingham to recommend
approval of the application. of Stewart Properties.'for the
preliminary plat of Marion Village by the Lake, a subdivision of
131 singlefamily lots, a rezoning from R-7 to R-2 and vacation
of indicated streets. subject to the-Planner's reports of
.3/11/88 and 3/14/88, a report dated 2/8:/88 from the Dakota.
County Soil and Water Conservation District, areport from the
.City Engineer. dated 2/16/88 and a let er from the Dakota County.
Survey Department dated 2/23/88 and subject to any other. staff
.recommendations..
Roll call was taken on the motion. Ayes: Unanimous.
Curt Gutoske gave a review of the final-plat of Meadows West 4th
and 5th Additions. He recommended approval subject to the
.recommendations in the Planner's report of. 3/.2/88. A brief
discussion was held among staff and Commission members..
88.55 Motion was made by Whittingham, seconded. by Walters to recommend
approval of the final plat of the Meadows West 4th and 5th
Additions subject to the Planner's report of 3/2/88 and `a report
by the City Engineer dated 2/18/88, areport by .the Dakota.
County Soil and Water Conservation District dated 3/.8/88,.a
letter from the Dakota County Survey Department dated. January
26,.1988 and any other recommendations by staff.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Tollefson
Development, Inca for the preliminary plat of Indian Hills, a
subdivision of 328 single family dots and rezone 6 acres of R-2
to B-4 Commercial was continued from the .March 3, 1988 meeting.
Curt Gutoske stated that the developer had submitted revised.
plans and was no longer requesting the rezoning. The entire
site will remain R-2 zoning. The entire layout will; be single
family lots. He stated that the.: recommendations one through 4
in the Planner's report of 3/16/88 had been satisfied and: meets
City standards. He stated that recommendations five through 9
we re ..still holding. He .recommended approval subject to the
above recommendations..
Carl Tollefson, the developer reviewed the revised plat pointing
out all of the revisions. The Commission members discussed the
plans including:

8$.56 Motion was made by Sizer, seconded by Walters to close the
public hearing.
.Roll call was taken on the motion. Ayes: Unanimous.
88.57. 'Motion was made by Whitehouse, seconded by Whittingham to
recommend approval of the application of Tollefson Deve opment,
Inc. for the preliminary plat of Indian Hills, a subdivision of
328 single family lots subject to'recommendations in the
Planner's report of March 16, 19$8, the Engineers report of
March. 15, 1988 and any other staff recommendations.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Jim and Mary
Steffen for a rezoning from R-7 to R-2 at 10593 W. 202nd Street
was opened. The City Attorney attested that all legal notices
.had been duly: published and mailed.
David Licht gave a review of .the rezoning. proposal and recom-
mended approval subject to .the stipulation that-an the applicant
submit an administrative subdivision of the three proposed lots
before a building permit is obtained. Mr. Steffen: was present
to answer any questions from the Commission or public.
There was no public comment.
88.58 Motion was made by Sizer, seconded by Walters to' close the'
.public hearing..
Roll call was. taken on the motion. Ayes: Unanimous.
88,59' Motion was made by Sizer, seconded by Whitehouse to recommend..
approval of the application of Jim and Mary Steffen for a
rezoningform R-7 to R-2 at .10593 W. 202nd Streetsubject to the
Planner's report of 3/11/88 and. other staff recommendations.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of R. Glenn and.
Pamela. J. Nord fora conditional use permit and/or setback
variance pertaining to a garage side yard setback at 20655 Holt
Avenue West was opened. The City Attorney attested that all
.legal notices had been duly published and mailed.
88.60 Motion was made by Whttingham, seconded by Walters to continue
the public hearing pending a report on the site plan from the
Planner.

The public hearing to consider the application of Heritage
Development for the preliminary plat of Highview Heights,. a
subdivision of 253. single family lots was opened. The City
Attorney :attested that all legal notices had been duly published
.and mailed.
Curt Gutoske gave a review of the plat: and recommended. approval
subject to the.. recommendations in the ;Planner's reports of
2/26/88 and 3/9/$8. Bob Lincoln of Heritage Development stated-
that a reduction in lots had been made per request by staff.
Several citizen comments were .made concerning:
- Trees that might be cut
- Main access street
- Lot size
Discussion among .Commission members included:
- Drainage and runoff
- Autlots
Access
- Paving of Highview- Avenue
88.61. Motion was made by Whittingham, seconded by Whitehouse to close
the public. hearing.
Rolf call was taken on the motion`. Ayes: Unanimous..
88.62 Motion was made by Langhorst, seconded by Whittingham to
recommend approval of the application of Heritage. Development
for the preliminary plat of Highview Heights subject to the
Planner's report of .3/9./88 with the addition of recommendation
number 10 being the paving of Highview Avenue up-to access of
the plat., the report from the Dakota County Soil and Water
Conservation District dated 3/2/88 and any other :staff
recommendations.

The public hearing to consider the application of Render
Development for the preliminary plat. of Lee Lake Estates, a
.subdivision of 73 single family lots and .variances from
shoreland setbacks on two lots abutting Lee Lake was opened.
The City Attorney attested that all legal notices had been duly
published and mailed.
88.b3 Motion was made by Sizer, seconded by Whittingham to continue
the public hearing pending further information from staff.
Roll call was taken. on the. motion. Ayes: Unanimous.

The public hearing to consider the application of Forest Park
Development. Corporation for the preliminarg plat of Great Oak
Shores, a subdivision of 20 single family lots and two outlots,
as well as the rezoning of outlot A from R-2 to R-7 for townhome
development was. opened. The City Attorney attested that all.
legal notices had been :duly .published and mailed.
David Licht gave a review of the plat-stating that the applca-
tion should have read R-5 instead of R-7 for the multiple
dwellings. He recommended approval subject to the recommends-
tions in the Planner's report of 3/16/88.
The issue of rezoning .was discussed and Commission members
expressed that they were not in favor of .the R-5 zoning.
Comments from the public concerned drainage into Lake Marion.
Mr. Bill Dolan, one of the developers stated that due to the
negative feelings of the Commission concerning the rezoning, he
.wished to withdraw that portion of the application at this time..
88.$4 .Motion was made by Whittingham, seconded by Walters to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
88.65 Motion was made by Whittingham, seconded by Sizer to table the
issue pending. further information from the City Engineer and .the
Natural Resources Committee..
Roll call was taken on the motion. Ayes: Unanimous.
88.66 Motion was made by Sizer, seconded by Whittingham to adjourn the
meeting.
Voice vote was taken on the motion.
