PLANNING :COMMISSION MINUTES
APRIL 7, 1988
The meeting was called to order by Vice Chairman Langhorst at
7:00 in the Lakeville Council Chambers.
Roll call of members was called. Present: Whitehouse,
MacGibbon, Whittingham, Walters. Absent: Miller, MacGibbon,
Sizer.
.Also present was Roger Knutson, City Attorney, Alan Brixus,
City Planner, Curt Gutoske, City Planner, Jim Robinette,.
Community Development Director and Mira Holliday, Recording
Secretary.
88.67b. Motion was. made by Walters, seconded by Whittingham, to
approve the minutes of the March 17, 1988. Planning Commission
-meeting.
Roll call was taken on the motion.. Ayes: Unanimous.
88.68be Motion was made by Walters, seconded by Langhorst to approve the
minutes of the March 31, 1988 Planning Commission meeting.
Roll. call was taken'on the motion. Ayes :..Whitehouse,
Langhorst, Walters. Abstain: Whittingham.
Dennis. Miller arrived at 7:12 p.m.
The public hearing to consider the application of George E.
Thompson for a rezoning from R-1 Low Density Single Family to
R-A Single Family Agricultural at 11900 & 11980 210th St. West
was opened. The City Attorney attested that all legal notices
had been duly published and mailed. Alan Brixius gave a brief
review of the application. It was decided to hold the item
until later in 'the meeting to see if Mr. Thompson would be in
attendance.
The public hearing to consider the application of Dawnlyn M.
Mulcare for a special home occupation permit for an in home
beauty salon at 17735 Iceland Trail was opened. The City
Attorney attested that all legal notices had been duly published
and mailed. Alan gave a review of the .application and plans and
.recommended approval subject to the recommendations in the
Planner's report of March 22, 1988..
Ms. Mulcare was present andstated that she was in agreement
with the recommendations. There was no .public comment.

88.69 Motion was made by Walters, seconded by Whittingham to close the
public hearing.
Roll call was .taken on the motion. Ayes: Unanimous
88.70. Motion was made by Whittingham, seconded by Walters. to recommend
approval of the application of Dawnlyn M. Mulcare for a special

The public hearing to consider the application of Thomas M.
Kearney for a planned unit development conditional use permit
for a food establishment to be located on 175th Court was'
opened. The City Attorney attested that all legal notices had
been. duly .published and mailed.
Alan Brixius gave a review o£ the plans in 'which he discussed.
site circulation, loading area , drive up window, parking,
setbacks, trash enclosure, landscaping, grading and drainage,
lighting. and signage. He recommended approval subject to
recommendations outlined in his report of 3/30/88.
Mr. Don Stenzel representing the applicant was present and
presented pictures of another existing Dairy Queen to the
Commission. He gave a brief presentation.
There were several citizens present who expressed concern over
the traffic in the area and questioned the possibility of a
signal light. Mr. Robinette explained the long range plans for
the area regarding signal lights stating it was under the
authority of the State.
The Commission members discussed various matters including:
- Drainage and grading
- Loading area
- Signage
- Parking
- Setbacks.
- Trees
- Possibility of a different layout
88.71. Motion was made by Whitehouse to table the matter for further
review. There was no second to the motion.
88.72 Motion was made by Miller, seconded by Walters to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.

.88.73 Motion was. made by Walters, seconded by Miller to recommend
approval of the application of Thomas M. Kearney for a planned
unit development conditional use permit for a food establishment:
to be located on 175th Court subject to recommendations 1
.through 5 and 9 of ..the Planner's report dated March 30, 1988 and
any other staff recommendations.
Roll call was taken on the motion. Ayes: Miller, Langhorst,
Whittingham, Walters. Nay: Whitehouse.
The reason for Whitehouse's nay being. that he feels with. the
developer owning expandable space to the south, the site could
be made safer in regard to parking and delivery.
Mr. Robinette announced that Mr. George Thompson (item ~~4) had
beencalled out of town and would not be present.
88.74 Motion was made by Walters, seconded by Whittingham to continue
the public hearing on the application of George E. Thompson for
a rezoning due to his absence..
Roll call was -taken on the. motion. Ayes: Unanimous.
The public hearing to consider the application of Vernon Lovstad
for a conditional use permit to construct a church to be located
on Highview Avenue and approximately 167th Street was opened..
The City Attorney attested that all legal notices had been duly
published and. mailed. Curt Gutoske presented a review of the
church site and plans. He discussed compatibility to the area,
a collector street which originates in the Trotters Ridge
subdivision, setbacks, phasing, .circulation, .parking, loading,
landscaping, utilities, survey,: and temporary living facilities
for church workers. He recommended approval of the application
subject to the recommendations outlined in his report of April
4, 1988.
Mr. Lovstad was present. along with other members of the Messiah
Lutheran Church building committee. Commission members
discussed all aspects of the plans with Mr. Lovstad and staff.
There. was no public comment.
88.75 Motion was made by Whittingham, seconded by Walters to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.

88.76 Motion was made by Langhorst, seconded by Whitehouse to
recommend approval of the application of Vernon Lovstad for a
conditional use permit to construct a church to be located on
Highvew Avenue and approximately 167th Street subject to the
Planner's report of April 4, 1988 with addition of driveway
visibility added to recommendation number 6 and recommendation
number 10 being that the trash enclosure be compatible with the
building.
.Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Glenn and
Pamela J. Nord for a conditional use permit and/or setback
variance pertaining to a garage side yard setback at-20655 Holt
Avenue West was continued from the March 17, 1988 meeting. Alan
Brixius gave a review of the application and recommended that
approval be denied due to request not appearing to have unique
circumstances or site conditions which merit such a
consideration.
Mr. Nord presented the Commission with several pictures of his
home and proposed garage along with a detailed explanation of
his need for. the permit and/or variance. He stated that many
homes in his area (which is an older area). are not in compliance
with the City standards. He stated .that all of his neighbors and
• adjoining property owners have no objection to his proposal.
There was no public comment.
Commission .members discussed the matter with Mr. Nord and staff
including such concerns as safety, curb cut and. setting a
precedent.
88.77. Motion was made by Miller, seconded by Whttingham to close the
.public hearing.
Roll call was taken. on the motion. Ayes:. Unanimous.
.88.78 Motion was made by Whitehouse, seconded by Miller to recommend
denial of the application of Mr, 'Nord in accordance with the
.Planner's report of 3/31/88 and safety factors.
Roll call was taken on the motion. Ayes: Miller, Whitehouse.
Nays.: Langhorst, Whittingham, Walters.
88.79 Motion was made by Whittingham, seconded by Walters to recommend
approval of .the application of Glenn and Pamela J. Nord for a
conditional use permit and/or setback variance pertaining to a
garage side yard setback at 20655 Holt Avenue West with the
condition of abandoning the present driveway.

The public hearing to consider the application of J & D Dakota
Enterprises, Inc. for the preliminary and final plat of the
Meadows 8th Addition, a subdivision of 37 single family lots and
two outlots was opened. The .City Attorney attested that all
..legal notices had been duly published and mailed. Curt Gutoske
gave a review of the plat and recommended approval subject to
the Planner's report of March 10, 1988..
Several residents of Iran Ave. were. present and expressed their
concern over traffic circulation. A lengthy discussion was held
between staff, the Commission and Jack Ardoyno, the developer.
Several alternatives,. including a temporary cul-de-sac. were
discussed. Also discussed was drainage, grading and. utilities.
.88.80 Motion was made by Whittingham, seconded by Walters to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
88.81 Motion was made by Miller, seconded by Langhorst to recommend
approval of the. application. of J & D Dakota Enterprises for the
• preliminary and final plat of the Meadows 8th Addition, a
subdivision of 37 single family lots with R-2 zoning subject to
the Planner's report of March 10, 1988 with the addition of
recommendation number.? being to terminate Ipswich Way between
Meadows 7th and 8th and subject to a load limit on Iran Avenue.
Roll call was taken on the motion. Ayes:. Unanimous.
The consideration of the application of Forest Park Development
Corporation for the preliminary plat of Great Oak Shores, a
subdivision of 20 single family lot and two outlots was
discussed. This matter had been tabled from the March 17
meeting due to concern over grading and drainage. Alan Brixius
and Jim Robinette reviewed a report from Donohue and Associates
dated February 25, 1988 in which approval was recommended. Alan
Brixius also read the minutes of the March 15, 1988 Natural
Resources Committee which recommended approval.
Bill Dolan, the developer was present.
88.82 Motion was made by Miller, seconded by Whittingham to recommend
approval of the application of Forest Park Development.
Corporation for the preliminary plat of Great Oak Shores, a
subdivision of 20 single family lots and two outlots subject
to the the Planners report of 3/16/88, the Engineer's report of
2/25/88 and the recommendations of the Natural Resources
Committee.

Roll call was taken on the motion. Ayes: Unanimous.
The public hearing. to consider the application of Rende r
Development for the preliminary plat of Lee Lake Estates, a
subdivision of 73 single family lot and variances from shoreland
setbacks on two lots abutting lee Lake was continued from the
March 17, 1988 meeting. Jim Robinette explained that there are
several problems concerning this plat and requested that it be'
continued again.
88.83 Motion was made by Miller, seconded by Walters,-to continue the
public hearing on the preliminary plat of Lee Lake Estates.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of the City of
Lakeville for an amendment to the .sign ordinance amending
Section 7.1 concerning residential area identification signs was
opened. The City Attorney .attested that all legal notices had
been duly published and mailed. Alan gave a review of the
amendment and discussion was held. Mr. Robinette stated that he
feels there is a need to create neighborhood identity.
Commission members discussed the issue of responsibility for the
signs and it was the general feeling that the City should not
. accept responsibility for upkeep.
Scott Johnson of Arcon Construction presented a drawing of an
identification sign for Lynwood North and expressed his support
for the amendment. Lighting and materials for the signs were.
discussed. Bill Pritchard of Orin Thompson. Homes was also
present and expressed his support of the amendment.
88.84 Motion was made by Miller, seconded by Whittingham to continue
the public hearing pending further specification to the
amendment.
Roll call was taken on the motion. Ayes:. Unanimous.
88.85 Motion was made by Miller, seconded by Whitehouse to table the
consideration of the. application of U.S. Home Corporation for a
variance to construct two landscaped entrance monuments that
include signage which does not conform to the sign ordinance at
the corner of County Road 46 and Hyland Avenue for the area
known as Trotters Ridge due to lack of a published legal notice.
The public hearing to consider the application of the. City of
Lakeville for an ordinance amending Ordinance No. 167, the
Zoning Ordinance, by changing the Business Campus District
designation section of the ordinance was opened. The City
Attorney attested that all legal notices had been duly published
and mailed.

88..86 Motion was made by Whittingham, seconded by Whitehouse to close
the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
88.87 Motion. was made by Whittingham, seconded by Whitehouse to
recommend approval of the application of the City of Lakeville
.for an ordinance amending Ordinance No. 167, the Zoning
Ordinance by changing the Business Campus District designation
section of the ordinance.
Roll call was taken on the motion. .Ayes: Unanimous.
Under other business, Jim Robinette submitted a resolution
establishing Tax Increment Financing District No. 9 which is the
redevelopment of four properties in the I-35 - 50 area at 176th
Street and Highway 50 f or approval..
It was requested by Commission members that this matter be
continued until Pat McGarvey, City Administrator could be
present to answer questions.
88.88 Motion was made by Miller, seconded by Whittingham to adjourn
the meeting.
Voice vote was taken on the motion. Ayes: Unanimous.
