PLANNING COMMISSION MINUTES
i APRIL 21, 1988
The meeting was 'called to order by Chairperson MacGibbon at 7.:00
p.m. in the Airlake Council Chambers.
Roll call of members was taken. .Present: .Walters,. Whittingham,
MacGibbon, Miller, Whitehouse. Absent: Sizes, Langhorst.
Also present-was Alan Brixius, Consultant City Planner; Roger
Knutson, City Attorney; Jim Robinette, Community Development
Director; and Bruce Robertson, Administrative....
Assistant/Recording Secretary.
88.92 Motion was made by Walters, seconded by Whittingham to approve
the minutes of the April 7th meeting of the Planning Commission.
Roll call was taken on the motion. Ayes: Walters, Whittingham,
Miller, Whitehouse.. Abstain: MacGibbon.
88.93 Motion was made by Miller, seconded by Walters to table
consideration of the application of Render Development for the
preliminary plat of Lee Lake Estates, a subdivision of 73 single
family lots and variances from shoreland setbacks on two lots
.abutting Lee lake until the May 5th meeting of the Planning
• Commission.
Roll call was taken on the motion. Ayes: Unanimous.
At this time, the Commission continued the public hearing to
consider the application of George E. Thompson for a rezoning
from R-1 low Density Single Family to R-A Single Family
Agricultural at 11900 and 11980 210th Street West..
Alan Brixius, consultant City .Planner, made a presentation on
the rezoning request. He stated the two parcels are 10 acres a
piece, currently outside the 2010 Urban Service area. As a
result, he doesn't see. any problem with the Agricultural
Use/Rezoning of the two parcels. A number of Commission members
had questions: or comments regarding the rezoning request, these
included•
* Concern over the applicant not showing up to discuss the
rezoning request at either of the Planning Commission
meetings of which it was on the agenda.
* The possibility of setting a limit on the number of cattle
that would be allowed on the lot.
* Problems with run off from the feed lot and the odor it may
• cause.

88.94 Motion was made by Macgibbon, seconded by Whitehouse to continue
• until the. May 5, 1988 meeting, the public hearing to consider
the application of George E. Thompson for a rezoning from R-1
Low Density Single Family to R-A Single Family. Agricultural at
11900 and 11980 210th Street West to give staff .additional time
to study the Commission's concerns.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Richard
Cecchini for a variance to build a garage to be located at 12245
175th Street W. was opened. The City Attorney attested that all
legal notices had been duly published and mailed.
Alan Brixius made a presentation on the variance request. He
stated that this request was similar to others in the Orchard
Lake area. This area had a significant number of non
conforming buildings. because of the large number of 20 foot
lots. The proposed garage would be .located 17 feet from the
street. and 12 feet from the start of the property line.
Richard Cecchini, the applicant, appeared before the Commission
and distributed some photographs of his property and presented
an alternative location proposal for his garage. He stated that
this alternative .would save a number of large oak trees on the
. property and would still allow him more driveway space than he
currently has.
A number of Commission members had concerns and .questions, which
included:
* The safety consideration of having to back out a vehicle
into the street from the garage.
* The large number of non: conforming structures in the Orchard
Lake area.
* Allowing additional non conforming structures in the
neighborhood would seta bad precedent.
* A request was made to place a number of "hidden driveway"
signs on the .street.
88.95 Motion was made by Whitehouse, seconded by Walters to recommend
approval of the application of Richard Cecchini for a variance
to build a garage to be located at 12245 175th St. subject to
the conditions set by the City Planner and Building INspector
and .utilizing the proposal submitted by the property owner
(Exhibit A).
Roll call was taken on the motion. Ayes: Walters, Whittingham,
MacGibbon, Whitehouse. Nay:. Miller.

Miller. stated he did not. believe the. approval of a variance to
build a garage on this site would provide adequate safety for
motorists..
The residents location proposal for the garage was approved over
the Planner's recommendation because it would save the trees on
the property and would require one variance instead of two.
The. public hearing to consider the application of Donald W.
Holm for an amendment to a conditional use permit to allow used.
.car sales at 10720 West 162nd Street was opened. The City
Attorney attested that all legal notices had been duly published
and mailed.
Alan Brixius distributed photographs of the site to Commission
members. He stated City staff had met with Mr. Holm a couple of
times and details of the project had been worked out to staff's
approval. He went on to state that the business would repair
and sell high quality foreign cars only. Car sales would`be
both inside and outside but only a limited number of cars
would be on the lot.
Mr. Donald Holm, the applicant, also appeared before the
Commission. He discussed the nature of his business and his
plans for upgrading the existing facility on the property.
There were a number.. of questions and comments by Commission
• members regarding the proposal, which included:
* A concern over existing traffic levels near the property.
Parking on the street. by customers near the business.
* The use of landscaping around the property that would impair
the view of motorists.
* Dumpster location.
* The type of signs that will be used.
* The number of trade. in.'s accepted and the resulting storage
problems.
* A request was made to place stop signs near the intersection
of 162nd and the Frontage Road.
* The .possibility that a new-owner could come in and sell poor
quality cars on the site in the future.
The above items were addressed by the City staff and developer...
88.96. Motion was made by Miller, seconded by MacGibbon to close the
• public hearing.

approval for an amendment to a conditional use permit to 'allow
.used car sales at 10720 West 162nd Street with the conditions
stated in the Planners report and an additional requirement to
install one handicapped parking stall on the site.
Roll call was taken on the motion.. Ayes: Unanimous.
At this time, the Commission re-opened the public hearing to
consider the application of the City of Lakeville for an
amendment to the sign ordinance amending Section 7.1 concerning
residential area identification signs.
Alan Brixius made a lengthy presentation on the proposed
ordinance amendment. He stated the signs would be used to
identify specific residential subdivisions and would be limited
to two signs for each entrance to an area from major collector
or arterial streets. He went on to describe the proposed
ordinance amendments specific regulations pertaining to size
limitations, set back requirements, maintenance standards and
sign construction specifications.
A number of Commission members had concerns/comments or ques-
tions regarding the proposed ordinance amendment, these
• included:
* Who would be responsible for upkeep/maintenance?
* Insurance and utility costs, who would pay for these?
* City's responsibility to pay the cost of sign replacement
if a sign is removed due to poor maintenance.
88.98 .Motion was made by Miller, seconded by Whitehouse, to Gable
consideration of the application of the City of Lakeville for an
amendment to the sign ordinance. amending .Section 7.1 concerning
residential area identification signs until the Planner has
additional time to insert any language changes to the amendment
suggested by Planning Commission members.
Roll call was taken on the motion. Ayes: Unanimous.
Whitehouse asked City staffto put on the next Planning
Commission agenda, consideration recommending downgrading all
R-7 zoned property in the City.
88.99 Motion was made by Miller, seconded by Whitehouse to adjourn the
meeting.
