HomeMy WebLinkAbout05-05-88 CITY OF LAKEVILLE PLANNING. COMMISSION MINUTES .MAY 5, 1988 The meeting was called to order by Vice Chairman Langhorst at 7;00 p.m. in the Airlake Council Chambers. Roll call of members was taken. Present: Whitehouse, Miller, Sizer, Langhorst, Whittingham, Walters. Absent: MacGibbon. Also present was Alan Brixius, City Planner, Roger Knutson, City Attorney, Jim Robinette, Community Development Director and Mira Holliday, Recording Secretary. 88.100 Motion was made by Miller, seconded by Walters to approve the minutes of the April 21, 1988 Planning Commission meeting. Roll call was taken on the motion. Ayes: Whitehouse, Miller, Whittingham, Walters. Abstain: Sizer:, Langhorst. The public hearing to consider the application of Render Development-for the preliminary plat of Lee Lake Estates, a subdivision of 73 single family lots and variances from shoreland setbacks on two lots abutting Lee Lake was continued from the last meeting. Mr. Langhorst announced that the application had been withdrawn by Mr. Render. 88.101. Motion was made by Whttingham, seconded by Walters to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of George E. Thompson for a rezoning from R-1 Low Density Single Family to R-A Single Family Agricultural at 11900 and 11980 210th Street West was continued from-the last meeting. Alan Brixius gave a review of the application and recommended approval. Mr. Thompson explained his .proposal stating he planned to have a small farm with no more than 12 cows and eventually build a new home. The Commission discussed the issue and felt it was a positive step. 88.102 Motion was made by Sizer, seconded by Miller to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 88.103 Motion was made by Miller, seconded by Whittingham to recommend approval the application of George E. Thompson for a rezoning from R-1 Low Density Single Family to R-A Single Family Agricultural at 11900 and 11980 210th Street West subject to the Planner's report of March 31, 1988. PLANNING COMMISSION MINUTES MAY 5, 1988 Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of George Thompson for a rezoning from R-2, Single Family to R-4, Single and Two Family at the corner of County Road 5 and Orchard Lake .Road was opened. The City Attorney attested that all legal notices had .been duly. published and mailed. Alan Brixius gave a review of the proposal and stated that the rezoning of the property is a policy decision, therefore he made no recommendation. Mr. Thompson reviewed his plans stating he planned to build a duplex of which he provided a drawing. He stated he felt his buildings would improve the looks of the area and would be compatible. Mr. Donald Gordhamer of Kenmore Drive presented the Commission with a petition of surrounding residents opposing the rezoning. He stated .they feel it would set a precedent. He was also. concerned over the access to the property. There were other citizens present who also opposed the rezoning. The Commission members discussed the issue and agreed they felt uncomfortable with increasing the density of the area. 88.104 Motion was made by Miller, seconded by Sizer to close the public hearing.. .Roll call was taken on the motion. Ayes: Unanimous. 88.105. Motion was made by Walters, seconded by Whittingham to recom- mend denial of the application of George E. Thompson for a rezoning from R-2, Single Family to R-4, Single and Two Family at .the corner of County Road 5 and Orchard Lake Road due to concerns over increasing density in the area. Roll call was. taken on the motion.. Ayes: Unanimous. Alan Brixius gave a review of the final plat of Cherry High- lands, a subdivision of 86 single family. lots. He stated. that the preliminary .plat had been approved by the. City Council and the final plat is consistent with that layout. He discussed the possible need for pedestrian ways between Cherry Highlands and another plat that has not been presented to the Commission yet. He recommended approval o£ the final plat contingent on the recommendations in the: Planner's report of April 27, 19$8 and the addition of recommendation number four being the resolution of the pedestrian way., Mr. Ray Brandt was present representing the developer. He reviewed the plat and answered questions of the Commission.: 2 PLANNING COMMISSION MINUTES MAY 5, 1988 88.106 Motion was made by Miller, seconded by Whittingham to recommend approval of the final plat of Cherry Highlands, a subdivision of 86 single family lots and a minor comprehensive plan amendment to include the .area in the 1990 Urban .Service Area subject to the. Planner's. report of April 27, 1988. Roll call was taken on the motion. Ayes: Unanimous. .The public hearing to consider the application of Glen Klotz for a preliminary plat, to be known as Orchard Lake Hills, and planned unit development and a minor comprehensive plan amendment to include the area in the 1990 Urban Service Area was opened. The City Attorney attested that all legal notices had been duly published and mailed. Alan Brixius reviewed the plat and stated it was consistent with the area redevelopment plan. He explained the reason for the planned unit development and discussed lot area and width. He stated that preliminary plat and the planned unit development can be given approval before the Langley Street construction issue is resolved, however the situation must be addressed before any final platting procedures begin. He also stated that the Natural Resources Committee tabled the issue at their May 3, 1988. meeting. He recommended approval subject to the recommenda- tions in the Planner's report of April 27, 1.988. Frank Kriz of Land Surveyors along with Glenn Klotz, was present. Several citizens were present and voiced their concerns over the project which included: * Increased value of property * Special assessments that might occur due to improvement of Langley Avenue. * Cul-de-sac .length Protected wetlands * Street and driveway grades * Drainage and erosion control * Access to property while Langley Avenue is under construction These concerns were addressed by City staff and Mr. Kriz. Several citizens stated they wished to go on record that. they opposed the project. Two citizens stated they were in favor of the project as it would help to clean up the area and make it more attractive. The Commission then directed questions to Mr. Kriz and staff members. Issues included were: 3 PLANNING COMMISSION MINUTES MAY 5, 1988 * Concern over access to property * Density of lots * Drainage * Easements 88.107 Motion was made by Miller, seconded by Whittingham to continue the public hearing to consider the application of Glen Klotz for a preliminary plat, to be known as Orchard Lake Hills, and a planned unit development and a minor comprehensive plan amendment to include the area in the 1990 Urban Service Area pending further review of the Planner into access to the property and comment by the .Natural Resources Committee. Roll call was taken on the motion. Ayes: Unanimous. .The public hearing to consider the application of the City of Lakeville for an amendment to ordinance 167, the Zoning Ordinance, amending. Section 37, Auto-Oriented Business District, by adding major auto repair as a conditional use was opened. The City Attorney attested that all legal notices had been duly published and mailed. Alan Brixius gave a review of the amendment discussing hours of operation, lot size, painting, odors and noise that can.-occur with major automobile repair business. • Mr. Gary Turpening representing Duane Marek gave a brief presentation on a possible proposal if the amendment is granted. The Commission discussed such issues as: * Comparison of other communities * Provisions for combustible materials * Lot area and width * Outside storage * Parking 88.108 Motion was made. by Sizer, seconded by Miller to close the public hearing. Roll call was taken on the motion. Ayes:. Unanimous. 88.109 .Motion was made by Sizer, seconded by Miller to recommend approval of the application of the City of Lakeville .for an amendment to Ordinance 167, the Zoning Ordinance, amending Section 37, Auto-Oriented Business District, by adding major auto repair as a conditional use subject to Planner addressing the lot area and width and provisions for combustible materials.- Rolf call was taken on the motion. Ayes: Unanimous. i 4 ' A PLANNING COMMISSION MINUTES MAY 5, 1988 The public hearing to consider the application of the City of Lakeville for an amendment to the sign ordinance amending Section 7.1 concerning residential area identification signs was continued .from the last meeting. Alan Brixiusreviewed the revisions made to the amendment. Lee Johnson of U.S. Homes presented a display showing a proposal for a sign for Trotter's Ridge (Hypoint Crossing). He asked that more flexibility in the size of signs be considered. A discus- sion was held concerning the size. allowable and it was agreed that 48 square feet should be sufficient. 88.110 Motion was made by Sizer, seconded by Miller to close the public hearing.. Roll call was taken on the motion. Ayes: Unanimous.. 88.111. Motion was made by Miller, seconded by Whitehouse to recommend approval of the application of the City of Lakeville for an amendment to the sign ordinance amending section 7.1 concerning residential area identification signs and corrections as annotated by the Planner. Roll call was taken on the motion. Ayes: Unanimous. 88.112 Motion was made by Sizer, seconded. by Miller to adjourn the • meeting. Voice vote was taken on the motion.
