CITY OF LAKEVILLE SPECIAL PLANNING COMMISSION MEETING MINUTES JUNE 23,.1988 The meeting was called to order by Diane MacGibbon, Chairperson at 7:00 p.m. in the Airlake Council Chambers. Roll call of members was taken: Present: Whitehouse, Whittingham, Miller, MacGibbon. Absent: Langhorst, Sizer, .Walters. Also present was Jim Robinette, Community. Development Director,. Alan Brixius, City Planner. 88.132 Motion was made by Miller, seconded by Whittingham to approve the minutes of the June 16, 1988 Planning Commission meeting. Roll call was taken on the motion. Ayes: Whitehouse, Whittingham, Miller. Abstain: MacGibbon The public hearing to consider the application: of Grist Mill Company for apreliminary and final plat was opened. Mr. Robinette attested that all legal notices had been dulypub- lished and mailed. A review was held by Alan Brixius. He indicated that this lot split is necessary for the Grist Mill to • obtain a mortgage on their newly constructed addition. He stated that the subdivision meets the requirements of the City ordinances. The City staff. recommended approval. There was no public comment. 88.133 Motion was made by Miller., seconded by Whitehouse to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 88.134 Motion was made by Whittingham, seconded by Whitehouse. to recommend approval of the preliminary. and final plat of Grist Mill Addition. Roll call was .taken on the motion.. Ayes: Unanimous. The public hearing to consider the application of Eldon Fossum for a preliminary plat, to be known as Marion Pines, a planned. unit development and a minor comprehensive plan amendment to include the area in the. 1990 Urban Service Area was opened. Mr. Robinette attested that all legal notices had been duly published and mailed. The Commission was presented a letter by Mr. Douglas P. Anderson commenting on the plat. The letter is attached to these minutes. • l PLANNING COMMISSION. MINUTES JUNE 23, 1988 Mr. Eldon Fossum gave a presentation of his plat indicating that it is a replat of an area that had been platted many years ago. He stated that the .City Council had granted concept approval in 1985.. Mr. Robinette indicated that the Natural Resources Committee recommended approval at'their meeting on June 21, 1988. He .also indicated that a public improvement project would be necessary for the upgrading of 199th Way, as it is still in a gravel condi ion. Mr. Brixius provided a complete review of the plat and his recommendations contained in a report dated May 25, 1988. He noted that there were some slight changes in the alignment of the plat from the original concept granted in 1985, however they are relatively minor and do make a better use of the property. He stated he feels it is superior in all respects. Mr. David Frost, a resident of the area was present and com- mented on the danger of the intersection of Highway 50 and Jacquar Avenue. Mr. Robinette stated that the Minnesota Department of Highways currently is in the design phase of a project to reconstruct a curve on Highway 50 in the vicinity of Jacquar. Mr. Robinette commented that both the Dakota County Soil and Water Conservation District and the Natural Resources Committee had been concerned with the cumulative effect of nutrients in Lake Marion when recent plats were viewed from a cumulative basis instead of individually. That is the reason Dakota County. Soil and Water Conservation District has been recommending, for quite some time, storm sewer ponding be constructed so as to lower the levels of phosphorus that .are in the lake. This practice has been followed and will be followed in accordance with their recommendations in this plat. Mr. Tom Rasmussen, a resident of the area was present and asked questions concerning the difference between R-6 .and R-7. This was .explained by the Planner. He also indicated that there: is currently a driveway entrance near his house that has a water hydrant almost in the driveway. He asked if this hydrant could be moved with the reconstruction of the road. Mr. Robinette indicated that this could be taken care of during construction of the road. The Planner indicated that the R-6 portion of the plat was .not being .considered in conjunction with this phase and would have to betaken up if and when that area is final platted. He also explained the current moratorium on R-7 developments in Lake- ville and the staff study that is underway at the :Council's. rec- ommendation. The proposed R-6 portion of the Marion Hills plat .would remain an outlot subject to final platting. The .Planner explained the difference between the 46 lot concept and the 49 lot preliminary plat being pursued. Mr. Whitehouse commented 2 PLANNING COMMISSION MINUTES JUNE 23, 1988 that he preferred the smaller number of lots as indicated in the .concept plan. He also indicated that the Planner should explore a minimum of 15,000 square foot lots. He commented that he would prefer single family next to the highway in place of the higher density R-6 that was indicated in the concept plan.. The developer indicated that he expected the houses to be in $125,000 to $165,-000 range. The recommendation from the Park Committee was reviewed in which a trail would be built on street to link other. bicycle trails from the east and west. 8$.135 Motion was made by Miller, seconded by Whittingham to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous.. 88.136 Motion was made by Whittingham, seconded by MacGibbon to approve the preliminary plat of Marion Pines subject to the Planner's report. dated May 25, 1988 deleting recommendation ~~7, a planned unit development and a minor comprehensive plan-amendment to include the area in the 1990 Urban Service Area.' Roll call was taken on the motion. Ayes.: MacGibbon, Whttingham, Whitehouse. Nays: Miller • Mr. Miller voted na because he felt recommendation number 7 of y the Planner's report .should be deft in. 88.137 Motion was made by Whittingham, seconded by Miller to adjourn the meeting.. The`Planning Commission will be reviewing and/or -approving this on June ' 23 at their meeting which I am unable to attend. - I have noted my comments below and wish them to be a matter-of public record. First, the plan provides for 49 lots (R-2) plus the outlot (R-6). This is a significant increase in density of that area, currently a field. At Jaguar and Highway' 50, we currently have .many accidents ayear some-serious. '(I can .recall two deaths.} This improvement will increase-that traffic ignifi- • cantly and, in ,turn, increase the risk of 'accidents: I would recommend additional access into the development. be provi-led on the east end, from the cul-de-.sac. ofif 197th Street around pond to,Ttaly Avenue by Antlers Park). Second, the Soil and Water Conservation Report, on file at City Hall, indicated that the algae level in Lake Marion would increase significantly and noticeably by this plan. They indicated also that if the'R-6 outlot density were reduced to R-2 i t would reduce that effect. I believe that the R-6 density should be eliminated and Towered to R-2 throughout the development for this reason. Let's do what we can to preserve our lake!! Thirds for a development of this size, should there not be a small park Alarmed? Might I suggest that the outlot, or a portion thereof, be a neighborhood. park..
