PLANNING COMMISSION MEETING MINUTES
JULY 7, 1988
The meeting was .called to order at 7:00 p.m. by Steve Sizer,
acting Chairman in the Airlake Council Chambers.
Roll call of members was taken. Present: Whitehouse, Miller,
Sizer, Whittingham, Walters. Absent: MacGibbon, Langhorst.
Also present was Alan Brixius, City Planner, Elliott Knesch,
City Attorney, Jim Robinette, Community Development Director and
Mira Holliday, Recording Secretary.
88.138 Motion was made by Miller, seconded by Whittingham to approve
the minutes of the June 23,..1988 Planning Commission meeting.
Roll call was taken on the motion. Ayes: Unanimous.
Alan Brixius gave a review of the alternate plans of the Orchard
Lake Hills plat. He explained that alternate plans had been
discussed at a workshop meeting of the City Council. The
developer, Mr. Glenn Klotz had been asked to resubmit an
alternate plan that he would be in agreement with to the
• Planning Commission for review and recommendation. Mr. Brixius
recommended approval of the plan subject to recommendations
listed in his report of July 1, 1988.
The Commission discussed various aspects of the plat including
lot size in the northern cul-de-sac area, the elimination of the
subdivision in Block 1, creating three substandard lots from
existing conforming platted lots, the establishment of minimum
setbacks for the lots in Block 3 and drainage plans.
Glenn Klotz and Mr. Frank Kriz was present to answer questions
of the Commission. Mr. Kriz distributed a drawing showing
larger lots on the upper section of the plat. Commission
members expressed that they liked the larger lots. Mr. Klotz
stated that Langley Avenue will not be disturbed and that he
would consider paying for the improvement of that street if any
costs were to be assessed to the residents of the area.
Mr. Robinette stated that the Natural Resources Committee had
reviewed the plat and recommended approval.
88.139 Motion was made by Whittingham, seconded by Walters to recommend
approval of the plat of Orchard Lake Hills as submitted to the
Planning Commission on July 7, 1988 and addressed as number 1 in
the July 1, 1988 Planner's report, eliminating recommendation
number 2 of the report and subject to any other recommendations
by City staff.

Roll call was taken on the motion. Ayes: Whitehouse, Sizer,
Whittingham, Walters. Nays: Miller
Miller stated the reason he voted nay was he felt there should
be two lots in Weisner's Addition instead of three.
The public hearing to consider the application of Glenn Hulburt
for the .vacation of Washkie Avenue was opened. The City
Attorney attested that all. legal notices had been duly published
and mailed. Alan Brixius gave a review of the request stating
that he was in agreement with the Engineer's report of June 22,
1988 which states that the topography of the land would make
construction of a street in that location difficult and that the
vacation .could be approved without disrupting access to the
surrounding area.
88.140 Motion was made by Walters, seconded by Miller to close the
public hearing..
Roll call was taken on the motion. Ayes: Unanimous.
88.141 Motion was made by Walters, seconded by Whittingham, to
recommend approval of the application of Glenn Hulburt for the
vacation of Washkie Avenue.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Alan and Jo
Ann Morphew for a conditional use permit to build a second
detached garage at 18275 Ixonia Avenue West was opened. The
City Attorney attested that all legal notices had been duly
published and mailed. Alan Brixius gave a review of the request
and stated that the lot being one and one half acres was larger
than the typical lot of the area. He also stated that a
certificate of survey should be provided by the applicant before
approval is given by the City Council.
Mr. and Mrs. Morphew along with Mr, and Mrs. Leonard Quist were
present and discussed problems with past surveys of the area.
Mr. Robinette stated he would contact the surveyor and request a
letter certifying the present survey before the matter goes to
City Council.
88.142 Motion was made by Miller, seconded by Whitehouse to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.

• 88.143 Motion was made by Miller, seconded by Walters to recommend
.approval of the application of Alan and Jo Ann Morphew for a
conditional use permit to build a second detached garage at
18275 Ixonia Avenue West, subject to the recommendations in the
June 23, 1988 Planner's report plus an additional four square
feet and the applicant provide a certificate of survey before
consideration of this request be sent to City Council.
Roll call was taken on the motion.. Ayes: Unanimous.
The public hearing to consider the application of the City of
Lakeville for a revision to Section 9.2 of the Zoning Ordinance
concerning the temporary use of motor homes as buildings was
opened. The. City Attorney attested that all legal notices had
been duly published and mailed. Alan Brixius reminded the
Commission of an application previously submitted by Messiah.
Lutheran Church for a conditional use permit which included a
' request for volunteer church laborers to live on the site during
construction. This conditional use permit was approved with the
exclusion of the latter request. The City Council asked that
the Planning Commission review the ordinance drafted by the City
Planner and Attorney in an effort to accommodate this matter.
-Mr. Brixius reviewed the draft ordinance and discussion was
.held. He recommended approval of the ordinance subject to
recommendations in his report of June 30, 1988 and that this
ordinance be targeted more for churches and/or public
facilities. The Commission held a detailed discussion which
included:
- Sanitation.
- Number of people living in each motor home.
- Wording of the draft .ordinance concerning motor home instead
of mobile home.
- Concern over other developers being able to house construction
workers on site.
- Security for the site.
- Possibility of repealing the ordinance if problems occur.
It was the general feeling of the Commission that. approving this
ordinance would open the City up to future problems. Members of
the Messiah Lutheram Church Building Committee and the Pastor of
the church were present and stated they appreciated the effort
the City has made to try and accommodate this need.
88.144 Motion was made by Miller, seconded by Whittingham to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.

88.145 Motion was made by Miller, seconded by Whittingham to recommend
denial of the application of the City of Lakeville for a
revision to Section 9.2 of the Zoning Ordinance concerning the
temporary use of motor homes as buildings.
Roll call was taken on the motion. Ayes.: Unanimous.
The Commission stated that if the City Council decides to pass
the ordinance revision that they consider the following
changes to the draft ordinance:
- Use the term motor home as defined by State Statue.
- No more than five motor homes on the site.
- No more than four occupants per motor home.
- Enact a repeal of the ordinance 120 days afterward.
The public hearing to consider the application of Messiah
Lutheran Church for a conditional use permit for volunteer
laborers to live. temporarily. on church site during construction
was opened. The City Attorney attested .that all legal notices
were duly published and mailed.
Commission members stated that the denial of the previous
ordinance amendment was not a reflection of their feelings
regarding Messiah Lutheran Church in any way.
88.146 Motion was made by Miller, seconded by Walters to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
88.147 Motion was made by Miller, seconded by Walters, to recommend
denial of the application of Messiah Lutheran Church for a
conditional use permit for volunteer laborers to live
temporarily on church site during construction.
Roll call .was taken on the motion. Ayes: Unanimous.
88.148 Motion was made by .Miller, seconded by Whittingham to adjourn
the meeting.
Voice vote was taken on the motion.
