PLANNING COMMISSION MEETING MINUTES
AUGUST 18, 1988
The :meeting was called to order at..7:00 p.m. by Terry
Langh~rst, acting Chairman in the Airlake Council Chambers.
Roll call of .members was taken. Present: Whitehouse, Miller,
Sizer, Langharst, Walters. Absent: MacGibbon Whittingham.
Also present was Alan Brixius, City Planner, Elliott Knesch,
City. Attorney, Curtis Gutoske, Consultant Planner with
Northwest Associated Consultants and Daryl Morey, Assistant
Community .Development .Director.
Whitehouse had a correction to the minutes of the August 4,
198$. Planning Commission meeting. Page 4, Motion 88.164, last
word on the second line should read applicant not application.
88.166 Motion was ..made by Whitehouse, seconded by Sizer to approve the
minutes of the. August 4, 1988 Planning Commission meeting with
the correction as stated.
Roll call was taken on he motion. Aye:. Whitehouse,.Sizer,
Langhorst, Walters. Abstain: Miller
Alan Brixius reviewed the findings of Mike Mueller of the DNR`
related to Kingsley Lake.
John Batten, Dako a County Soil and Water Conservation Dis-
trict, discussed Mike Mueller's. depth study of Kingsley Lake..
The findings of the study reveal that Kingsley Lake. has an
average depth. of six feet; and .through the waterski course, the
depth. readings. range from fourfeet to eight feet.. The lake
level was lower whensampled by the U.S.G. S. in 1976 than it is
today. The lake. is normally lower than it is now and it is
likely to return to that Gower level. There are floculant
sediments on the lake bottom. The sediments are suscepitible
to disruption by motor action. Turbidity from motor action
would cause disruption of the organic material at the bottom ~f
.the. lake..
There were a number of citizens present who expressed .concern
about the effect motor boats. will have nn the loon, geese and
duck population ~f the lake; the effect of oil and gas spillage
from motor boats; the swimming platform; and the effect if
more water skiers choose to use the lake.
Bill Sowers,. Kingsley Lake property owner, stated that the
waterski club was set up .primarily for insurance purposes. The
lake will be used by 3 - 4 people, 4 - 6 hours per week,...
approximately 5 months per...year. He stated the club located on
Kingsley Lake because they were forced off..Orchard Lake by
Steve Michaud, Lakeville Parks Director. He concluded that

sedimentation is not occurring in the lake and .that the
vegetation is in place.. He pointed out the advantages of
skiing on Kingsley. Lake versus Marion Lake. He claimed his
rights are at stake on this issue.
.88..167 :Motion was made by Sizer, seconded by Whitehouse, to close the
public hearing to consider the application of the City of
Lakeville for an ordinance amending Title 7, Chapter 2 of 'the
Lakeville City Code concerning. water surface usage..
Roll-call was taken on the motion. Ayes: Unanimous.
Miller questioned what the residents want on-the lake.... He felt
Section 5 of the proposed ordinance amendment should be
removed.
Walters stated there was no evidence of damage to the lake.
Whitehouse stated he would like Kingsley Lake to be like it was
before. the waterskiing club arrived. He thought the club
.should be located on Orchard Lake in a place other than the one
they were asked to move from.
Sizer stated that'Mr. Sower is not totally to blame for the
disruption of the loons on the lake. He recommended the
deletion of horsepower limits under Section 5 of the proposed
ordinance amendment.
Langhorst stated there are basically three options availables
1) Open Kingsley Lake to the public, 2) Leave 'Kingsley lake as
it is, .and 3) Do not allow. any boats on Kingsley Lake.
88. 16$ Motion was made by Sizer, seconded by Whitehouse to recommend
approval of the ordinance amending Title 7, Chapter 2 of the
Lakeville City .Code: amending Section 5, Motors, to exclude the
use of any boat motors on Lake Kingsley and Lee Lake.
Roll call was taken on the motion.. Ayes: Whitehouse, Sizer.
Nays: Miller, Langhorst, Walters.
Langhorst voted nay .because he..felt the ordinance does not
satisfy all the landowners on the lake.
Walters voted nay because he felt there was not a good
alternative course for the water ski club to use within the
City and did nat want to take away any existing property owners
right to use a larger motor on the lake.
Miller voted nay because he agreed with Walters.
88.169 Motion was made by Langhorst, seconded by Miller to recommend.
approval of the ordinance amending Title 7, Chapter 2 of the
Lakeville'City Code deleting Section 5.

Roll call was taken on the motion. Ayes: Miller, Langhorst,
Walters. Nays: Whitehouse, Sizer.
Whitehouse voted nay because there are other public areas for
this ype of use.
Sizer voted nay because the use of the the lake in that fashion
was not consistent with .the "Natural Environment Lake"
classification.
Curtis Gutoske reviewed the Orchard Lake Hills final plat
recommending approval subject to recommendations made in the
August 15, 1988 Planner's report.
88..170 Motion was made by Miller, seconded by Walters to recommend
approval of the. final plat of Orchard Lake Hills..
Roll call was taken on the motion. Ayes: Unanimous.
Alan. Brixius reviewed the final plan of Marion Pines,
recommending .approval subject to recommendations made in the
August 11, 1988 Planner's report.
88..171 Motion was made by Miller, seconded by Whitehouse to recommend
approval of the final plat of Marion Pines...
.Roll .call was taken on the. motion. Ayes:. Unanimous.
Curtis Gutoske reviewed the .final plat of Rolling Oaks 5th and
bth Additions. he recommended.. approval subject to the
recommendations made in the August 15, 1988 Planner's report.
88.172 Motion was made-by Walters, seconded by Szer, to recommend
approval of the final plat: of Rolling Oaks 5th and 6th
Additions.
Roll call was taken on .the motion. Ayes: Unanimous.
The public hearing to consider the application: of Gerald
Bedeaux for a conditional use permit for a commercial planned
unit development to include outdoor sales and storage withina
B-4 zoning district was continued from. the last meeting. Alan
Brixius outlined the concerns stated by Northwest Associated
.Consultants in a letter sent. to Mr. Bedeaux dated August 11,
1988. Those concerns related to parking, landscaping and
screening. He recommended approval subject to concerns. and
recommendations outlined. in the August 11, 1988 Getter and the
Planner's repgrt dated July 27, 1988.
Mr Bedeaux. stated that his outside storage area was currently.
screened by a 10 foot .high fence and that his dumpster was
screened as well.

Commission members asked questions related to parking,
lighting, curbing, signage, loading/unloading, fuel storage,
dumpster size, vehicle storage and outdoor parts storage.
.88.173 Motion was made by Sizer, seconded by Walters, to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
88.174 Motion was made by Whitehouse, seconded by Sizer to recommend
approval of the. application of Gerald Bedeaux for a commercial
planned unit development to include outdoor sales and storage
within a B-4 zoning district, subject to the recommendations in
the. August 11, 1988 and July 27, 1988 Planner's reports;
contingent upon the deferment of 14 parking stalls until such
time as-demand exceeds supply the City may require the
additional stalls be provided; and subject to any other
recommendations by City staff.
Roll call was taken on the motion. Ayes: Whitehouse, Sizer,
Langhorst, Walters. Nay: Miller
Miller stated the reason he voted nay was because he is
concerned about the parking situation on the site.
The public hearing to consider the. application of Wayne Brown
and. Arnold Christensen for a conditional use permit to move a
buildingwas opened. The City Attorney attested that all legal
notices had been duly published and mailed.
Alan Brixius reviewed. the conditional use permit, recommending
approval subject to the recommendations made in the August 8
and 18, 1988 Planner's reports. He also described existing
conditions with regard to outside storage on the site.
Wayne Brown, Brown and Chris, stated he would like an exception
to the 24 foot driveway width. outlined in the Planner's report.
He stated the existing 12 foot wide driveway is sufficient as
there are only three or four office employees that would
utilize the driveway. He also stated the office building being
moved onto the site is .only temporary.
Miller asked if there was an existing well and septic system on
the site. Mr. Brown stated there is an existing well and
septic system andthe City has a record of it.
88:175 Motion was made by Sizer, seconded by Miller, to 'close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.

88.176 Motion was made by Walters, seconded by Sizer, to recommend.
approval of an application by Wayne Brown and Arnold
Christensen for a conditional use permit to move a building,.
subject to recommendations listed in the Planner's reports of
August 8 and 18, 1988 except to allow a 12 foot instead of a 24
foot wide driveway and any other recommendations of City.
staff and the Building Department.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of
Chemcentral/Minnesota for a planned unit development
conditional use permit was opened. The City Attorney attested
that all. legal notices had been duly published and mailed.
Alan Brixius reviewed the conditional use permit, recommending
approval subject to the recommendations`made in the August 8,
1988 Planner's report.
Dave Frede,.General Manager of Chemcentral/Minnesota reviewed
the site .plan. He stated drainage. is toward the front of the
lot along Hamburg. He also stated the Fire Department is
requiring two driveways be provided even though. he would prefer
only having to provide one.
88.177 Motion was made by Sizer, seconded by Whitehouse, to close the
public hearing.
Roll ,call was taken on the motion. Ayes: Unanimous.
Walters asked if one, larger driveway could be provided as
opposed to two,_24 foot wide driveways.
Alan Brixius responded yes, if .approved by the City Engineer.
88.178 Motion was made by Miller, seconded by Whitehouse, to recommend
approval of an application by Chemcentral/Minnesota. for a
planned unit development conditional use permit, subject to
recommendations listed in the Planner's report of August 8,
198$ and any other staff recommendations especially from the
City Engineer `and the Fire Department regarding the driveway
curb. cut.
Roll call was. taken on the motion. Ayes: Unanimous.
88.179 Motion was made by Sizer, seconded by Miller to adjourn the
meeting.
