PLANNING COMMISSION.. MEETING MINUTES
SEPTEMBER 1, T988
The meeting was called to order by Diane MacGibbon, Chairperson
at 7:00 p.m. in the Airlake Council Chambers.
.Roll call of members was taken. Present: MacGibbon, Langhorst,
Whitehouse, Whittingham, Walters. .Absent: Sizer, Miller.
88..1.80. Motion was made by Langh~rst, seconded by Walters,to approve the
minutes of .the August 18, 1988 meeting..
Mr. Whitehouse pointed out that on page 3, paragraph 2 the word
"areas" was misspelled. Staff indicated that it would be
corrected.
Roll call was. taken on the motion. Ayes: Langh~rst,
Whitehouse, Walters. Abstain: Whittingham, MacGibbon.
The .public hearing to consider the application of Eldon Fossum
to vacate all ...public streets, alleys and easements within the
.Marion Pines plat was opened. The City staff attested .that
all legal notices had been duly published.
A presentation was given by City staff, indicating that .since
Marion Pines is being replatted, it was necessary to approve the..
vacation of these streets and alleyways within. the .old plat
before the new plat can be filed. Staff and the Planning..
Commission xeviewed the Planner's report dated August 28, 1988.
Mr. Carl Lutgens of 10127 199th Way was. present and indicated
that he is a homeowner in the area. He .stated that there are
some old platted right-of-ways on his property and he-asked
if the developer could have them removed along with the `matter
at hand. The City staff indicated that the developer could only
take care of platted right-of-ways within the portion he was
replatting and if there were other areas outside of the platted
area, owners would have to request vacation on their own'
property.
88.181_ Motion was made by Langhorst, seconded by Walters. to close. the
public hearing.
Rolla call was taken. on the motion. Ayes: .Unanimous.
88.182. Motion was made by Walters, seconded by Whttingham to recommend
approval of the vacation of the streets and right-of-ways within
the plat of Marion Pines as requested and approve the survey
indicating. that vacation.
Roll call was 'taken on the motion. Ayes: Unanimous.

The Chairperson entered into the record, a letter from Mr. Bill
Stewart, devehper of Marion Village by the Lake to the Planning
Commission indicating that he was proceeding as fast as he could
reasonably solve some problems with the platting and also
indicating his satisfaction with the-way he has been treated by
the City commissions and staff.
Mr. Whitehouse asked`Mr. Robinette to find out an actual
completion date"for the lights being installed at I-35 and
Highway 50 and let him know at the next meeting.
88.183 Motion was made. by Walters, seconded by Whittingham, to adjourn
the meeting.
.Voice vote was taken on the motion.
