PLANNING COMMISSION MEETING MINUTES
SEPTEMBER 15, 1988
The meeting was called to order by Steve Sizer, acting Chairman
at 7:00 p.m. in 'the Airlake Council Chambers.
Roll call of members was taken. Present: Whitehouse, Miller,
.Sizer, Whittingham, Walters. Absent: Langhorst, MacGibbon.
Also in attendance was David Licht, Consulting Planner, Elliott
Knesch, City Attorney, Daryl Morey, Assistant Community
Development Director and Mira Holliday, Recording Secretary.
88.184 Motion was made by Whittingham, seconded by Walters to approve
the minutes of the September 1, 1988 Planning Commission
meeting.
Roll call was taken on the motion. Ayes: Whitehouse, Walters,
Whittingham. Abstain: Miller, Sizer.
The public hearing to consider the application of Robert E.
Swanson for a conditional use permit for outdoor rental and
outdoor storage was opened. The City Attorney attested that all
• .legal notices had been duly published and mailed. Daryl Morey
gave a review of the application, stating that the conditional
use permit was applied for after the outdoor storage and rental
had begun. He discussed various items, including:
- Screening of the area.
- Storage area being grassed.
- Lighting.
- Parking spaces
- Advertisement
Mr. .Morey .stated that the City must decide if outdoor display
and storage is an appropriate use in the area requested or if it
would be considered unsightly to the neighboring area.
Mr. Swanson was present and answered questions of the
Commission. He stated that he was not made aware of the
requirement for a conditional use permit at the time he leased
the property. The City Attorney stated that the property owner
should be made aware of these proceedings.
The Commission members stated they. were not in favor of the
Large trucks being parked in front of the business. The concern
of the advertising on the trucks being in violation of the sign
ordinance was discussed as well as how snow removal would be
handled. The Commission felt that the City is in need of this
type of business but needs to be handled in a different manner.
Mr. Swanson stated he is willing to park the trucks behind the
building and utilize other means of advertising. He stated he

i was agreeable to continuing the matter in order to meet with the
owner or trustee of Southfork Center and then. meet again with
.City staff.
88.185 Motion was made by Miller, seconded by Walters t~ continue the
public hearing pending a meeting with the applicant, owner. of
the property and City staff.
Roll call was taken on the motion. Ayes: Unanimous.
David Licht gave a review of the final plat of Shady Oak Shores.
He stated that preliminary plat approval had been given by the
City Council and presently the developer is asking that a small
portion of the plat consisting of 15 single family lots be given
final plat approval. He stated the final plat is consistent
with the preliminary and recommended approval subject to the
recommendations outlined in the Planner's report ~f September
15, 1988, deleting recommendation number 1.
Roger Derrick and Ralph Wagner were present to answer questions
of the Commission. Mr. Derrick stated they would like to put
.the pedestrian right-of -way between Lots 7 and 8 instead of
between Lots 6 and 7, thus being placed over the storm sewer.
David Licht responded that this would .have to be reviewed by the
• City Engineer.
.7:45 p.m. - Diane MacGibbon arrived..
88.186 Motion was made by Miller, seconded by Whitehouse to recommend
approval of the final plat. of Shady Oak Shore subject to the
recommendations in the Planner's report of September 15, 1988
deleting recommendation number one and adding the stipulation
that any model home must conform to Section 19, model home
ordinance, and that the placement of a pedestrian right of way
between Lots 7 and 8 be subject to the recommendations of the
City Engineer.
Roll call was taken. on the motion. Ayes: Unanimous.
The public hearing to consider the application of the City of
Lakeville for an ordinance amending Section 26 of the Lakeville
Zoning Ordinance to allow commercial outdoor recreational uses
as a conditional use in an R-1, low density single. family
residential district and amendment. to the definition of
commercial recreation was opened. The City Attorney attested
that all legal notices had been duly published.
Daryl Morey gave a review of the background of the matter,
stating that the City has recently received three informal
requests. for golf courses to be located in residential areas.
. He stated that he feels Lakeville. will see more of this in the
future as the City grows. He also stated that golf courses are
good neighbors and can increase the value of surrounding

property. He stated that the ordinance should limit commercial
outdoor recreational uses to golf courses and country clubs in
these areas. He also stated that under 2.2.30 of the ordinance
it should read indoor fire arms range.
88.187 Motion was made by MacGibbon, seconded by Walters t~ close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
88.188 Motion was made by Sizer, seconded by MacGibbon to
recommend approval of the application of the City of Lakeville
for the draft ordinance amending Section 26 of the Lakeville
Zoning.. Ordinance to allow golf courses and country clubs as a
conditional use in an R-1, low density single family residential
district and amendment to the definition of commercial recrea-
tion.
.Roll call was taken on the motion. Ayes: Whitehouse, Walters,
Sizer, Whittingham, MacGibbon. Nays: Miller.
The reason for Miller's nay was he felt .the amendment is
premature.
• The public hearing to consider the application of the City of
Lakeville for an ordinance amending Section 37 of the Lakeville
Zoning Ordinance t~ allow governmental and public regulated
utility buildings and structures as a conditional use in a B-3,
Auto Oriented Business District was opened. The City Attorney
attested that all legal notices had been duly published.
Daryl Morey gave a review of the amendment stating that the Ci y
has purchased property for a new City Hall which is currently
zoned B-4. The only other alternative would be to spot zone the
property, He gave examples of what types of structures would. be
permitted by conditional use permit which included:
- pumping stations
- switching stations
- police and fire stations
A brief discussion was held among the Commission members. There
was no public comment.
88.189 Motion was made by Miller, seconded by MacGibbon to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.

88.190 Motion was made by Miller, seconded by MacGibbon to recommend
approval of the application of the City of Lakeville for the
amended draft ordinance amending Section 37 of the Lakeville
Zoning Ordinance to allow governmental .and public regulated
utility buildings and structures as a conditional use in a B-3,
.Auto Oriented Business District.
Roll call was taken on the motion. Ayes: Unanimous.
David Licht gave a review of the Metropolitan Council's response
to the Lakeville Comprehensive Plan update, A report dated
September 13, 1988 was distributed to Commission members and
staff
Diane MacGibbon announced that effective the end of the year,
she will be resigning from the Commission. Warren Walters
stated that he had informed Jim Robinette at the last meeting.
that he too wished to resign as soon as a replacement could be
found or if necessary, he would wait until the end of the year.
88.191 Motion was made by Sizer, seconded by Miller to adjourn the
meeting.
