HomeMy WebLinkAbout10-06-88 CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES OCTOBER 6, 1988 The meeting was called to order by Diane MacGibbon, Chairperson at 7:00 p.m. in the Airlake Council Chambers. Roll call of members was taken. Present: Whitehouse, Miller, Langhorst, MacGibbon, Whittingham. Absent: Walters, Sizer. Also present was Alan Brixius, Consultant City Planner, Elliott Knesch, City Attorney, Daryl Morey, Assistant Community Development Director and Mira Holliday, Recording Secretary. 88.192 Motion was made by Miller, seconded by Whitehouse to approve the minutes of the September 15, 1988 Planning Commission meeting, Roll call was taken on the motion. Ayes: Whitehouse, Miller, MacGibbon, Whittingham. Abstain: Langhorst. Alan Brixius gave a review of the final plat of Marion Village By The Lake. He discussed recommendations which are outlined in the Planner's reports of September 29 and September 30, 1988 and stated that the recommendations have already been met by the developer, Stewart Properties. A brief discussion was held among Commission members. 88.193 Motion was made by Langhorst, seconded by MacGibbon to recommend approval of the final plat of Marion Village By The Lake , Phase I, subject to the recommendations in the Planner's report of September 29, 1988 and September 30, 1988. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of Robert E. Swanson for a conditional use permit for outdoor rental and outdoor storage was continued from the previous meeting. Daryl Morey stated that the applicant was waiting for a written response from Dallas Development Corporation, the owner of the property. 88.194 Motion was made by Langhorst, seconded by Miller to continue the public hearing to consider the application of Robert E. Swanson for a conditional use permit for outdoor rental and outdoor storage. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of Jerry Tongen for a conditional use permit for major auto repair was opened. The City. Attorney attested that all legal notices had been duly published and mailed. Planning Commission Minutes October 6, 1988 Alan Brixius gave a review of the application stating that the present business operates under a conditional use permit that was approved in 1985. He stated this use is appropriate for the area and recommended approval subject to recommendations in the Planner's report of September 30, 1988. Mr. Tongen was present and stated he was agreeable with the recommendations made by Mr, Brixius. The Commission discussed various aspects of the matter including: - Setbacks - Parking arrangement - Screening between the business and residential area - Paving of 209th St. and the parking lot - Curb cuts - Improper signage - Concern over conditions of previous conditional use permit being met. - Removal of existing trees on the property line Mr. Bob McKenstry of 188th Street expressed concern over the hours of operation. Staff addressed the question.. • 88.195 Motion was made by Miller, seconded by MacGibbon to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 88.196 Motion was made by MacGibbon, seconded by Whittingham to recommend approval of the application of Jerry Tongen for a conditional use. permit for major auto repair subject to the Planner's report of 9/30/88 with the addition that. when the existing tree along the property line is removed, landscaping be provided between the front of the garage on the adjoining property and once blacktopped, landscaping in front be provided and also subject to other staff recommendations. Roll call was taken on the motion. Ayes: Miller, Langhorst, MacGibbon, Whittingham. Nay: Whitehouse The reason for Whitehouse's nay was he felt the conditions of the original conditional use permit should be met before any additional permit is issued. The public hearing to consider the application of Barbara. L. Finanger for a conditional use permit for a dog kennel ax~la rezoning from R-1 to R-A was opened. The City Attorney attested that all legal notices had been duly published and mailed. Daryl Morey distributed large copies of the site plan to Commission members. He reviewed the application and plans and recommended approval subject to the applicant meeting the provisions of Section 25.4.4 of the Zoning Ordinance. Mr. Steven Finanger, the 2 Planning Commission Minutes October 6, 1988 applicant's husband was present and described the proposed kennel in detail. He distributed photographs of a similar facility. He also submitted to the Commission a letter from the :Chief of Police in Savage which stated there had been no sound, smell or nuisance complaints received on a similar facility. Commission members discussed various aspects of the proposed kennel including: - Feeding provision for the dogs - Flooring which would be concrete sealed with polyurethane fir bacteria control - Heating and air conditioning - Septic system - Exercising of the dogs - Noise control - Attached apartment - Number of employees Lois Petit, a nearby resident who owns a kennel in Scot County expressed her opposition to the proposal stating that her kennel does not stay full and she sees no need for another one in the • area. Daniel Cole of Briggs & Morgan Law Firm, was present representing the Lenertz family, adjacent property owners. He stated that they are against the proposal in that the property is considered "prime property" and the proposal would not be in keeping with the City Comprehensive Plan. He felt this would be considered "spot zoning" and not a community venture. Diane Soberg, also an adjoining property owner, stated she agreed with Mr. Cole in opposing the proposal. Alan Brixius stated that the area is not intended to have utilities within the next 20 years and will not expand into the MUSA for quite some time. 88.197 Motion was made by Whittingham, seconded by Langhorst to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 88.198 Motion was made by Langhorst, seconded by MacGibbon to recommend approval of the application of Barbara L. Finanger for a conditional use permit for a dog kennel and a rezoning from R -1 to R-A subject to the kennel being placed on the property to satisfy the City Code and subject to the Planner's report of 9/30/88. Roll call was taken on the motion. Ayes: Langhorst, Macgibbon, Whittingham. Nays: Whitehouse, Miller. 3 Planning Commission Minutes October 6, 1988 The reason for Whitehouse's and Miller's nay was they felt the property would be spot zoned. The public hearing to consider the application of Allan Grommesch for a conditional use permit to allow two curb cuts on a single family lot was opened. The City Attorney attested that all legal notices had been d ly published and mailed. Alan Brixius gave a review of the application stating that the action taken on this matter hould be a policy decision to be determined by the City based on a number of factors listed in the September 29, 1988 Plann is report. The Commission discussed the matter with Mr Tom Simonson who was present representing the applicant. There was no public comment. 88.199 Motion was made by Miller, s conded by MacGibbon to close the public hearing. Roll call was taken on the m tion. Ayes: Unanimous. 88.200 Motion was made by MacGibbon seconded by Whitehouse to recom- mend denial of the applicati n of Allan Grommesch for a condi- tional use permit to allow t o curb cuts on a single family lot. • Roll call was taken on the m tion. Ayes: Miller. Nays: Whitehouse, Langhorst, MacGi bon, Whittingham. 88.201 Motion was made by MacGibbon seconded by Whittingham to recommend approval of the,ap lication of Allan Grommesch for a conditional use permit to al ow two curb cuts on a single family lot subject to the Planner's report of September 29, 1988 and subject to the applicant mee ing the 40 foot setback requirement. Roll call was taken on the m tion. Ayes: Unanimous. The public hearing to consid r the application of Bruce and Deborah Steeples for a condi Tonal use permit to build a garage on a nonconforming site was pened. The City Attorney attested that all legal notices had b en duly published and mailed. Daryl Morey gave a review of the a plication and plans. He stated the garage would increase the li abilty of the area and recommended approval with the stipulatio the garage be consistent and complementary to the existin house. Mr. Steeples was present and stated he was in agreeme t with the. recommendations. 88.202 Motion was made by Miller, s conded by Langhorst to close the public hearing. Roll call was taken on the m tion. Ayes: Unanimous. Planning Commission Minutes October 6, 1988 88.203 Motion. was made by Miller, seconded by MacGibbon to recommend approval of the application of Bruce and Deborah Steeples for a conditional use permit to build a garage on a nonconforming site subject to the Planner's report of September 30, 1988. Ro11 call was taken on the motion. Ayes: Unanimous. Under other business Whitehouse asked about the status of the improvements of 160th Street and Cedar Avenue and the possibil- ity of a stop light at 162nd Street. Staff addressed the issue. 88.204 Motion was made by MacGibbon, seconded by Whittingham to adjourn the meeting. Voice vote was taken on the motion.
