HomeMy WebLinkAbout11-17-88 1 • CITY OF LAKEVILLE PLANNING COMMISSION MINUTES NOVEMBER 17, 1988 The meeting was called to order by Chairperson MacGibbon at 7:00 p.m. in the Airlake Council Chambers. Roll call of .members was taken. Present: Sizer, MacGibbon, Whittingham, Walters, Miller. Absent: Whitehouse, Langhorst. Also present was Alan Brixius, Consulting Planner, Elliott Knesch, City Attorney, Daryl Morey, Assistant Community Development Director, John Hennen, Community Development Department Intern and Mira Holliday, Recording Secretary. 88.230 Motion was made by Sizer, seconded by Walters to approve the minutes of the November 3, 1988 minutes. Roll call was taken on the motion. Ayes: Unanimous. Alan Brixius gave a review of a street alignment in the Shady Oak Shore plat. Al Hermann, the developer was present and answered questions of the Commission. It was the feeling of the Commission that the concept plan was very positive and reflects what the staff and Commission requested for the layout. • The public hearing to consider the application of Darrell E. Gonyea for a rezoning from R-2, Single Family Residential District, to B-4, General Business District at Block 1, Lot 7, Jacksons First Addition was opened. The City Attorney attested that all legal notices had been duly published and mailed. Alan Brixius gave a review of the request and stated that he is working on some background information. He stated that the staff does not feel this rezoning would be a positive change, 88.231 Motion was made by Sizer, seconded by Miller to continue the public hearing pending further review by staff. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of the City of Lakeville for an ordinance amending the Zoning Ordinance, Section 11, 11.14 concerning trash handling equipment was opened. The City Attorney attested that all legal notices had been duly published. John Hennen, Community Development Department Intern gave a review of the proposed amendment. A brief discussion was held among Commission members and it was agreed that the amendment • was a positive change. PLANNING COMMISSION MINUTES NOVEMBER 17, 1988 • 88.232 Motion was made by Walters, seconded by Whittingham to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 88.233 Motion was made by Miller, seconded by Whittingham to recommend approval of the application of the City of Lakeville for an ordinance amending the Zoning Ordinance, Section 11, 11.14 concerning trash handling equipment subject to the report of John Hennen, dated November 9, 1989. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of the City of Lakeville for the rezoning of Area F from R-7 High Density Residential District to R-2, Single Family Residential District was opened. The City Attorney attested that all legal notices had been duly published and mailed. Alan Brixius gave a review of the study of the area and recommended rezoning from R-7 to R-2, Single Family. Frank Biessel of 205th Street stated he feels the land is not suitable for residential use due to the nearby gravel mines. • Wally Potter of 202nd Street asked for an explanation of the various zonings (ie. R-2, R-3, R-4, etc.). Alan Brixius gave a description of each zoning within the City. Mr. Potter stated he is not in favor of high density by Lake Marion but is concerned over the value of the land if it is rezoned to a lower density. Harry Johnson, representing Stewart Properties questioned the location of Kaparia Avenue on the map which Mr. Briuxius was using. A discussion was held over the actual location. Other questions were raised concerning exact zoning boundaries. Edward Christian, an attorney representing the Estate of Mary Christian stated he has concern over the value of property if it were down zoned. Gene Rechtzigel expressed his concern over the rezoning. He stated he and his family would prefer the land be left R-7. Elaine Stoffos, representing her grandfather, Traverse Schinke, a property owner in the area, stated she feels the area should remain R-7. Commission members discussed their concerns which included: • 2 PLANNING COMMISSION MINUTES NOVEMBER 17, 1988 - Buffer for the gravel mine - R-2 zoning around Lake Marion - Zoning should reflect what is physically in an area - Lakeville should definitely have some R-7 zoned areas 88.234 Motion was made by Sizer, seconded by Miller to continue the public hearing regarding Area F until December 1, 1988 for further review by staff and the development of findings of facts . Roll call was taken on the motion. Ayes: Unanimous. Further consideration of the application of the City of Lakeville for the rezoning of Area A from R-7 High Density Residential District to R-2 Single Family Residential District was continued from the November 3 meeting. Alan Brixius gave a review of the concerns from the last meeting referring to his report dated November 14, 1988, A brief discussion was held. 88.235 Motion was made by MacGibbon, seconded by Walters to recommend approval of the application of the City of Lakeville for the rezoning of Area A from R-7 High Density Residential District to R-2 Single Family Residential District and adoption of the • findings of fact subject to the R6/R7 Zoning Study and the Planner's report of November 14, 1988. Roll call was taken on the motion. Ayes: Unanimous. Under other business, Daryl Morey stated that an error had been made when a recent ordinance amendment was brought before the Commission concerning government and public regulated buildings and structures as a conditional use in a B-3 or CBD-I zone. He stated that instead of "conditional use" the amendment should read "permitted use" The Commission was in agreement. 88.236 Motion was made by Sizer, seconded by Miller to adjourn the meeting. Voice vote was taken on the motion.
