PLANNING COMMISSION MEETING MINUTES
DECEMBER 15, 1988
Due to lack of a quorum at 7:00 p.m. the City Engineer, Keith
Nelsen proceeded to give a review of the construction plans of
Cedar Avenue.
The meeting was called to order at 7:25 p.m. in the Arlake
Council Chambers. Members present were: Miller, MacGbbon,
Whttingham and Walters. Absent: Langhorst, Whitehouse and
Sizer.
Also. present was Alan Brixius, Consulting Planner, Elliott
Knesch, City Attorney, Daryl Morey, Assistant Community
..Development Director, Keith Nelson, City Engineer and Mira
Holliday, Recording Secretary.
88.251 Motion was made by Walters, seconded by Miller to approve :the
minutes of .the .December 1, 1988 Planning Commission meeting.,
Roll call was taken on the .motion. .Ayes: Unanimous.
The public hearing to consider the application of Terxy Schroder
for `a conditional use..permit and variance to construct an indoor
golf facility was opened. The. City Attorney attested that. all
legal: notices had been duly published. and. mailed.
Alan Brixius explained that this .application had been approved
in 198b but. the permit had expired. He stated that no changes
had been made since the last..review of the golf facility before
the Planning Commission and this was merely a Formality.
Glen Nord, Terry,Sehroeder and Sam Wunderlich were present and
stated they had no'plans to change the location of the struc ure
on the-site, only the materials used in the construction. of the"
building.
Joyce Anderson of 167th Street asked questions .regarding. the
landscaping and arrangement of the facility. Staff and Mr.
Schroeder addressed the ques ions.
88.252 Motion was made 'by Whittingham seconded by Walters to close the.
public hearing,.:
Roll call was taken ~n the motion. Ayes: Unanmous.>
88.253 Motion was made by"Whittingham, seconded by Miller to recommend
approva of-the application of Terry Schroder for a conditional
use permit and variance. to construct an indoor golf facility
subject to the Planner's•reportof 10/28/88.. and any comments of
City staff.
Roll call was taken on the motion. Ayes: :Unanimous.

The public hearing to consider the application of the City of
Lakeville for the rezoning of Area D from R7, High Density to
R2, Single Family Residential District was opened. The City
Attorney attested that all legal notices had been duly published
and mailed.
Aian Brixius reviewed the study that had been .conducted. nn the
area .and recommended two options.. dne that the area remain R7
and two .that the Acorn Heights area be rezoned R2.
John Huston-_of Joda, Inc. stated he had no objections to the
rezoning of .the single family .lots that .had already been
developed but stated, he does object to Lots 1, 2, and 3 of Block
1 and Lots l and 2, Block 3 being rezoned to R2. They would like
to build some medium density .residential units on the
above-mentioned undeveloped lots. Mr. Huston stated that these
lots are the closest lots in Acorn Heights to the freeway and
thus :would be more appropriately zoned a medium or high density
residential..
Byron Watschke of Fortune Realty stated he prefers the area
remain R7. He stated that he can see 185th Street becoming as
busy as Cliff Road in Eagan.
Brian Husby of Mid-Americana Festivals stated he also .prefers the
. area remain R7.
Ella Ful'bright of Acorn heights stated she prefers the R2
zoning.
A brief discussion was held among Commission members and staff.
88.254' Motion was made by Miller, seconded by Walters to close the
public hearing.

88.255 Motion was .made by Miller, seconded by Whttngham to recommend
denial of the application of the City of ;Lakeville fir the
rezoning of <Area D from R7, High Density to R2, Single Family
Residential District.-
Roll call was taken on the motion, Ayes: Unanimous.

Lakeville for a rezoning of Area, H-from R7, High Density to RS,-
Single Family', Two Family and Medium. Density Residential
District or R6, Medium Density 'Residential District was opened.
The City.Att~rney attested that all legal notices had been duly
published and. mailed.

Alan Brixius reviewed the recent study of the area. A brief
discussion was held among Commission members. There was no
public comment.
88.256 Motion was. made by Miller, seconded by Whittingham to close the
public. hearing,
Roll call was taken on the motion. Ayes: Unanimous.
88.257. .Motion was made by Miller, seconded by Whittingham to recommend
denial. of the application of the. City of Lakeville for a
rezoning of Area H frgm R7, High Density to R5, Single Family,
Two. Family and Medium Density Residential District or R6, Medium
Density Residential District.
Rohl call was taken qn the motion. Ayes: Unanimous.
The public hearing to consider the application of the-City of
..Lakeville for. the rezoning of an area located in the SE 1/4 ~f
the SW l/4 of Section, 28, Range 20 (formerly known as Area K and
L) from RT High Density to R5, Single Family, Two Family and
Medium Density Residential District was opened. The City
Attorney:.attested`that all.. legal notices .had been duly published
and mailed.
Alan Brixius reviewed the study of the area and stated that
property owner, Arlene Weck had previously requested R5 along
with the surrounding area. Ms. aleck was present and restated her
feelings. on the matter. Orin Schweick, an area property owner
was present and. stated 'he too preferred the R5 zoning.
Commission members and-staff discussed a possible mistake in the
zoning map concerning the east side of Hamburg. 'It was
suggested that a public hearing be held concerning .the rezoning
of this area from R7 to R4.
88.258 Motion was made by Miller, seconded by Walters to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
88.259 Motion-was made by Miller, seconded by Whittingham to recommend.
approval of bhe application of .the City of Lakeville for the
rezoning ~f an area located in the SE 1/4 of the SW i/4 of
Section 28 Range 20 (formerly .known as Area K-and L) from R7
.high Density to R5, Single family,; Two Family and Medium Density ,
Residential District and adopt the Findings of Fact ,as amended..
Roll call was taken on`the-motion. :Ayes: Unanimous.

Lakeville for the rezoning of Area N from R6, Medium Density
Residential District to Rl, Single Family residential District
was opened. The City Attorney attested that all legal notices
had been duly published and mailed. Alan Brixius reviewed the
study of the area and stated that Byron Watske of Fortune Realty
had stated to him that he had nn objections to the rezoning.
A brief discussion was held among Commission members and staff.
There was no other public comment.
88.260 Motion was made by Miller, seconded by Whittingham to close the
public hearing.
Roll call .was taken on the .motion. Ayes: Unanimous.
88.261 Motion was made by Miller, seconded by Whittingham to reeommend
approval of the application of the City. of Lakeville fnr the
rezoning of_Area N from R6, Medium Density Residential District
to R1, Single Family Residential District.
Roll. call was-taken on the mo ion. Ayes.: Unanimous.
The public ..hearing to consider the application of the City of
Zakeville €or the vacation of Keokuk Avenue in the Lakeville.
Commerce Center plat was opened. The City. Attorney attested that
all-legal notices had been duly published-and mailed. A brief
discussion was held among Commission members and staff. There.
was'no public comment.
88.262 Motion was 'made by Miller, seconded by Whittingham to close the
public hearing.
Roll call was taken ~n the motion. .Ayes: Unanimous.
88.263 Motion was made by Mller,:sec~nded by Whittingham to ,recommend
approval of the application of the City of Lakeville for the
vacation of Keokuk Avenue in the Lakeville Commerce Center plat.
Roll call was taken on the motion. Ayes: Unanimous.
The.. public hearing. to consider the application of Darrell E.
Gonyea`for a rezoning frnm R2, Single Family Residential
District, to B4, General Business District"at Block 1-,-Lot 7,
Jacksons First Additon was continued from .the last meeting.
Staff explained that this application would either be withdrawn
or_ready for action at the next meeting.
88.264 Motion was made by Miller, seconded by Whittingham to conttinue
the public hearing.
Roll call was taken on the motion. Ayess Unanimous.
