RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT
TO FRIEDGES LANDSCAPING, INC.
FOR CONSTRUCTION OF STONEBOROUGH PARK —
CITY IMPROVEMENT PROJECT #11 -05
Proposed Action
Staff recommends adoption of the following motion: Move to authorize Mayor and City
Clerk to execute an Agreement with Friedges Landscaping, Inc. for construction of
Stoneborough Park.
Overview
City staff has been working with Brauer & Associates, Ltd. regarding the preparation of
plans and specifications for the construction of Stoneborough Park over the past three
months. The proposed park is located off of Hytrail Circle (E of Dodd Blvd & N of 215
Street). Bids were opened on Tuesday, April 26 Eleven (11) contractors submitted
bids on the project. The bids, including all alternates, ranged from the low of
$192,782.50 to a high of $399,853.45. The favorable bidding climate resulted in the low
bid being under the Landscape Architects estimate.
At this time, staff is recommending approval of an Agreement with Friedges
Landscaping, Inc. for the construction of Stoneborough Park at a cost of $188,857.50.
The final contract amount is a result of selecting add and deduct alternates as noted in
the attached recommendation letter from Brauer and Associates.

RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT
TO FRIEDGES LANDSCAPING, INC. FOR CONSTRUCTION OF
STONEBOROUGH PARK — CITY IMPROVEMENT PROJECT #11 -05
WHEREAS, the City of Lakeville has planned for the development of
Stoneborough Park; and
WHEREAS, plans and specifications were created by Brauer & Associates, Ltd;
WHEREAS, Notice to Bidders for the acceptance of sealed bids for the project
were officially published on March 31, 2011; and
WHEREAS, sealed bids were opened at 2:00 PM on April 26, 2011; and
WHEREAS, the lowest responsible bidder for the construction of Stoneborough
Park is Friedges Landscaping, Inc. with a bid of, including selected alternates,
$188,857.50.
NOW, THEREFORE, BE IT RESOLVED that City staff and Brauer & Associates,
Ltd. are recommending that the City Council authorize the Mayor and City Clerk to
execute an Agreement with Friedges Landscaping, Inc. for the construction of
Stoneborough Park in the amount of $188,857.50.

Re: Recommendation to accept bid for the Stoneborough Park Development Project
A total of 11 bids were received for this park improvement project resulting in very competitive bid results. Brauer
& Associates, Ltd. has reviewed the submitted bids and some minor errors were found and corrected, but they did
not affect the overall low bid ranking. Friedges Landscaping, Inc. has submitted the lowest qualified bid for this
project.
We recommend the City of Lakeville execute a contract with Friedges Landscaping for the Base Bid work, plus the
desired alternates. We also recommend setting aside a minimum construction contingency of 10% of the
construction budget to allow for any unknowns on the site that may require changes to the plans and possible import
of soils.
The recommended final bid amounts for the contract are as follows:

There was one alternate bid item for hydromulch cover along the trails that was not accepted and an alternate bid
item that provided a unit price for common borrow in the event we may need to import common borrow soil during
construction, which would be utilized on an as needed basis.

This AGREEMENT made and entered into as of April 27` 2011, by and between the City of Lakeville, MN,
hereinafter referred to as the OWNER and Friedges Landscaping, Inc., hereinafter referred to as the
CONTRACTOR.
The Project:
The Architect: Brauer and Associates, Ltd.
The OWNER and CONTRACTOR, in consideration of the mutual covenants herinafter set forth, agree as
follows:
ARTICLE 1. CONTRACT DOCUMENTS
The Contract Documents consist of this Agreement, the Conditions of the Contract (General, Supplementary and
other Conditions), the Drawings, the Specifications, all Addenda issued prior to and all Modifications issued after
execution of this Agreement. These form the Contract, and all are as fully a part of the Contract as if attached to
this Agreement or repeated herein.
ARTICLE 2. THE WORK
AGREEMENT BETWEEN OWNER AND CONTRACTOR

The Contractor shall perform all the Work required by the Contract Documents for the Stoneborough
Park Development Project including, but not limited to, all specific work described on the BID FORM
00500.
ARTICLE 3. TIME OF COMMENCEMENT AND SUBSTANTIAL COMPLETION
The Work to be performed under this Contract shall be completed as follows:
1. All work shall start upon acceptance and notification by the Owner and shall be 100% complete on or
before July 8 2011.
ARTICLE 4. CONTRACT SUM
The OWNER shall pay the CONTRACTOR in current funds for the performance of the Work, subject to
additions and deductions by Change Orders as provided in the Contract Documents, the Total Contract Sum of
One Hundred Eighty Eight Thousand Eight Hundred Fifty Seven Dollars and Fifty Cents ($188,857.50) to
include the base bid, plus the accepted alternates, listed below.

ARTICLE 5. PROGRESS PAYMENTS
CONTRACTOR shall submit Applications for Payment no greater than once per month. Applications for
Payment will be processed by ARCHITECT as provided herein.
OWNER shall make partial payments on account of the contract price on the basis of CONTRACTOR'S
Applications for Payment as recommended by the ARCHITECT in accordance with the Contract Documents, on
or about the 15` day of each month during construction as provided below. All progress payments will be on the
basis of the progress of the work measured,
Progress payments will be made in an amount equal to NINETY -FIVE PERCENT (95 %) of the work completed,
but, in each case, less the aggregate of payments previously made and less such amounts as ARCHITECT shall
determine, or OWNER may withhold.
ARTICLE 6. FINAL PAYMENT
Final payment, constituting the entire unpaid balance of the Contract Sum, shall be paid by the OWNER to the
CONTRACTOR when the Work has been completed, the Contract fully performed, a final Application for
Payment has been submitted by the CONTRACTOR, and when a final Certificate for Payment has been issued by
the ARCHITECT following the one year guarantee period.
