Chris Petree presented the April monthly report of the Operations & Maintenance Department. Consent Agenda 11.27 Motion was made by Little, seconded by Rieb to approve the consent agenda items as follows: a. Claims for payment. b. Agreement between Lakeville Arenas and City of Lakeville for financial management services. d. Tree work license renewal for Lawrence Tree & Stump Services, Inc. e. Findings of fact and conditional use permit to allow an expansion of a single - family home with a non - conforming setback within the Shoreland Overlay District of Lake Kingsley, 16515 Kingswood Drive. g. Resolution No. 11 -39 accepting bids and awarding contract for the construction of Stoneborough Park, Improvement Project 1 1 -05. h. Amendment #3 to the Master Telecommunications Capacity Lease Agreement for Network Services. Roll call was taken on the motion. Ayes, unanimous. Item 7 - Donnelly Farm 3rd Addition Mathew Weiland, representing Wyatt Pudel Pointer I, LLC, requested Council approval of the Donnelly Farm 3rd Addition preliminary and final plat and amendment to the Donnelly Farm Planned Unit Development. The PUD amendment is being proposed to allow the replatting of 73 vacant townhome lots and portions of three common area lots into 41 single family residential lots based on the RS -4 zoning standards. The project is located south of 194th Street and east of Dodd Boulevard. All existing drainage and utility easements from the undeveloped townhome lots are proposed to be vacated, and new easements will be established that reflect the proposed single family lot design. Mr. Weiland stated all lots within the preliminary and final plat meet the minimum requirements of the City's zoning ordinance. The project will utilize most of the existing infrastructure. He further stated that these single family lots will not be covered by the existing homeowners association for the townhome units. Associate Planner Allyn Kuennen explained that in 2008 the City completed an update of the Comprehensive Land Use Plan. During this process, the City received a request to consider design standards for smaller single family lots. City staff met with several residential developers CITY OF LAKEVILLE COUNCIL MEETING MINUTES MAY 2, 2011 Page 3 to receive feedback regarding design standards for smaller single family lots. The City ultimately adopted a zoning ordinance amendment that included the new RS -4 single family lot design standards, providing for smaller single family lot sizes and reduced front and side yard setbacks. The Planning Commission held a public hearing and unanimously recommended approval of the Donnelly Farm 3rd Addition preliminary and final plat, PUD amendment and easement vacation. In response to Council Member Little's question, Mr. Weiland explained that due to foreclosures and the existing housing market, the demand has shifted from townhomes to single family homes, as they have become more affordable. Council Member Swecker asked about the architectural design standards for the single family homes. Mr. Weiland stated they plan to continue the design standards that were adopted for the existing single family area of the Donnelly Farm development. Council Member LaBeau asked if the existing homeowners association supports the project. Mr. Kuennen stated the Donnelly Farms Homeowners' Association has submitted a letter of support for the project. Council Member LaBeau asked about the cash fee of $1,000 for each abandoned water service. Mr. Mielke explained that most of the single family lots will utilize existing water services previously installed for the townhome units with the Donnelly Farm Addition. The City and developer agreed to a fee of $1,000 to be paid by the developer for each existing water service that will need to be permanently abandoned. That fee was deemed reasonable to cover future maintenance and repair costs that may be incurred by the City. 11.28 Motion was made by Swecker, seconded by Rieb to approve the following: a. Resolution No. 1 1 -40 approving the preliminary and final plat of Donnelly Farm 3rd Addition, including Addendum "C" to Development Contract and Planned Unit Development Agreement b. Resolution No. 1 1 -41 vacating public drainage and utility easements Roll call was taken on the motion. Ayes, unanimous. CITY OF LAKEVILLE COUNCIL MEETING MINUTES MAY 2, 2011 Page 4 Item 8 - Stone Borough 4th Addition Warren Isrealson, representing KJ Walk, Inc., requested Council approval of Stone Borough 4th Addition, which involves the replatting of vacant townhome lots to single family residential lots under the RS -4 standards. He stated that representatives of the existing homeowners association have indicated support for the project. Mr. Kuennen explained that Stone Borough 4th Addition is centrally located within the Stone Borough development on the east side of Dodd Boulevard, north of 215th Street. The development meets the minimum requirements of the zoning and subdivision ordinances. All existing drainage and utility easements within the area to be replatted are proposed to be vacated, and new easements will be established that reflect the single family lot design. The preliminary plat includes 44 single family lots and the final plat includes 28 single family lots as recommended by the Planning Commission. The Planning Commission held a public hearing and unanimously recommended approval of the preliminary and final plat and easement vacation. 11.29 Motion was made by Rieb, seconded by LaBeau to approve the following: a. Resolution No. 1 1 -42 approving the preliminary and final pat of Stone Borough 4th Addition b. Resolution No. 11 -43 vacating public drainage and utility easements Roll call was taken on the motion. Ayes, unanimous.
