HomeMy WebLinkAbout0555 t ~,a - w ORDINANCE N0. 555 CITY OFlAKEVILLE .DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING ORDINANCE NO. 1.67, THE ZONING ORDINANCE CONCERNING THE "R-MH" MANUFACTURED HOME PARK DISTRICT THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS: SECTION 1. Section 2.2 of Ordinance No. 167 is amended by adding the following definitions: 106) Manufactured Home. "Manufactured home" means a structure, transportable in one or more sections, which in the traveling mode is eight (8) body feet or more in width or forty (40) body feet or more in length, or when erected on site, is three hundred twenty (320) or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained therein; except that the term includes any, structure which meets all the: requirements and with respect to which the manufacturer voluntarily files a certification required by the secretary and complies. with the standards established under Minnesota Statutes Chapter 327. 106A) Manufactured Home. Park.. "Manufactured home park" means any site, lot, field, or tract of land upon which two (2) or more. occupied manufactured homes are located, either free of charge or for compensation, and. includes .any building, structure, tent, vehicle, or enclosure used or intended for use as part of the equipment of the manufactured home parka SECTION 2. Section 34 of Ordinance No. 167 is amended in its entirety to read as follows: SECTION 34. "R-MH", MANUFACTURED HOME PARK DISTRICT 34.1 Purpose. The purpose of an "R-MH" Manufactured Home Park District is to provide a separate district for manufactured home parks, distinct from other residential areas. .25023 06/19/95 34.2 The following are permitted uses in an "R-MH" District: 1) All permitted uses in an "R-1 " District except detached single family dwellings. 34.3 The following are conditional uses in an "R-MH" District (requires a conditional use permit based upon procedures set forth in and regulated by Section 34.4 and Section 4 of this Ordinance). 1) Manufactured home parks. 2) Public or semi-public recreational. buildings and neighborhood or community centers; public and private educational institutions limited to elementary, junior high, and senior high schools; and religious institutions such as churches, chapels, temples, and synagogues provided that: a) Side yard setbacks shall be double that required for the district, but not greater than thirty 130). feet. b) The use must be adequately screened and Jandscaped .from abutting residentia( uses in compliance with Section 9.7 of this Ordinance. c) Adequate off-street parking and access is provided on the site or on lots directly abutting or directly across a public or private street from the principal use in compliance with Section 12 of this Ordinance. Said parking must be adequately screened and landscaped from surrounding and abutting residential uses in compliance with Section 9.7 of this Ordinance. d) Adequate off-street loading and service entrances are provided and regulated .where applicable by Section 13 of this Ordinance. e) The provisions of Section 4.3(5) of this Ordinance are considered and satisfactorily .met. 3) Governmental and public regulated utility buildings and structures necessary for. the health, safety, and general welfare of the community provided that: a) Compatibility with the surrounding. neighborhood is maintained and required setbacks are met.. b) Equipment is completely enclosed in a permanent structure with no outside storage. 25023 06/19/45 2 c) The use. must be adequately screened and landscaped from .abutting residential uses in compliance with Section 9.7 of this Ordinance. d) The provisions. of Section 4.2(5) of this Ordinance are considered and satisfactorily met. 34.4 Site Plan: Requirements. In addition to the conditional use permit requirements outlined in Section 4, a site plan containing the following information must be submitted: 1) Legal description and size in acres of the proposed manufactured home park. 2) Location and size of all manufactured home. lots, storage areas, recreation areas, laundry drying areas, roadways, parking sites, and all setback dimensions .including but not limited. to: parking spaces, manufactured home sites, and accessory building locations. 3) Detailed landscaping .plans and specifications. 4) Location and .width of sidewalks. 5) Plans for public sanitary sewage disposal, surface drainage, public water systems., underground electrical service, gas service, and cable TV. 6) Location and size of all streets abutting the manufactured home park .and all driveways from such streets to the manufactured home parka 7) Road construction plans .and specifications. 8) Plans for any and all structures fi.e., central community building, storm shelter). 9) Such other information as required or implied by these manufactured home park standards or requested by public officials. 101 Name and address of developer or developers. 1 1) Description of the method of disposing of garbage, refuse, and recyclable materials. 12) Detailed description of maintenance procedures and grounds supervision for common areas. 13) Provide details on development phasing, if applicable. 25023 06/19/95 3 14) Location and size of building pads for accessory buildings. on manufactured home lots. 15) A copy of the guidelines and rules proposed by the manufactured home. park operator regulating the building type and construction of building additions, accessory buildings, decks, and similar type construction. 16) A sign plan showing the size and. location of all proposed signs. 34.5 Standards for Manufactured Home Parks. 1) General Provisions for all Manufactured Home Parks.: a) All land area shall be: 1. Adequately drained. 2. Landscaped to control dust. 3. Clean and free from refuse, garbage, rubbish, or debris, b) There shall not be outdoor camping anywhere in a manufactured home park. c) Public access to manufactured housing parks shall be as approved by the City. d) All structures (fences, storage, decks, etc..) shall require a building permit .from. the Lakeville Building Official Fences shall be prohibited on individual manufactured home lots. e) The area beneath a manufactured home shall be enclosed except that such enclosure must have access for inspection. f) A manufactured home park shall have. an adequate central community building. Such building must be provided with restroom .facilities, have adequate heating in all areas, and be maintained in a safe, clean, and sanitary condition. g) Emergency Storm Protections: Manufactured home parks established prior to July 1, 1993, shall comply .with emergency storm protections as required by Minnesota Statutes § 327.02. A .new manufactured home park established after July 1,.1993, shall have .storm shelters in .compliance with Minnesota Statutes § 327.02.. Additionally, all emergency storm protection measures shall be subject to the approval of the City Council. h) Individual manufactured home lot setbacks: 25023 06/19/95 4 1. In manufactured home. parks existing prior to January 1, 1965, no unit shall be located closer than ten (10) feet to the side of an adjacent unit, nor closer than three (3) feet between manufactured homes parked end to end. 2. In manufactured home parks created between January 1, 1.965, through July 1, 1982, no manufactured home shall be located closer than twenty. (20) feat from a street surface, nor closer than twenty (20} feet to an adjacent manufactured. home. 3. In manufactured.. home parks created after July 1, 1982, through January. 1, 1995, no manufactured home shall be located closer than ten (10) feet to a side or rear lot line, nor closer than twenty (20) feet to the front lot line. 4. In manufactured home parks created after January 1, 1995, no manufactured home shall be located closer than ten (10} feet to a side or rear .tot line. The front yard setback shall be at least thirty (30) feet from the street surface. On corner lots, the side yard setback shall be at least twenty (20) feet from the street .surface. No manufactured .home shall be located closer than thirty (30) feet from the periphery lot line of the manufactured home park. 5. In manufactured home parks created prior to January 1, 1995, changes in the setbacks required under Section 34.5(1.h 1-3) of this Ordinance may be allowed by planned unit development as regulated by Section 6 of this Ordinance. i) Permitted encroachments: 1. Attached steps, uncovered stoops, and landings. may encroach up to five 15) feet into a side yard- setback, provided that they do not exceed twenty (20) square feet in area or extend closer than ten (10) feet to a structure on an adjacent lot. 2. An eave or overhang may encroach up to one (1) foot into a front, side, and rear setback. 25023 06/19/95. 5 j) Building height requirements: 1. No structure shall exceed one (1) story. or twenty-five (25) feet, whichever is least. k) Utilities:. 1. All manufactured home parks shall be connected to public water and sanitary sewer system. 2. AIC installation for disposal of surface storm water must be approved by the City. 3. All utility connections shall be as approved by the City. 4. The source of fuel for cooking, heating, or other purposes at each manufactured home site shall be as approved by the. City. 5. All utilities shall be underground; there shall be no overhead wires or .supporting poles except those essential for street or other lighting. purposes. 6. No obstruction shall be permitted. that impedes the. inspection of plumbing, electrical facilities, anal related manufactured home equipment. 7. The method of garbage, waste, and trash disposal must be approved by the City. 8. The owner shall pay any required sewer ..and water connection fees to the .City. 9. The owner .shall pay inspection and testing fees for utility service to the City. I) Storage:. 1. Exterior storage on individual manufactured home lots shall comply with :the provisions of .Section 9:15 of this Ordinance, except not more than .one (1) recreational vehicle may be allowed on a lot. 25023 06/19/95 6 m) Accessory Buildings: 1. .Accessory buildings including garages shall be limited to one per manufactured home lot. Maximum allowable floor area shall not exceed six percent 16%} of the. lot size in manufactured home parks where lot size is delineated by site plan or lot markers. Floor area shat! not exceed eighty (80} square feet in manufactured home parks where lot size is not delineated. 2. Maximum building height: Fifteen (15) feet. 3. Location: The manufactured home park site plan shall designate the locations .proposed. far the development of garages and/or accessory buildings on each manufactured ..home lot. Said accessory. buildings shall comply with the following. setback requirements: a. An accessory building shall only be located in side or rear yards. b. Accessory buildings shall not be located within any utility easements. c. In manufactured home parks .existing prior to January 1, 1965, accessory :buildings shall be located at least three. (3) .feet from any other building. or structure on the same lot and at least five (5) feet from a structure on an adjacent lot. On corner lots, accessory buildings shall. be located at least ten (10) feet -from a side street surface. Accessory building floor area shall not exceed eighty (80) square feet. d. In manufactured home parks created between January 1, 1965, through July 1, 1982, accessory buildings. shall be located at least six (6) feet from any other building or structure on the. same lot and at least .six 16) feet from a structure on an adjacent lot. On corner lots, accessory buildings shall be located at least fifteen (15) feet from a side street surface. e. In manufactured home parks created a#ter July 1, 1982, through January 1, 1995, accessory buildings shall be located at least six (6) feet from any other building or structure on the same lot and at least ten 25023 06/19/95. 7 (10) feet from a structure on an adjacent lot. On corner lots, accessory buildings shah be located at least twenty (20) feet from a side street surface. f. In manufactured home parks created after January 1, 1995, accessory buildings shall be located at least six (6) feet from any other. building: or structure on the same lot .and at least ten (10) feet from a structure on an adjacent lot. On corner lots, accessory buildings shall be located at least twenty (20) feet from a side street surface. Accessory buildings in excess of twelve (12) feet in width must be paced on a lot at least. sixty-five (651 feet in width. g. In manufactured home. parks and on manufactured home park lots established after January 1, 1995, all accessory buildings located on individual manufactured home unit lots .shall be owned, constructed, and maintained by the. manufactured home park .owner. In said parks, all accessory - structures shall be established as park of a pre- determined site plan and subject to the approval of the City Council. 4. Building Type and Construction: Any building addition shall either be manufactured or custom. built of materials that are consistent or compatible to the design of the principal building. "Compatible" means that the exterior appearance of an accessory building is not at variance with the principal building from an aesthetic and architectural standpoint to cause: a. A difference to a degree to cause. incongruity with the principal building. b. A deviation from the general character of the neighborhood. c. A depreciation of neighborhood values or adjacent property values. d. A nuisance. Types of nuisance characteristics include, but are not limited to: noise, dust, odors, glare, and. unsightly building exterior. 25023 06/19/95 $ r 2) Design Requirements for Manufactured Home Parks Created After January 1, 1995: a) Park Size: 1. The minimum area required for a manufactured home park designation shall be five (5) acres. b) .Lot Size: 1. Individual manufactured home lot approved after January 1, 1995: a. Lot Width: .Not less thane sixty-five (65) feet. b. Lot Depth: Not less than one hundred twenty (120) feet. c. Changes. to lot width and lot depth requirements may be allowed by planned unit development as regulated by Section 6 of this Ordinance. d. Each manufactured. home lot shall have frontage on an approved roadway and the corner of each manufactured home lot shall be marked and each lot shall be numbered. c) Parking: 1. Each manufactured home site shall have off-street parking space for two (2) passenger vehicles. 2. Alf. parking spaces shall be hard surfaced according to specifications established by the City. d) Internal Roads and Streets: 1. Alf streets. shall be private streets and shall be developed with a roadbed of not less than thirty-two (32) feet. in .width and. shall meet City design specifications. Areduction in the street width requirement may be allowed by planned unit development as regulated by Section 6 of this Ordinance provided sufficient off-street guest parking spaces are constructed and maintained at the owner/operator's request. 25023 06/19/95 9 2. The. park shall have a street lighting plan approved by the City. el Recreation: 1. All manufactured homeparks shall have at leasften percent (10%) of the .land .area developed fore recreational use (tennis courts, children's play equipment, swimming pool, golf green, etc.). The recreational .use shall be developed and maintained by the owner/operator's expense. f) Landscaping: 1. Each manufactured home lot shall be provided with two (2) trees. The size and type of trees must meet .the .requirements of Section 9.7 of this Ordinance. 2. A landscape screen meeting the requirements of Section 9.7 of this Ordinance shall be installed and maintained around each manufactured home park. 3. All areas .shall be landscaped in accordance with a landscaping plan approved by the City Council g) Lighting: 1. Artificial light shall be maintained during all hours of darkness in all buildings containing public toilets, laundry equipment, and the like. 2. The manufactured home park grounds shall-be lighted as approved. by the City from sunset to sunrise. 34.6 Operational Standards for Manufactured Home .Park. 1) Maintenance. The operator of any manufactured home park, or a duly authorized attendant and/or caretaker shall be responsible at all times for keeping the manufactured home park, its facilities and equipment, in a clean, orderly, operable, and .sanitary condition. The attendant or caretaker shall be answerable, along with said operator, for the violation. of any provisions of these regulations to which said operator is subject. 2) Inspections Prior to Sale. a) .Prior to the sale of a manufactured home within a manufactured home park, the operator or a manufactured home park or the duly 25023 Ob/19/95 1 0 t authorized attendant and/or caretaker must inform the Lakeville Building Official of the prospective sale and .provide. the Building Official with a completed copy of the Manufactured Home Safety Disclosure Form required by Minnesota Statutes § 327.07, Subd. 3A. 3) Permits. Prior to a manufactured home being moved onto a lot, the owner shall apply for and obtain a building. permit for the (foundation) blocking to State Code and a permit for connection to public sewer and water. The applicationfor permits shall be accompanied by a .site plan., drawn to scale, detailing the unit placement, accessory structures, and setbacks. 4) Prior to locating a manufactured home housing unit constructed prior to July 1, 1972, on a lot within a manufactured home park within the City of Lakeville, said unit shall be upgraded to current life safety codes and subject to the approval of the Lakeville Building Official. 34.7 Street Maintenance. 1) All private internal streets in manufactured home parks shall be maintained by the park. owner in a good state of repair, free from obstructions, encumbrances, depressions, pot holes, and break ups. Snow shall be promptly plowed and. removed from streets and adjacent mail boxes and fire hydrants, so that snow or snow piles do not constitute a safety hazard to motorists and pedestrians, or constitute an obstruction to emergency service vehicles. Icy streets and areas adjacent to mail boxes shall be: promptly sanded. "Promptly" shall mean no later than twenty-four (24) hours after it has formed. SECTION 3.
