Planning Commission Meeting
• September 2, 1982
Patrick Harvey, Chairman, called the meeting to order at 7:30 p.m. in the
Lakeville City Council Chambers.
Roll call. of members was taken. Present: D. Miller, Heald, Harvey,
Johnson, Grohoski, Rice. Absent: Geisness
Also present: Sid Miller, Building Inspector; Roger Knutson, City Attorney;
Pat McGarvey, City Administrator; Alan Brixius, City Planner; Shirley
Sorensen, Recording Secretary
8.2.127 Motion was made by Johnson, seconded. by D. Miller, to approve the minutes of
the August 19, 1982 Planning Commission .meeting.
Roll call was taken on the motion. Ayes: Heald, D. Miller, Harvey, Johnson,
Grohoski. Abstain: Rice
Chairman Harvey opened the public hearing on the application of Conestoga
Leasing, Inc. for a conditional use permit to allow ..for outside storage of
trucks and materials and to amend the existing conditional use permit to
Brown. and Cris, Inc. at 19740 Kenrick Avenue, on the east side of I-35.
Mr. Roger Knutson attested to this being a duly publicized hearing. Mr.
Alan Henriksen, representing Conestoga Leasing, explained what they are
expecting to have at this site and mentioned two memos dated August 13,
1982, from him.
Mr. Marv Geisness arrived at 7:37 p.m.
Discussion followed. Grohoski asked about the septic system being adequate.
This site would be manned 24 hours, with about 15 employees overall. This
would not be a sales office.
82.128 Motion was made by Grohoski, seconded by Rice, to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous
82.129 Motion was made by Grohoski, seconded by Rice, to recommend to the City
Council approval of the conditional use permit for outside storage of trucks
and materials to Conestoga Leasing at 19740 Kenrick Avenue on the east side
of I-35, subject to the 4 conditions. listed in the original conditional use
permit .dated May 22, 1979 and, additionally, subject to condition ~1~5, that
is .that the site shall be accessible to the City Building Official (or other
designated official) at all reasonable. times,"for visual inspection, to
insure-that no hazardous or other detrimental materials (as defined by EPA,
DOT or PCA) are kept or stored on the site.
Roll call was .taken on the motion. Ayes: Unanimous

use permit and a variance to construct a parsonage and a church building..
at the southwest corner of the intersection of Highview Avenue and 150th
Street. untilfurther notice.
Roll. call was taken on the motion. Ayes: Unanimous
Mr. George Branton presented a new drawing, showing the changes that had
been made, on his Lake Vale Townhouse project as approved by the City
Council. Discussion followed. Commission members thanked Mr. Branton 'for
his. presentation.
Chairman Harvey opened the continued public hearing on the application of
Kraus-Anderson Construction Co, for a conditional use permit for underground
fuel storage facilities and a convenience grocery store at the northeast
corner of Highway 50 and Dodd Road. Mr. John Pope of Pope Assoc. Architects.
stated that they had met. with City Staff and successfully addressed the
problem areas, he believed. Mr. Pope went over the 10 items listed in the
consultant's analysis$~2~ir. Leo Gray stated that water runoff would go west
and not east of Iberia. Several commission members were concerned with the
Hiway 50 access. Ms. Heald brought up the rear exposure of the building
and was told the brick would be extended all around.
2.131 Motion was made by Rice, seconded by Johnson, to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous
82.132 Motion was made by Rice to recommend to the City Council that they approve
underground .fuel storage facilities on Highway SO and Dodd Road. Seconded
by Harvey..
82.133 lotion wa3 made by Geisness, seconded by Grohoski, .requesting that the. motion to
recommend approval be amended so, that no access be allowed on to-Hiway-50 and that aC
time the property around it develops, then a master plan be developed around the
the convenience store<~aith appropriate access on to Hiway 50.
Discussion followed with Grohoski stating that we should solve a problem here
before it fiappens. Heald, D. Miller and Johnson agreed also.. Mr. Harvey
stated that the City, County, or State would have to agree to put in a frontage
road on this property.
Roll call was taken on the. amendment motion. Ayes: Heald, Johns;onz ,
Grohoski, Geisness. Nays: D. Miller, Harvey, Rice.
Mr. Rice does not agree with the amendment and Mr. Harvey would have preferred
to see us making temporary: curb cuts that are allowed.

Chairman Harvey opened the continued public hearing on the application
of the City of Lakeville for an amendment to the Zoning .Ordinance No. 167
.'establishing dwelling unit restrictions for residential housing, di~ting-
uishing types of .housing, regulating its use, and authorizing .its location.

82.134 Motion was made by Rice, seconded by Miller, to close the. public hearing.
Roll call was taken on the motion. Ayes: Unanimous
Mr. Roger Knutson read the changes in the draft.
82.135 Motion was made by Grohoski to table the motion on the draft.
Roll call was taken on the motion. .Ayes: Grohoski, Geisness Nays: Heald,
D. Miller, Harvey, Johnson, Rice.
82.136 Motion was made by Johnson, seconded by Harvey to continue the meeting past
10:30 p.m.
Roll call was taken on the: motion. .:Ayes: Heald, Harvey, Johnson. Nays:
D. Miller, Grohoski, Rice, Geisness.
82.137 Motion was-made by Rice, seconded by Harvey, to recommend adopting the
proposed amendment to the Zoning Ordinance No. 167, as changed to:
11.13 >Single Family Dwellings. All single family homes .except in the
RMH District and earth sheltered homes shall:
1. Meet the requirements of the State Uniform Building Code.
2. Be constructed upon a continuous Per meter foundation that
meets. the requirements of the State. Uniform Building Code.
3. Not be less than 30 feet in length and not .less than 22 feet
in width over that entire minimum length. However, all
dwellings shall meet. the minimum floor area requirements as
.set. out in this ordinance. Width measurements shall not take
account of overhang and other pro3ections beyond the principal
walls.
4. Have a roof covered with shingles or tiles.

Rice, Geisness. Nays: Grohoski
Mr. Grohoski explained that his nay vote was because adequate time had not
i been given for discussion and consideration of this item and that he con-
sidered the amendment unnecessary and not in the City's best interest.

Motion was made by Rine to adjourn the meeting.
Voice vote was taken on the motion.
