HomeMy WebLinkAbout0517 c=TSr o~ s~sv=LLS DAKOTA COUNTY, MINNESOTA ORDINANCE NO. 517 AN ORDINANCE AMENDING ORDINANCE NO. 167, THE LAKEVILLE ZONING ORDINANCE, MODIFYING SECTION 36, THE B-2 ZONING DISTRICT BY THE ADDITION OF MOTOR FUEL SALES IN CONJUNCTION WITH CONVENIENCE GROCERY STORE OPERATIONS A3 A CONDITIONAL USB TH8 CITY COUNCIL OF TH8 CITY OF LAREVILLE, MINNBSOTA DOES HEREBY ORDAIN: Section 1. Ordinance No. 167, Section 36.4 is hereby amended by adding the following: 5) Motor vehicle fuel sales (excluding motor vehicle servicing and/or repair). in association with convenience grocery operations provided that: a. The standards and requirements for motor fuel sales shall. be in addition to those which are imposed for other uses and activities occurring on the property. b. Motor Fuel Facilities. Motor fuel facilities shall be installed in accordance with State and. City standards. Additionally, adequate space shall be provided to access gas pumps and allow ..maneuverability around the pumps. Underground fuel storage tanks are to be positioned to allow adequate access by motor fuel transports and unloading operations which do not conflict with circulation, access sad-other activities on the. site. Fuel pumps shall be installed on pump islands. c. Canopy. 1) Upon: specific City Council approval, a protective canopy accessory structure located over pump island(s) may be located on the property and shall be twenty (20) feet or more from the frost andjor side. lot line, provided that adequate visibility both on and off site is maintained. 2) Lighting shall only be permitted under the canopy structure. 3) There shall be no signing on the sides of the canopy. 4) The architectural design and character of the canopy shall be consistent with the. principal building on the site. d. Compatibility. 1) The .architectural appearance,.scale, sad functioaai plan of the .building(s) and.. site shall not be residential in character and shall. not be so dissimilar to the existing buildings or area as to cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot. 2) All sides of the principal and accessory structures are to have essentially. the same or a coordinated harmonious finish treatment pursuant to Section 11.4 of this Ordinance. - e. ..Dust Control and Drainage. The entire site other than taken up by a building, structure, or plantings shall be surfaced with a .material to control dust and drainage which is subject to approval of the City 8ngineer. f. Area. A minimum lot area of twenty thousand (20,000) square feet. and minimum lot frontage of one hundred fifty (150) feet. The City Council may exempt previously ; developed or previously platted property fra~a this requirement provided than the site is capable of adequately and safely handling all .activities sad required facilities. g. Curb Separation. A continuous and .permanent concrete _ curb not less than six (6) inches above grade shall separate internal sidewalks for pedestrian traffic frown motor vehicle areas, gursuant to .the provisions of Section 12.4.8. h. Landscaping. At the boundaries of the .lot, a strip of not less than five (5) feet shall be ~laadscaped and .screened in compliance with Section 9.T of this ordinance. i. Exterior Lighting. The lighting shall be accomplished in such a way as to .have no direct source of light visible from adjacent land in residential use or from the public right-of-way and shall be in compliance with Section 9.9 of this Ordinance. j. Light Standard Base Landscaped. Each light standard .base. shall be landscaped. k. Access. vehicular access points shall c;date a minimum of conflict with through traffic movement and shall comply with Section 12 of this Ordinance and shall be subject to the approval of the City Engineer. 1. Parking. 1) Parking or car magazine space shall be screened from view of abutting residential districts in compliance with Section 9.7 of this Ordinance. 2) Parking .for motor fuel service shall be in addition to that required for other uses on the site. m. Pedestrian Traffic. Aa internal site pedestrian circulation system shall be defined and appropriate. provisions made to protect such areas from encroachments by parked cars or moving vehicles. n. Noise. Noise control shall be as required as regulated in Section 9.13 of this Ordinance. o. Outside Storage and Sales. Except as .herein noted, no outside storage or sales shall be allowed. An enclosed screened area is to be provided for outside rubbish storage and dumpsters. p. Litter Control. The operation shall be responsible for litter control within three hundred 1300) feet of the premises and is to occur on a daily basis. Trash receptacles must be provided at a convenient location on site to facilitate litter control. q. Signs. All signing sad informational or visual communication devices shall be .minimized sad shall be incompliance with Section 16 of this Ordinance. r. Additional Stipulations. All conditions pertaining to a specific site are subject to change when the Council, upon investigation in relation: to a formal request, finds that the general welfare and public betterment can be served as well or better by modifying or expanding the conditions set forth herein.. ' s. Hours of Operation. The hours of operation shall be limited to 6:00 am. to 11:00 pm., unless extended by the City Council. t. The provisions of Section 4.2.5 of this Ordinance are considered and satisfactorily met. Section 2. This ordinance shall be effective on 17 October 1994 following passage and publication.
