Roll call of members was taken. Present: Walters, MacGibbon, Sizer, Langhorst, Heald, Miller. Absent: Lambert (arrived. at 7:07 p.m.) Also present: Tom Grundhoefer, City Attorney; Jim Robinette, Community Development Director; David Licht, City Planner; Shirley Sorensen, Recording .Secretary. Chairman Sizer called for additions or corrections to the minutes of the. March 15, 1984 meeting. Heald added the words 'and was directed to City Staff for further information.' on to the fourth paragraph from the bottom on page 1, following Carpet Values Building; and the words 'and the engineers to review the traffic. design.' to motion 84.39 on page 2, after street parking only. 84.48 Motion. was made by Heald, seconded. by Miller, to approve the minutes of the March 15, 1984 p.c. meeting, as amended. Roll call was taken on the motion. Ayes: Walters, MacGbbon, Miller, Heald, Langhorst. .Abstain:. Sizes Chairman Sizer opened the continued public hearing on the application of North Creek Mobile Home Community, for a mobile home park south. of 170th Street, on the west side of Pilot Knob Road, and for a minor comprehensive plan change to include. the land in the 1990 Planned Urban Service Area. Mr. Robinette explained there had been meetings with the DNR regarding this flood plain area and they are still collecting data before making their final decision.. Mr. Ken Grund and Mr. B11 Block represented North Creek Mobile Home Community and stated that the owners of Countryview had always planned to run one main street all through this develop- m{ent, from back before this plat was officially drawn. They also f~el that 32 foot back-to-back dimension of streets is fine and that a 36 foot street is too wide. They had not understood how many extra parking. spates were required, according to .the .planner's letter dated 4/3/84... Mr. Block doesn't feel that there will be much. effect downstream by changing culvert size. Mr. Grund stated they are working very closely with the DNR and Barr Engineering regarding the flood plain. Betty Sindt, a resident. of Countryview Mobile Home Park, s aced again. that she feels there would be just too much traffic if Countryview Trail were hooked up to Phase Three of North Creek. 7 PLANNING COMMISSION MEETING April 5, 1984 Mr. Licht said that staff has not done an in-depth traffic study. He also stated that street widths can be required that vary from what our ordinance says is a minimum. Mr. Block stated they would meet whatever requirements the City has. Mr. Pete Boelter, 9530 178th Street, Farmington, school counsel- or, wondered about the impact on the schools, how many children will there be from this size development. Mr. Robinette stated he has talked to Farmington Superintendent, who stated. they would gladly take all the students they can get. Mr. Licht stated that the school districts are aware of the projected growth in the Lakeville area. Discussion followed regarding length of lots, width of mobile homes, open spaces., width of.streets, accesses, flood plain. modification,. parking, and number of lots. 84.49 Motion was made by Lambert, seconded by Miller, to close the public hearing. Roll call. was taken. on the motion. Ayes: Unanimous 84.50. Motion was made by MacGibbon, seconded by Lambert, to recommend to City Council .approval. of the application of North Creek Mobile Home Community for. a mobile .home park south of 170th Street, subject to: 1. Recommendations in the .planner`s report of April 3, 1984. 2. Letter to Mr. Block from planner, dated March 26, 1984. 3. DNR approval. 4. Staff recommendations. S. 36` wide collector street. 6. No west connection to Countryview Trail except as a minimum emergency street. 7. One extra visitor parking space, so signed, in each parking bay (.totaling. five spaces per bay). 8. A minor comprehensive plan change to include the land in the 1990 Planned Urban :Service Area. Roll call was taken on the motion. Ayes: Walters, MacGibbon, Heald, Lambert. Nays: Millen, Szer, Langhorst Miller's nay was because he would like to have. had it tabled until after the DNR has made it`s decision. He also wondered about the culvert b@ing sufficient to handle the run-off. in this area. Sizer's nay was because he objects to the. overall design and feels we have a golden opportunity to make a statement that the City>of Lakeville is going to quit making a distinction between R-2 subdivisions and do .away with a concept of a mobile home park. Also, not enough provision made for double wide mobile homes.. 2 • f~ ley PLANNING COMMISSION MEETING April 5, 1984 Langhorst has a problem with the Phase Three second .access and also agrees with Mr. Sizer's comments. Chairman Sizer opened the public hearing on the application of Oswald Wurdeman Trust for the vacation of the street dedicated to the city in the Lyndale Lakes Club First Addition plat and named Valley View Place. Mr. Grundhoefer attested to the proper published and mailed notices having .been given for this hearing. Mr. Robinette explained-what the .intent is here, to vacate a street from an old plat that could not be put in, as it deadends in a lake, and retain drainage and utility easements. 84.51 Motion was made by Miller, seconded by Heald, to close the public. hearing. Roll call was taken. on the motion. Ayes: Unanimous 84.52 Motion was made by Miller, seconded by Langhorst, to recommend to city council approval of this vacation of street named Valley View-Place,: with required easements,. and any. other staff recom- mendations. Roll call was taken on the motion. Ayes: Unanimous Chairman Sizer opened the public hearing on the application of Nancy Schauer for a special home occupation permit to set up a beauty salon at 18246 Italy Avenue. Mr. Grundhoefer attested to the proper mailed and published notices having been given for thishearing. Mr. Licht. stated that signing had not been. addressed .and that they recommend review of the permit after the first year. Sizer feels that commercial businesses should go in a commercial area. 84.53 Motion was made by Heald, seconded by MacGibbon, to close the public. hearing. Roll call was taken on the motion. Ayes: Unanimous 84.54 Motion was made by Langhorst, seconded by Lambert, to recommend to City Council approval of the special home occupation permit ..for Nancy Schauer to set ug a beauty salon, subject to the planner's recommendations of 3/26/84, signage be reviewed and approved by the City, and permit be reviewed after the first year. Roll call was taken on the motion. Ayes: Unanimous Chairman. Sizer opened the. public. hearing on the application of Lakeville Development Co. for a subdivision, planned unit development conditional use permit and rezoning from B-4 to R-6 3 rt . PLANNING COMMISSION MEETING ' April 5, 1984 for multiple housing in the vicinity of Holt Avenue and Highway 50. Mr. Grundhoefer attested to the proper mailed and published notices having been given for this hearing.. Mr. Lichtstatedtheywould recommend approval .subject to-staff re-review to make sure they have updated according to the planner's report dated April. 2, 1984 84.55 Motion was made. by Miller, seconded by Walters, to close the public hearing.... Roll. call was taken on the motion. Ayes: Unanimous 84.56 Motion was made by Heald, seconded by Miller, to recommend approval to city council on the application of Lakeville Dev. Co. for a subdivision, planned unit deuelopment conditional use permit and rezoning from B-4 to R-6 for multiple housing,. subject to the review. and recommendations of the planner's report ..dated April 2, 1984, and any other staff recommendations. Roll call was taken on the motion.. Ayes: Unanimous. Chairman Szer opened the public hearing on the application of Farmington Cong. Jehovah's Witnesses. for a conditional use permit to build a church, on Cedar Avenue,. north of 210th Street.. Mr. Grundhoefer attested to the proper mailed and published notices having been given for this hearing. Mr. Quentin Newland was in . attendance to answer questions about the building of this church. Discussion followed regarding landscape plans, additional parking spaces, screening, well, signing.., and surfacing of the driveway within 6 months of occupancy. 84.57 Motion was made by Miller, seconded by Walters, to close the public .hearing. Roll call was taken on the motion. Ayes:. Unanimous 84.58 Motion was made by Miller, seconded by Walters, to recommend to City Council approval of .the conditional use permit to build a church on Cedar Avenue, subject to the recommendations in the planner's report of 3/28./84, specifically to the paving of the. parking. lot within 6 months from time of occupancy, and any other staff recommendations. Roll call was taken. on the motion. Ayes: Unanimous Chairman Sizer opened the public: hearing on the application of Queen Anne. Courts for rezoning from B-4, General Business to- R-MH, Mobile Home. Park and for development approval for the expansion of Queen Anne Park. Mr. Grundhoefer attested to the proper mailed. and published notices having been given for this.. hearing. Mr. Robinette `stated that no sufficient grading or 4 • . PLANNING COMMISSION MEETING April 5, 1984 drainage plans have been submitted to the City. Also, the City has planned. for a park in that area for a long time., and the developer would like a park to the west - not to the north. The Park Director stated that the land to the west could possibly be considered if things were just right. Mr. Don Hess, Landplan, Inc., made the presentation for the developer, explaining what they propose to do at Queen Anne Mobile Home Park. He stated that he feels strongly that this design can be worked out, although they have come up on a few problems. Currently they are planning for water to go to both the. old and the new parks. He stated they will be getting a grading plan to the City. that they hope will be acceptable. and will pursue developing a park to the west, with that landowner. The following items were discussedt landscaping, entrances to the park(s), fire dept. access to water, storm protection bldg.,. secured storage area, setbacks, screening,•distance between homes, and many of the things that had been discussed at our March 1, 1984 p.c. meeting. Mr. Bob Rystrom, 11325 172nd Street, was spokesman for many of the neighbors. of this proposed .park and stated that the land. to the west is swamp. He said these neighbors are. all adamantly opposed to this expansion. He cited a school burden, traff is on to 172nd St would be unreal, many incidents have taken place already (If we don't have the manpower now, what will happen. with • this increase?), noise pollution, Orchard Lake already over- crowded, decrease in property values (will discourage people from buying homes), streets crowded with cars, boats, etc., violation of private drive (do not want it expanded), and many more reasons listed in the attached petition signed by 136 resident Chairman Sizer received this petition (including aerial pictures) signed by 136 residents .opposed to expansion of Queen Anne Park. Mr. David Olson, 11516 172nd St., explained that the proposed ponding is more like a lake. Mr. Bob Peterson, 17496 Kodiak. Ave, saidhe had also talked to the. people .that own the land where the road is proposed to go over. the tracks and said. it couldn't be done. He suggested that we take a drive through the old park, saying this new park will be an old park in 10 years and will look. just like Queen Anne does today. He also stated that the building that was the storm shelter in old Queen Anne is now being used as someone's home. Mr. Bi11 Stone was concerned about safety - would like to have seen a detailed. plan for shelters. Also.,-where will they put boats, trailers,.. etc Ms. Lois Kindvall, 17137 Kirben Ave:, felt that $1500 a year in taxes is too much to pay for dodging cars coming from this park now. 5 t ~ ~ PLANNING COMMISSION MEETING April 5, 1984 Ms. Rosalyn Wilson, 11538 172nd St., does not want her land having any more water than she already has.. Mr. Robinette stated that there is an approved proposal for the interchange and widening of Highway 50-5, construction scheduled to begin. in the summer of 1985. Chairman Sizer stated that he feels that the highest and best use of the property is as B-4. With. the development going on in Lakeville now, the B-4 will be able to be more- compatible with the surrounding R-2 zoning district. 84.59 Motion was made by MacGbbon, seconded by Miller, to close the public hearing. Roll. call was taken on the motion. Ayes: Unanimous 84.60 Motion was made by Sizer, seconded by Langhorst, to recommend to city council denial on the application of Queen Anne Courts for rezoning .from B-4, General Business to R-MH, Mobile Home Park, for the reasons stated earlier. Roll call was taken on the motion. Ayes: Unanimous 84.61. Motion was made by MacGibbon, seconded by Miller, to table any action on the development for the expansion of Queen Anne Park until. the City Council acts on the rezoning. Roll call was taken on the motion. Ayes.: Unanimous Chairman Sizer opened the public hearing. on the application of Autumn Winds Farms for rezoning from R-1, low density single family, to R-A, single family-agricultural, and a conditional use permit for the operation of a commercial stable at 19198 Judicial Road. Mr. Grundhoefer attested to the proper mailed and pub- lished notices having been given for this hearing... Ms. Judy Titcomb was in attendance representing the applicant and asked that this matter be tabled until the next meeting, to give them time for surveying, etc. Mr. Licht agreed it would be better to give everyone more. time for study and Gable until April 19th. Ms. Sharon Sinner was in attendance, asked if her 3-page letter had been distributed to p.c. members, and. was told it would be along with afll other pertinent. information, prior to next meeting. 84.62 Motion was made. by Miller, seconded.. by Langhorst, to continue this public hearing until the. April 19, 1984 meeting, to give applicant and. staff more time for gathering information. Roll call. was taken on the motion. Ayes:. Unanimous 6 w i~ ' 4 ' PLANNING COMMISSION MEETING April 5, 1984 Chairman Sizer called on Mr. Licht. to explain what has happened on the Dodd Pointe Plat. He gave some of the detail and what changes have been made in getting this plat in accordance with staff recommendations. Mr. Jim Hill and Mr. Pat Finnegan represented the developer and. expressed indignation about Mr. Blumberg's performance at the February 2nd planning. commission meeting. He asked p.c. members. to put out of their minds the things Mr. Blumberg said previ- ously, while making their. decision on this plat.. He said the owners of the property are nice people and had a difficult piece of property to work with. Mr. Hill explained the type of homes they would be building, the correct spacing to be achieved, and berming along the county road. 84.b3 .Motion was made by Lambert, seconded by Walters, to recommend to city council approval of the revised Dodd Pointe Subdivision plat for. R-2 planned unit development conditional use permit,. rezoning. from. R-2 to B-3, and approval of the preliminary plat,. subject to recommendations of City .Staff. Roll call was taken on the motion. Ayes: Unanimous 84.64 Motion was made by MacGibbon to close the meeting.
