City Council Chambers. Roll call of members. was .taken. ..Present: .Heald, Lambert, Langhorst, MacGibbon, Miller, Sizer, Walters. Also present: Roger. Knutson, City Attorney; .Alan Brixius, City Planner; Jim Robinette., Community Development Director; Pat McGarvey, City Administrator; Shirley Sorensen, Recording Secretary. Chairman Sizer asked if there were any additions or corrections to .the minutes of the May 3, 1984 p. c. meeting. 84.83 Motion was made by Heald, seconded by Walters, to approve the minutes of the May _3, 1984 meeting. Roll call was taken on the motion. Ayes; Walters, MacGibbon, Sizer, Heald., Lambert.. Abstain: Miller, Langhorst Chairman Sizer opened the public hearing on the preliminary plat • of Suburban Builders for a 13 lot subdivision to be known as Rock. Ridge, located on 173rd St. W. and Ipava Avenue, and also for a .minor comprehensive plan change to include it in the 1990 Planned Urban Service.. Area. Mr. Knutson attested to the proper mailed and published notices having been given. Mr. Del Goetze, developer, was in attendance to answer questions. He asked about the pedestrian easement and was told on this particular plat it would not be necessary._ A temporary cul- de-sac at the .end of 173rd. Street was. discussed.. It was stated that the park. dedication fee is handled at the time of final .platting. 84.84 Motion was made by Langhorst, seconded by Miller, to close the public hearing. Roll call was taken on. the .motion: Ayes: Unanimous 84.85 Motion was_made by Heald, seconded by Walters to recommend to City Council approval of the preliminary plat of Suburban. Builders for a 13 lot subdivision known as Rock. Ridge., subject to recommendations from planner's report dated: l0 May 1984, exclud- ing necessity of a pedestrian. easement. near the center of Block 1, engineer's report dated 15 May .1984, and any. other Staff rec- ommendations; also, for a minor comprehensive plan change to include it in the 1990 Planned Urban Service Area. • Chairman Sizer opened the public hearing: to consider an amendment Planning Commission Minutes May 17, 1984 • to 11.4 of the Lakeville Zoning Ordinance concerning restrictions on the use of exterior building construction materials. Mr. Knutson attested to the proper published notices having been given. Chairman Sizer called on Mr. McGarvey to apprise us as to what has prompted this amendment. Mr. McGarvey said that the Carpet Values building, which sits along 35W, was .originally proposed as a metal building, but was eventually approved with a different exterior material. He went on to .tell. about the several large developments that are .going to be built in the Lakeville area,. that have definite style that the builders will pursue ..and we have. need, perhaps, of some building restrictions.. This is the first time the City has some large commercial .developments and we would like to insure these .businesses that their businesses will be protected and also to keep big business coming,. to keep things in our area nice and of good quality.. Mr. McGarvey has made some .inquiries regarding requirements in other suburbs, so that we might have some direction for answering. questions regarding building in our area.. Burnsville and Eden Prairie prohibit metal buildings, except in farm areas. Mr. McGarvey feels we need appropriate ordinances now, rather than to wait for the next problem. . Mr. Brixius stated hey have tried to get in some flexibility, allowing for alternative materials. Some.. districts would. be more restrictive than others.::. Some metal buildings would be_allowed, worked into the exterior treatment. of the building. He, too, feels that it is up to us now to get standards set, to get a good foundation. Mr. Robinette stated that there is now a moratorium on .putting up a metal building in Lakeville. Mr. Richard Reinhart, 20455 Idalia, was wondering if this would pertain to utility buildings on residential property. He said he had tried to get a permit to build a 12 x 12 wooden building on his lot and was told he should come to this meeting, Mr. Robinette talked to him, Mr. Bob Fitzgerald,. Mid Continent Steel, 7525 Mitchell Road, Eden. Prairie, MN, said he has. been in the metal building business for 30 years and would like us to give him about 15 minutes (at our next meeting) to make a nice presentation, since we are consider- . ing an amendment change. We will put him on the agenda for our special May 31st meeting. Mr. Dick Brandis, 21382 Heywood Avenue, two years ago built a metal building and has put up masonry buildings as well, which are sometimes just as shoddy. Curbs can be .put around parking- . .lots to dress them up and he believes that. any industrial park has to be kept up. 2 Planning Commission Minutes May 17, 1984 84.$6 Motion was made by Heald, seconded by Langhorst, to continue this public hearing until our May 31st meeting.. Roll call was taken on the motion. Ayes: Walters, MacGibbon, Sizer, Heald, Langhorst, Lambert. Nay: Miller Miller's nay was because he wanted to hear. more discussion this evening. Chairman Sizer opened the public hearing on Senior Citizen Center for a proposed zoning amendment change from R-5 district to R-7 District, application for a conditional use., planned unit development to build .both an elderly .housing/senior citizen building complex, conditional use permit for .senior citizen housing project, conditional use permit for recreational govern- ment buildings, variance from the provision of the Lakeville zoning ordinance to .permit 13 off-street parking spaces at the proposed Senior Citizen Building rather than .the required 24, variance from the provision of .the Lakeville zoning ordinance to permit 11 off-street parking spaces at the. proposed elderly housing building rather than the required 24, and resubdivision and combining various lots. Chairman Sizer called on Mr.-McGarvey to make the .presentation of • this item. Mr. McGarvey stated that the Federal Government. allocates certain funds :for these projects, and on1y..100 units were allocated for-this year, as compared with sometimes 1000 units allocated in years .past. Of this 100 units, Lakeville received 24, that is why .the 24 unit building is proposed to be built. One of the requirements for receiving these funds is that the building be located close.. to downtown area, and will be built in conjunction with the Senior Citizen Center which is to be funded by a Community Block .grant .from Dakota County. Mr. McGarvey explained that there is a lot of competition for these type funds .and much .criteria has to be met. He went on to say where they would be located,. parking could be a problem and .would be addressed at such time as it is, need for rezoning and conditional use permit,. acquisition of the land, size of apart- went units, .requirements for living there, variance, and .funding. Ms. Colleen Ortner, 20665 Holt, pointed out that the post office is moving their offices into_the Gephart Building and a new furniture store would be moving in that building also, so was wondering if there wasn't going to be a large parking problem, as well as the additional traffic. Mr. Brixius stated that the P.U.D. request is asked for to take care of the variance and they recommend approval of the rezoning, permits, and variance.. • Mr. Glenn Nord, 20655 Holt., stated that he is definitely in favor 3 4 Planning Commission Minutes May 17, 1984 • of this project, but feels there are several serious problems .that need to be dealt with now. Those are as follows: Parking, traffic on 207th St. is already a problem now and will get .worse, put up stop signs as a condition, plain looking building could be much prettier with little added cost, no landscape .plan, and take out entrance to apartment building from_Holt Avenue. He feel these are issues that should be addressed now. Mr. Brixius stated that.a landscape plan will. be submitted at a later date. Mr. McGarvey said that we will probably end up with no money if .too many changes .are .made. Ms. Diane Gossard, 17342 Junelle Path, was wondering why the buildings have to be so close and where the ...shelter .would be in case of an emergency. She also stated. she would like to see a larger building for housing. 84.87 Motion was made by Lambert, seconded by_MacGibbon, to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous The .planning commission wishes to go on record saying they do foresee some parking problems and the City may have to buy some additional land, in the future, to be .used as a parking lot.. • 84.88 Motion was made by MacGibbon, seconded by Miller, to recommend to the city council approval of the. zoning amendment change from R-5 District to R-7 .District. Roll call was taken on the motion. Ayes: Unanimous 84.89 Motion was made. by MacGibbon, seconded by Lambert, to recommend the city council approval of the application for a conditional use, planned unit development to build an elderly housing/senior citizen building complex, conditional use permit for senior. citizen housing project, conditional use permit for recreational government buildings, variance from the provision of the Lake- ville zoning ordinance to permit 13 off-street parking spaces at the proposed Senior Citizen Building rather than the required 24, variance from the provision of the_Lakeville zoning ordinance to permit 12 off-street parking spaces at the proposed .elderly housing building rather than .the .required 24, and resubdivision and combining of .lots 1, 2, 3, 4, 5, Block 8 Berres Addition, Dakota County, MN and.. Lot. 12, Block 14, Lakeville Village, subject to the planner's-report and adding to the conditional use permit restrictions X11 'That the City shall actively pursue additional .parking and alleviate any problems once they exist and have a traffic study done by .traffic engineer', plus any other Staff recommendations. • Roll call was taken on the motion.. Y P g Chairman Sizer opened the .public hearing to consider application of John Rowan and Joe Huss for. variances to build a garage within 8 feet of .the side lot ..line. on .the south and 5 feet of the :.north lot line, to serve the existing duplex on the property at 20404/20406 Howland Avenue. Mr. Knutson attested to the proper mailed and published. notices having been given for this hearing. Discussion followed as to just where the garages would, or could, be located. Motion was made by Lambert to close the public hearing, but died for lack of a second. 84,90 Motion was made by MacGibbon, seconded by Lan~horst., to continue this public hearing until June 7, 1984, to give applicant .and planner some time to come up with a compromise, perhaps a smaller or no variance. Roll call was taken on the motion. Ayes: Unanimous Chairman Sizer called for the final plat of Woodridge Estates Second Addition. • 84.91 Motion was made by Langhorst, seconded by Miller., to .recommend to city council approval of the final plat of Woodridge Estates Second Addition, subject to planner's report and any other Staff recommendations. Roll call was taken on the motion. Ayes.: Unanimous 84.92 Motion was made by Miller., seconded by Langhorst, to adjourn the meeting. Voice vote was taken on the motion.
