+ ~ Lakeville, Minnesota i PLANNING COMMISSION MEETING MINUTES August 16, 1984 7:00 p.m. Steve Sizer., Chairman, called the meeting to order at 7:00 p.m. in the Lakeville City Council Chambers. Roll call_of members was taken.. Present: Heald, Lambert, Langhorst, MacGibbon, Sizer, Walters. _Absent; Miller (arrived at 7:08 p.m.) Also present: Roger Knutson, City Attorney; Alan Brixius, City Planner; Jim Robinette, Community Development Director; Shirley Sorensen,.Record- ing Secretary. Chairman Sizer called for. additions or corrections to the minutes of the July 19, 1984 p. c. meeting. 84.128 Motion. was made by Langhorst, seconded by Heald, to approve the minutes of the July 19, 1984 .meeting. Roll call was taken on the motion., Ayes: Walters, MacGibbon, Heald, Langhorst, Lambert. Abstain: .Sizer Chairman Sizer called for final plat approval of Rolling Oaks South (formerly Alpine Village). Mr. Jack Lynch explained the reason for changing.. the name having to do with finding out that all. the street names would start with the letter 'J'. Mr. Doug Malam of Registered Properties stated the reason for final platting into. outlots is in order to get it recorded at the County. Phase I is expected to begin this fall, at which time we will see platting of the first outlot. 84.129 Motion was made by .Heald, seconded by Lambert,. to .recommend. to City Council approval of the final plat of Rolling Oaks South (formerly Alpine Village), subject to any,_recommendations by Staff. Roll call was taken on the motion. Ayes;. Unanimous Chairman Sizer opened the. public. hearing to .consider the application of the Lakeville Development Company for vacation of a drainage easement, dated July 19, 1910, east of the intersection of .210th Street and Holt Avenue. Mr. Knutson stated that the proper mailed and published notices have been given for this hearing. Mr. Brixius stated that this was a blanket easement that is no longer needed, therefore the engineers recommended that it be vacated, 84.130 Motion was made by MacGibbon, seconded by Walters, to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous Y ~ Planning Commission Minutes August 16, 1984 i 84.131 Motion was made by MacGibbon, seconded by Langhorst, to recommend to City Council approval of the application of the Lakeville Development Company for vacation of a drainage easement, dated July 19, 1910, east of the intersection of 210th Street and Holt Avenue, subject to City Staff recommendations.. Roll call .was taken on the motion.. Ayes: Unanimous Chairman Sizer opened the public hearing to consider the application of Jack Lankas Homes. for subdivision and rezoning to R-6. Also for a Planned Unit Development conditional use. permit for multiple .dwellings and a minor comprehensive plan change to include it in the 1990 Urban Service Area. Mr. Knutson stated that the proper mailed and published notices have been given for this hearing. Mr. Rick Sather, Engineer and .Planner, stated he has been .retained by Mr. Lankas to prepare the drawings for reviewal here tonight. He made a very good slide presentation and explained they were asking for rezoning from I-1 and R-2 to R-6, to put up 4-unit and 8-unit buildings. He went. on to explain the exception area, where Mr. Sam Testa lives and has an apart- ment building, also showing slides, of the type of buildings they propose to put up, the surrounding .area (.including the Jemm Building site), and explaining the berming, streets, parking, drainage., etc. There were approximately 30 residents in_attendance, of which. only three were_in favor of .this project. Mr. Sam Testa stated he had no objection at all, felt it would be a good use of this surrounding land, and getting rid of the industry there, Mr. Brixius went over his report dated August 13, 1984 reiterating the :three things that the commission is considering tonight. Discussion continued for two hours on the following objections: Rezoning to R-6, too dense a use Drainage and present high water level Mixing single family and multiple dwellings Increased traffic Traffic. hazardous to children fishing along Co.-Rd. 64 .Natural flow of water .Separation (berming) between Meadows 4th and this proposed project Value of single family homes would go down Type of association Multiple dwellings become rental units Soundproofing and firewalla required Location of entrance street off Co. Rd. 64 Storm sewer Increased noise level. Attached is a list of residents who spoke in opposition to this project. • 2 Planning Commission Minutes August 16, .1984 • Mr. Steve Grohoski, 18390 Jamaica Path, stated that he is a developer in Lakeville and has, in the past, asked for rezoning to R-5 of a parcel of land before platting, so as to let the people buying lots (houses) in a subdivision adjacent to!it know what will. be .going in in the future, .and avoid what is happening here tonight. He went on to say that going to R-6 zoning is overkill, and perhaps .should go with R-4 or R-S. Mr. Grohoski is opposed to this project, feeling there is enough land already zoned for multiples close by. Mr. Jim Widmer., 9941 Upper 205th St W, feels this would improve the value of his property,. but said that perhaps R-6 zoning is too dense. Discussion continued with the planning commission members concerns as follows: Associations Density Parking Transition from R-2 to R-6 8-plexes Shoreland Overlay District Dis ance from established homes to proposed buildings Drainage • Traffic Mr. Sather. explained that the. house pads would. be 2 feet above the highest water level of Lake Marion. Mr. Lankas said they have not had any water problems in the area where they are currently building homes (nearby). Mr. Brixus stated that_studes do not indicate that property values go down because of multiple dwellings next door. Mr. Lankas explained that their association would be quite stringent. Mr. Sather stated that the parking .problem could be worked out according to planner's recommendations. 84.132 Motion was made by Heald, seconded by Langhorst, to close the public hearing.. Roll call was taken on the motion. Ayes: Unanimous Discussion followed mostly regarding the density. 84.133 Motion .was made by Heald, seconded by Lambert, to recommend to the City Council denial of the application of Jack Lankas Homes for rezoning from I-1 and R-2 to R-6, due to the surrounding area, that it is not in character with the general area, thus the other two requests (for PUD CUP and minor comp. plan change) become moot. Roll call was taken on the motion. Ayes: Unanimous 3 Planning Commission Minutes. August 16,, 1984 • Chairman Sizer opened the public hearing to consider the application of Nancy Moore ..for vacating an alley easement at 20944 Holyoke Avenue. Mr. Knutson stated that the proper mailed and published notices have been given for this hearing. Mr. Brixius went over the engineer's report stating they are vacating the alley underlying the bowling .alley. 84.134 Motion. was made by MacGibbon, seconded by Langhorst, to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous 84.135 Motion was made by MacGibbon, seconded by Walters, to recommend to City Council approval to vacate. the alley easement, .per the engineer's report dated August 14, 1984. Roll call was taken on the .motion. Ayes: Unanimous Chairman Sizer opened the public. hearing. to consider the application of Amy Miskowiec for a special home occupation permit to operate a sign painting business at 19986 Kenwood Trail. Mr. Knutson stated that the proper mailed and published notices have been given for this hearing. Ms. Miskowiec explained what she plans to_do and Mr. Brixius went. over his report dated August 6, 1984. 84.136 Motion was made by Miller, e.conded by Heald, to close the public hearing. Roll call was taken on the motion.. Ayes: Unanimous 84.137 Motion was made by Miller:, seconded by Langhorst, to recommend to the City. Council approval of the special home occupation permit for Amy Miskowiec to ...operate a sign painting business at 19986 Kenwood Trail, with the planner's recommendation that it be renewed after one year, and any other Staff recommendations. Roll call was taken on the motion. Ayes: Unanimous Chairman Sizer opened the .public .hearing to consider the application of Everett W. and Karen_L. Wright for a planned unit development conditional use permit to build a self-service .car .wash and miniature_goif course on 160th Street, east of Cedar Avenue. Mr. Knutson stated that the proper mailed and published. notices have been given for this hearing. Mr. Everett Wright .introduced his architect,. Dave. Darrell, who stated .that they would go along with the recommendations of City S aff and asked if anyone had any questions. Mr. Brixius went over his report of August . 8, 1984 and stated they would recommend approval if recommendations were addressed and revised plan submitted. 4 Planning Commission Minutes August lb, 1984 • 84.138 Motion was_made by Miller, seconded by MacGibbon, to .close the public hearing. Roll call was taken on -the motion. Ayes: Unanimous Discussion followed regarding:.:accesses., signs, drainage_of water from car wash, finish on concrete block bldg., building. on .golf course and foods. 84..139 Motion was made by Miller, seconded by MacGibbon, to recommend to City Council approval of the .application of .Everett. Wright for a_planned unit development conditional use permit to build a self-service car wash and miniature golf course on 160th Street, east of Cedar Avenue.,. subject to the conditions on Page 5 of the .Planner's Report dated August 8 , 1984 and any other staff recommendations. Roll call was taken on the motion. Ayes:. Unanimous Chairman Sizer opened the public hearing. to consider the application of Brad Johnson for a planned unit development conditional use permit to .build an apartment complex between 208th Street and 209th Street, behind the Gephart Warehouse., Mr. Knutson stated .that the proper mailed and . published notices have been given for this hearing. ' Mr. .Johnson showed a revised .landscape plan and Mr. Brixius went over his report of August 9, 1984 in detail. Mr. Craig Meyer, 8630 209th Street, had a letter written to the planning commission members, city council, and Mr. McGarvey,_and signed by 29 residents of the surrounding area, stating their opposition to the building of this multi-unit development. Let these minutes reflect receipt of this petition and is attached herewith. Chris Meacham, 8615 209th St W, felt this is a hodge-podge of zoning and not in keeping with the .surrounding area. Mrs. Pat .Murphy, 8560 209th St W, stated she doesn't remember this. .property was zoned any more than for R-2, single family residen ial. Linda Wright lives right next to this proposed apartment complex and is .concerned .about the. traffic, as is her husband, Charles. He said that when the warehouse was put in there was to be no on-street parking, no loading and no garbage outside .and.. all of_these things have occurred. He feels the street needs to be unplugged before we put any more traffic on it. The Recording Secretary has been instructed. to look up the cond- tions pertaining to the Gephart Warehouse. • 84.140 Motion was .made by Langhorst, seconded by Miller,_to ..close the .public hearing.. 5 Planning Commission Minutes August. l6, 1984 • Roll call was. taken on the motion. Ayes: Unanimous 84.141 Motion .was .made by Mi11er,_ seconded by Walters, to recommend to City Council approval of the application of Brad Johnson for a planned unit development .conditional use permit to build an apartment complex between 208th Street. and 209th Street, subject to planner's report of .August 9th and, more specifically, to no parking on 208th Street. Roll call was taken on the motion. Ayes:. Unanimous Under other business, MacGibbon suggested we get a committee to regulate signs being put on commercial .buildings. She mentioned the Carpet Values sign as an eyesore. 84.142 Motion was made by MacGibbon, seconded by Miller, to adjourn the meeting. Voice vote .was taken. on the motion. McGarvey, City Clerk As residents and owners of pr©perties adjacent to the land between 208th and 209th Streets West, we are opposed to the granting of a permit for the construction of multi-unit apartments on this property. It is our opinion that the .planned development is not in the best interest of our neighborhood for the following reasons: - We feel that the type of structures proposed are not in keeping with the present character of our neighborhood, that .being single family dwellings owned by their residents. Multi-story apartments of this type would definitely not enhance the appearance of this area. - We are concerned (especially those of us with small children) about the M increase in traffic that would result from twenty four rental units. - We are concerned about the increase in activity and noise in what is currently a quiet and peaceful neighborhood. - We are very concerned about the effects of the proposed development on the market value of our homes. In addition, we would like the Planning Commission to carefully consider if Lakeville has a real need for additional rental units of this type in this part of town.
