HomeMy WebLinkAbout0519 ORDINANCE NO. 519 CITY O`F LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING ORDINANCE NO. 167, THE ZONING ORDINANCE, CONCERNING ACCESSORY BUILDINGS AND YARD SETBACK REQUIREMENTS THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS: Section 1. Section 9.4 of Ordinance No. 167 is amended by adding subparagraphs. 9 and 10 to read as follows: (9) Site Plan Approval. Accessory buildings with. 120 square feet of projected roof area and less must receive site plan approval before they are constructed or moved onto property. The Building Official shall review the site plan and construction drawings to determine compliance with the zoning ordinance and .other applicable ordinances, laws, and regulations. (10) Not withstanding Section 9.4(4), domestic animal enclosures shall not be placed in the front yard or in side yards abutting a street, shall not be placed closer than ten (10) feet to any property line, and shall not be placed closer than twenty-five (25) feet to any dwelling unit other than on the owner's property. No encroachment shall be permitted in existing or required drainage and utility easements. Screening and/or a hard surface will be required if problems occur with appearance, noise, odor, and sanitation as determined by the. Zoning Administrator. Section 2. Section 2.2 of Ordinance No. 167 is amended by adding the following definition: Domestic Animal Enclosure: Any accessory building or portion thereof, accessory structure or area of any kind, including,. without .limitation, pens, runs, kennels and domestic animal houses, that is principally used or designed for use as a place for keeping domestic animals. An electronic pet containment system is not considered a domestic animal enclosure. 9736 rO T/21 /94 Section 3. Section 11.5(1)(b) of Ordinance No. 167 is .amended to read: Terraces, steps, decks, uncovered porches, stoops, or similar features provided they do not extend above the height of the ground floor level of the principal structure or to a distance less than five (5) .feet from a side yard or more than five (5} feet into a required front yard. Terraces, steps, decks, uncovered porches, stoops, or similar features may extend to within ten (10} feet of a rear lot line. No encroachment shall be permitted in existing or required drainage and utility easements. Section 4. This ordinance shall be effective immediately upon. its passage and publication.
