Chaffers. Roll call of members was taken: Present. Geisness, Antolik, Harvey, Miller, Enright, Rice. Absent: Johnson. Also present: Frank Kriz, City Engineer; Roger Knutson., City Attorney; David Licht, City Planner. The Chairman requested a review of the 18 June 1981 Planning Commission meeting minutes. 81.120 Motion was made by Enright, seconded by Rice to approve the 18 June 1981 Planning Commission meeting minutes. Roll call was taken on the motion, Ayes: Geisness, Miller, .Enright, Rice. Abstain: Harvey, Anto) ik Chairman Harvey opened the continued public hearing on the application of Klotz Constructian, Inc. for. a conditional use permit to build a house within 1,000 feet of Ch~chard Lake. and for a variance in setbacks from the lake and street at 12000 168th Street W. Mr, Klotz appeared before the Commission and indicated that the final plan revisions resulting from a meeting with City staff had not. as yet been completed . Mr. Licht stated that City staff had met with Mr. Klotz and by slightly repositioning the house and garage atwenty foot setback from the lake had been achieved, as well as a reduction in grade .between the house and the lot. The concerns noted by the Natural. Resources Committee as o consequence were resolved and the staff therefore recomrr~nds approval of the applicatian, Mrs. Enright questioned whether the Jot line question be#ween the Klotz Construction property and the neighbor had been resolved . Mr. Klotz and Mr. Kriz verified that it had . 81.121 Motion was made 6y Rice, seconded by Enright to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous $1.122 Motion was made by Rice, seconded by Enright to recommend to the City Council approval of the application of Klotz Construction, Inc. for a conditional use permit to build a house within 1,000 feet of C?rchard Lake and for variances in setback from the lake'and up to an eight foot front yard setback at"12000-1b8th Street W. subject to final plan review .and acceptance by staff. Ayes: Unanimous. r c ~~,'s Lakeville, Minnesota Planning Commission Meeting 2 July 19$1 The continued public hearing on the conditional use permit for Ken Zak to build a garage over 1,000 square feet at 21490 Keokuk Avenue W. and to rezone the .property from {-1 and ICD to R-1 was opened by the Chairman. Mr. Phillip Schiebe, Attorney representing the applicant, appeared before the Commission. He stated the main issue at hand was the body shop use which the applicant wishes to operate in conjunction with his residence, Mr, and Mrs. Zak appeared and stated the primary reason for purchasing the property was its zoning and their being able to construct and operate a body shop in conjunction with their home. They stated they understood such was acceptable based upon conversations with Sid Miller, Lakeville Building Official . Upon questioning Mr. Zak stated he had stated that City Council approval was required. Mr. Antolik stated Mr. Miller would not have been aware of restrictions placed upon the .property when Waconia Homes gained approval of the structure as a model . Mr. Harvey stated single family zoned property existed to the immediate west of the Zak land. Mr. Geisness questioned what use was apprc~riate for the area. Mr. Licht explained the limited size of all the industrial property west of I-35, south of County Road 70, made questionable any nonresidential use . Lack of public .sewer and water further limits the type of development . If the property were rezoned to R-1 the Zak's could at least .legally occupy their home. At present they are classified as an illegal nonconforming use. Additionally, if .both a residence and body shop were wanted on one site, a PUD • zoning would be required due to two principal activities being conducted. Mr. Geisness stated he sympathized with the applicant's situation, but questioned a body shop opera- tion in association with a home and also the validity of a PUD in this'type of case. Mr. Antolik stated he agreed. Mr. Miller questioned. whether this was not an isolated case and if some flexibility could be given. Mrs. Enright questioned the precedent which would be set, plus if this was good long range planning. Mrr Rice stated similar concerns .and stated that once granted, it would be hard to restrict such action. 81.123 Motion was. made by Enright, seconded by Miller to close the public hearing... Rolf call was taken on the motion. Ayes: Unanimous Mr. Zak stated the rezoning and conditional use permit as recommended by staff does not achieve the objective of what is wanted . Mr, Geisness questioned the purchase of the property. Mr. Schiebe presented a letter from Steve Pemberton, the realtor sellirx3 the property. Mr. Zak stated he would not have bought the property solely as a residence. Mr. Harvey questioned whether the applicant had changed his plans for the property as only recreational equipment storage was discussed at the first public hearing.. He further questioned whether action was wanted on the matter at this time or whether the applicant and their attorney wished to .confer. The applicant indicated he wished to discuss the situation further with his legal counsel . Mr. Harvey tabled further discussion of the Zak request until later in the meeting. 2 / i C.' ~r Lakeville, Minnesota Planning Commission :Meeting 2 Juty 1981 The Chairman opened the public hearing on the application of Lakeville Building Co., Inc. far a conditional use permit for underground fuel tanks, outside storage, and to build on a lot without city sewer and water south of County Roc~l70 on the east side. of Kertrick Avenue Mr. Knutson attested to the validity. of the hearing.. Mr. Larry GreII and Mike Greiser appeared orrbehalf of the applicant. Mr. Knutson stated far the record that his office represented Mr. Greiser at times, but not in this request . Mr. Kriz outlined the major drainage question facing development of this property and stated that a drainage study and plan was needed. Mr. Grell indicated his acceptance of the study. Mr. Kria stated other problems were considered minor. The maximum curb cut- is recommended at 32 feet, the parking lot needs to be moved five feet from the right-of-way line. Aturn-around is needed at the.-end of the parking lot. He also stated the property is nonsewered so no resubdivision should be permitted. Mr. Licht stated approval from the State Fire Marshall .was. required for'the fuel tanks and that a landscaping and. screening plan and bond would be needed. On-site sewer plans and information,. as well as provision for handicapped areas had been noted as necessary by the City Building staff. Mr. Geisr~ss questioned who maintains the road servicing the property. It was noted that it is a county road. Mr. • Geisness further questioned if this was a branch terminal and what possible. reuse could be made of the fac i I i ty . $1 .124 Motion wasmade by Enright; seconded by Miller to close the public hearing,. Ayes: Unanimous $1 .125 Motion was made 6y Miller, seconded by Rice to recommend to the City Council approval of the application of Lakeville Building Co., Inc. for a conditional use permit for under- ground fuel tanks, outside storage, and to build on a lot without city sewer and water south of County Roca! 70 on the east side of Kenrick Avenue, subject to correction of problems and compliance with items recommended by staff, plus approval of the State Fire Marshall of fuel storage . Roll call was taken on the motion. Ayes: Unanimous The pub) is hearing on the: application of Pau( J . Krause, 35-50 Development Corporation, for a preliminary plat of Argonne Park located south and west of Highway 50 near 175th Street was opened by the Chairman. The validity of the hearing was attested to by Mr. Knutson... Mr. Glenn Nord, attorney representing the applicant, illustrated. plans for development of the property in question. Mr. "Gene Jacobson, consultant for the applicant, stated the County had indicated .acceptance of the plat name. He also. stated they wished lot line easement requirements waived, plus a reduction of the interior street i from 66 feet to 60 feet, City staff indicated variances would have to be requested . 3 M Lakeville, Minnesota Planning Commission Meeting 2 July 1981. Ms. Sherly Neisbit of Argonne Farms questioned zoning in the area. An explanation of zoning was supplied by the Commission and staff. Mr. Nord stated retail space and offices would be placed on the site in question. Mrs. Enright stated this land is located in the major entrance to the City and should be properly planned.. Mr. Antolik questioned traffic generated by the proposed development ar~d the ability for Highway 50 to handle. Mr. Geisness stated the (arid involved in the request is choice property and is this the best plan for the area. Mr. Licht stated that details such as drainage have yet to be worked out which may serve to modify the present design. Staff at this point has no recommendation on the subdivision. Mr. Krause statedlakeville State Bank plus medical clinics and offices were interested in the property. Mr. Geisness questioned if fewer lots and buildings were desirable. Mr. Harvey stated traffic in the area, especially with trucks is now a problem and needs to be corrected before allowed to increase. He also questioned the size and appearance of lots and buildings backing onto Highway 50. Mr. Miller stated he felt lot size was up the applicant. Mr. Licht stated a phasing of development may reduce traffic problems. Mr. Krause and Mr. Bill Jackson stated they wished to pursue development of the entire tract at one time. Mr. Harvey urged the applicant to supply the remaining necessary information as early as possible. Mr. Nord s#ated the EAW is currently being pursued. 81 .126 Motion was made by Rice, seconded by Antolik to continue and table further discussion , of the request until the additional information necessary has been submitted and reviewed by staff and recommendations from the other advisory bodies has been received. Roll call was taken on the motion. Ayes: Unanimous Mr. Knutson stated that Mr. Zak and his attorney had informed him of their desire to .have Commission action tabled on their request until the next meeting. 8i .127 Motion was made by Anto) ik, seconded by Rice, to continue discussion and table action on the Zak`s request until the next meeting as requested by the applicant. Roll call was taken on the motion. Ayes.: Unanimous Mr. Rice questioned if the silo with the sign painted on it in AirLake Industrial Park conformed to the ordinance . He further stated removal of the old barn in the same location was a major improvement.. Mr. Rice questioned the parking of cars for sale on County Road 5 near the old Orchard Lake tavern . 4 Lakeville, Minnesota Planning Commission Meeting 2 July 1981 Mr. Harvey stated that Northwest Sand and Gravel was parking equipment for sale in view of the Interstate ar~d that he believed this is a violation'of their conditional use permit . .81.128 Action was made by Rice to adjourn the meeting.
