HomeMy WebLinkAbout09-17-81 Lakeville, P4innesota • Planning Commission Meeting 17 September 1981 Chairman Harvey called the meeting to order at 7:30 p.m. in the Lakeville City Cduncil Chambers. doll call of members was taken: Present: Antolik, Harvey, Johnson, Rice. Absent: Miller, Geisness. Also present: Sid Miller,-City Building Official; Roger Knutson, City Attorney; David Licht, City Planner. The Chairman Called for a review of the Planning Commission meeting minutes of 3 September 1981. .81.161 Motion was made by Antolik, seconded by Johnson to approve the Planning Commission meeting minutes of 3 September 1981. Roll call was taken on the motion. Ayes: Antolik, Johnson, Harvey. Abstain: Rice Mr. Geisness arrived at the meeting at 7:35 p.m. The Chairman opened the public hearing on the application of Bernard and Elizabeth Murphy to rezone property from R-A, Single Family-Agricultural, to A-P, Agricultural • Preserve, located near Cedar Avenue. P1r. Knutson attested to the validity of the hearing. He also advised-that the three requests for .rezoning to Agricultura] Preserve could be considered simultaneously. The Chairman opened the public. hearing on the application of Robert J. and Elayne Donnelly to rezone property from R-A, Single Family-Agricultural, to A-P, Agricultural Preserve, located near Cedar Avenue, and the public hearing on the application of Paul F. Thomas to rezone property from R-A, Single Family-Agricultural, to A-P, Agricultural Preserve, located near Cedar Avenue. P9r. Knutson attested to the validity of the hearings. Mr. Harvey questioned if there was anyone in the audience wanting to speak on the .matter or if the staff had additional comment. Mr. Licht stated he only wished. to re-emphasize .that the applicants fully understand the restrictions which will be placed on their properties. Mr. Knutson outlined the procedures and restrictions of the Agricultural Preserve District. He further stated that the A.P, zoning would make it more difficult for the properties in question to be selected as ash disposal sites, but that there was no guarantee the rezoning would prevent it. The Chairman read a letter from Commissioner Puller stating his en- dorsement of the rezoning. The Chairman directed that Mr. Miller's letter be entered in the record. !1.162 Motion was made by Rice, seconded by Antolik to close the three public hearings. Roll call was taken on the motion. Thomas to rezone property from R-A, Single Family-Agricultural, to A-P, Agricultural. Preserve, located near Cedar Avenue. Roll .call was taken on the motion, Ayes: Unanimous The applicants were advised that their request will be considered by the City • Council at their 21 September meeting. The applicants indicated that they had. a meeting conflict due to a hearing on the disposal sites the same evening. Chairman Harvey opened the public hearing on the application of Northland Mortgage Company fora variance from the City ordinance for the length of a cul-de-sac street in the proposed Foxborough Second Addition located west of Cedar Avenue. Mr. Knutson stated the hearing notice had been properly handled. Mr. Ken Carlson of Northland Rlortgage introduced Mr. Peter Molinaro of Suburban Engineering who outlined the reasons for the variance request. He and Mr. Carlson stated agreement with the City Planner's report dated 14 September, but requested that the exact lengths of the variances be generalized rather than specific as measurements could change with the final grading and plat plans. Mr. Licht stated his agreement with the applicant's request. Mr. Antolik further questioned the need for the cul-de-sac variance to which Mr. Licht responded. Mr. Licht stated he had also received a call that day from the property owner to the north, questioning road alignments and drainage plans. Mr. Licht indicated he explained the plans and the neighboring owner indicated his acceptance. 81.166 Motion was made by Antolik, seconded by Rice to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous The Chairman reopened the continued public hearing on the request for preliminary plat. approval by Northland P+lortgage for the Foxborough Second Addition. Mrs Harvey stated the Park Committee had requested a relocation of the westerly access into the • park. The applicant stated their agreement with the request :and their willingness to make the change. 2 Lakeville, Minnesota • Planning Commission Meeting 17 September 1981 81.167 Motion was made by Rice, seconded by Geisness to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous 81.168. .Motion was made by Johnson, seconded by Harvey to recommend to the City Council approval of the application of Northland Mortgage Company fora variance from the City ordinance for the length of a cul-de-sac street in the proposed Foxborough Second Addition located west of Cedar Avenue. Ayes: Unanimous 81.169 Motion was made by Rice, seconded by Johnson to recommend to the City Council apprdva7 of the application by Northland Mortgage .Company fora preliminary plat of the Foxborough Second Addition subject to the moving of the westerly park access in compliance with the Park and Recreation Committee's recommendation and compliance with the recommendations as outlined in the City Planner's report dated 14 September 1981. Roll call was taken on the motion. Ayes: Unanimous The Chairman opened the public hearing on the City of Lakeville's application to • amend the Zoning Ordinance, Section 11.4, Building. Types and Construction. Mr. Knutson attested to the legality of the hearing. Mr. Harvey stated his opposition to metal pole buildings such as the one recently constructed at 210th Street and Dodd. Mr. Antolik indicated his agreement. Mr. Miller and Mr. Geisness questioned why such farm related buildings should not be allowed. Mr. Miller stated he had reviewed the amendment drafted by the City Planner with a State Building Code. Consultant and had been advised that the restriction on building type was illegal as it exceeds the Uniform Building Code. P1r. Knutson stated that a State Supreme Court decision ruled that the State Code could not be exceeded, but that the issue is whether this is a zoning or building matter and that the matter is not precise. Mr. Miller stated that architectural standards such as requiring brick building fronts is acceptable. Mr. Antolik stated that. the Interstate Corridor should be protected. The Commission then discussed various types of buildings and their construction. The Commission concluded the staff should draft additional amendment options for the Commission to consider. 81.170 Motion was made by Johnson, seconded by Rice to continue the public hearing. Roll call was taken on the motion. Ayes:. Unanimous Mr. Licht advised the Commission that he had reviewed the preliminary Metropolitan Council staff report on the revised Comprehensive Plan .and that .approval of the Plan is now being recommended. • 3 Lakeville, Minnesota Planning Commission Meeting 17 September 1981 Mr. Harvey advised the Commission of a carbon copy letter he had received from the Renaissance Festival Attorney to P1r. Charles Dayton which expressed a willingness of the Festival Representatives to meet with Mr. Dayton to discuss and attempt to resolve issues. Mr. Antolik and Mr. Harvey discussed a housing seminar which they attended on 16 September .along with Mrs. Sindt and Mrs. Enright. 81.171 Motion was made by Rice, seconded by Antolik to adjourn the meeting. However, I have noted the requests by Bernard Murphy, Elizabeth Murphy, Paul Thomas, and Robert & Elayne Donnelly to have their property rezoned from R.A.. Single Family-Agricultural to Agricultural Reserve. I have also reviewed the September 10th Memorandum submitted by Northwest Associated Consultants, Inc., and the relevant attachments thereto. Based upon this information, and on my firm belief that agricultural property owners should be able to protect their agricultural interests, I recommend approval of the requests.
