Planning Commission Fleeting
5 November 1981
Chairman Patrick Harvey called the Lakeville Planning Commission meeting to
order at 7:30 p.m. in the Lakeville City Council Chambers..
Roll call of members was taken: present:. Geisness, Harvey, Miller, Rice,
Absent: Antolik, Johnson.
Also present: Sid Miller, Gity Building Official; Roger Knutson, City Attorney;
David Licht, City Planner.
The Chairman called fora review of the minutes from the meeting of 15 October
1981. Mr. Harvey noted a typographical error in the second to the last sentence
in the paragraph following motion 81.173. The last word should be difficulty.
81.179 Motion was made by Rice, seconded by Miller to approve the 15 October 1981
Planning Commission meeting minutes as corrected.
Roll call was taken on the motion. Ayes: .Harvey, Miller, Rice.. Abstain: Geisness.
The Chairman opened the public hearing on the application of Edward Atcas to
rezone the property of the existing Skelly Station at the southeast corner of
Cedar Avenue and 167th Street to B-3, Auto-Oriented District. Mr. Knutson
attested to the validity of the meeting and proper notices given. The Chairman
• asked if a representative of the applicant was present. No response was received.
P~1r. Don Horejsi, a resident on 176th Street, appeared and .stated the station had
generated rubbish on the site and in the neighborhood and a general clean-up was
necessary. He also stated dumping had been occurring on the station site. The
area residents would like the on-site problems corrected and a good operation
would be welcomed. Mary Laffernzen questioned what would be the hours of operation.
Sid P1iller stated the City had received three complaints on the storage and
dumping of tires and that the City had enforced clean-up. Pat Franice, resident
along 167th Street, stated there are more problems now, Mary Laffernzen stated
a higher fence was needed as tires have been dumped over the fence. Peg Ersfeld
reiterated the tire problem and garbage in the creek. Bruce Laffernzen asked if
there was a safety problem. P1r. Geisness questioned who could request a fire
inspection. Sid Miller indicated anyone could request.
81.180 P1otion was made by Rice, .seconded by Harvey, to close the public hearing,
Roll call was taken on the motion. Ayes: Unanimous.
Mr. Geisness stated the safety and garbage issues should be addressed and that
the application being sought was a possible leverage point. P1r. Knutson and.
Mr. Licht indicated the station was a legal non-conforming use. and that it could
be operated without the rezoning or variance being pursued. Commissioner Miller
asked why the applicant was not at the hearing. Mr. Geisness questioned who was
responsible for the property. Sid Miller stated that he believed that it was
a company owned station. Mr. Harvey and Mr. Licht stated that an appropriate
• action would be to table the matter until the next meeting.

81.181 Motion was made by Rice, Seconded by Hiller, to reopen the public hearing.
Roll call was taken on the motion. Ayes: Unanimous
81.182 Motion was made by Rice, seconded by f1iller, to table discussion of the application
by Mr. Atcas until the 19 November 1981 meeting and to request that f1r. Atcas be
present.

Chairman Harvey opened the discussion with Gary Tholkes of the flenasha Corporation
about the feasibility of establishing a day care center in the Airlake Industrial
Park. f1r. Tholkes explained a need existed for working couples to have facilities
in close proximity to care for their children. Mr. Geisness stated his favorable
reaction to such facilities. Mr. Licht stated the City should proceed cautiously
as introduction of such operations in industrial areas was a major change in policy.
Questions of health and safety would be generated by such activities. fir. Rice
stated he also questioned such operations in the industrial area. f1r. Geisness
stated such operations were common in industrial and commercial areas and did
not see why it shouldn't be automatically permitted. Commissioner Miller stated
approval of numerous agencies would be required,.so assurance of protection
would exist. Cindy Young appeared and said the State Department of Public Welfare
provides thorough regulations. •
81.183 Motion was made by Geisness, seconded by Miller, to establish a public hearing
on 3 December 1981 to consider a zoning ordinance text amendment to allow
day care facilities as a permitted use in the commercial and industrial zoning
districts of the City.
.Roll .call was taken on the motion. Ayes: Miller, Geisness. Nays: Harvey, Rice.
~1r. Rice and Mr. Harvey stated their objection to the motion was to consider
such facilities as permitted rather than conditional uses.
81.184 Motion was made by Geisness, seconded by Harvey, to establish a public hearing
on 3 December 1981 to consider a zoning ordinance text amendment to allow day
care facilities as a conditional use in the commercial and industrial zoning
districts of the City.
Roll call was taken on the motion. Ayes: Unanimous
Chairman Harvey recognized P1r. Jerome Schweim who appeared before the Commission
indicating his interest to establish a garden center retail operation without
poor storage at 162nd Street and the freeway. Mr. Schweim was present to gain
a determination on the acceptability of the idea. f1r. Rice stated he had no
problem with the proposed use. f1r. Geisness asked if a market study had been
prepared to which the response was no. Commissioner Miller stated he saw no

problems with the proposed use. The City staff indicated that appropriate
applications and information should be filed with the City and if received
within the next week, a hearing on the matter could occur at the 3 December
Commission meeting.
Under other business, F9r. Geisness questioned the park at 162nd and Jamaica
and the long range plans for parks in the City. He stated he would like to
see jogging trails and other such facilities provided. Ne suggested a liaison
committee be established between the Park Committee and the Commission. Mr.
Rice noted that the Park Committee currently has two vacancies which limits
its operation.
Mr. Licht advised the Commission of Mr. Kriz's inspection of the parking area
at the Power Center and his conclusion that the area should be left. to settle
over the winter prior to .having blacktop applied. Mr. Knutson stated he had
been in contact with F~1r. Nord requesting verification of actions required by
the conditional use permit. The Commission concurred that a completion schedule
in writing should be established. Commissioner Fliller requested that he be
carbon copied on correspondence relative to this matter.
The Commission entered into a discussion of sign violations in the City. The
Leo°s Kawazaki wall sign and the Airlake "Silo" were noted. Staff indicated
• that they would review these matters and report back to the Commission.. The
Commission generally agreed the sign ordinance should be enforced or corrected
to cover what is considered acceptable.
Mr. Rice indicated he would be absent due to business from the 19 November
Commission meeting. Commissioners Geisness and Fliller also stated their probable
absence from the meeting. The Chairman requested that the members confirm their
absence or attendance in advance of the next meeting, as the ability to have a
quorum was questionable.
81.185 P1otion was made by Rice to adjourn the meeting.

The Chairman adjourned the meeting at 9:50 p.m.
