..Planning Commission Meeting
3 December 1981
Chairman Patrick Harvey called the meeting to order at 7:30 p.m. in the Lakeville
City Council Chambers.
Ra11 call of members was taken: Present: Geisness, Antolik, Harvey, Johnson,
Grohoski, Rice. Absent: Miller
Also Present: .Council persons Zaun and Enright; Roger Knutson, City Attorney;
Sid Miller, City Building Official; David Licht, City Planner.
The Chairman called fora review of the minutes of the 19 November Commission
meeting.
81.195 Motion was made by Grohoski, seconded by Antolik to approve the Planning
Commission meeting minutes for 19 November 1981.
Roll call was taken on the motion. Ayes: Geisness, Antolik, Harvey, Grohoski,
Johnson. Abstain: Rice.
The Chairman reopened the continued public hearing on the application of Edward
Atcas for rezoning of the existing Skelly Station property at the southwest corner
of 167th Street and Cedar Avenue from R-2, Single Family, to 6-3, Auto-.Oriented
District. Mr. Licht advised the Commission that the applicant had notified the
• City on his desire to withdraw his request due to the property in question being
sold to another party. Mr. Licht also stated that the applicant had. contacted
him and questioned whether the new owner could continue the rezoning action now
before the Commission. Mr. Knutson stated the public notice had specifically
referenced the applicant and that a renotice would be required. The Commissioners
also expressed an interest in renotifying the area residents should action be
continued..
81.196 Motion was made by Rice, seconded by Grohoski to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous
81.197 Motion was made by Rice, seconded by Antolik to recommend to the City Council the
denial of the application of Edward Atcas for rezoning of the existing Skelly
Station property at the southwest corner of 167th Street and Cedar Avenue from
R-2, Single Family, to B-3, Auto-Oriented District based upon his withdrawing
his request and due to his lack of interest in the property.
Roll call was taken an the motion. Ayes: Unanimous
Chairman Harvey opened the public hearing on the application of John A. Campbell
fora conditional use permit to build a garage at 17950 Italy Avenue providing
aver 1,000 square feet of space. Mr. Knutson. attested to the validity of the
hearing and proper notices being made. The applicant was present and appeared
before the Commission. Per. Geisness questioned whether the neighborhood was
aware of the pi ans. No one appeared, but ~1r. Campbell indicated that he had
• shown adjoining owners the proposed plans.. Mr. Rice noted park property is
adjoining. Mr. Geisness questions streets and service in the area. The

applicant noted that it had been requested that the City not plow the street
in question. Mr. Geisness further questioned what standards were used to judge
such uses. Mr. Licht indicated the City°s typical policy was to prohibit
home occupations. P+Ir. Geisness stated his concern for color of the structures
and that a precedent was being set. Mr. Harvey noted the large size of the lot.
81.198 Motion was made by Rice, seconded by Grohoski to close the public hearing.
Roll call was taken on the motion. Ayes: Unanimous
81.199 Motion was made by Rice, seconded by Antolik to recommend to the .City Council
approval of the application of John A. Campbell fora conditional use permit
- to build a garage at 17950 Italy .Avenue providing over 1,000 square feet of
space, contingent upon no home occupation being conducted in the structure and
recommending that the exterior of the garage be the same as the house.
Ro11 call was taken on the motion. Ayes: Unanimous
Chairman Harvey opened the public hearing on the application of the City of
Lakeville to amend the Zoning Ordinance to allow children's day-care facilities
within corr~nercial and industrial zoning districts. Mr. Knutson stated valid
notice had been provided. Mr. Licht advised the Commission that thorough study
• was needed of the amendment and that possibly more restrictions were needed.
He recommended that the Commission table discussion until the next meeting.
Cindy Young appeared and stated that other communities such as New Hope, allowed
day-care in industrial areas.
81.200 Motion was made by Grohoski, seconded by Rice to continue the public hearing.
.Roll call was taken on the motion. Ayes: Unanimous
Mr. Licht reported to the Commission that the staff had checked the compliance
of a nurnber of signs which the Commission had questioned. The AirLake °'silo"
sign appears to be within ordinance limits. The Kawasaki sign painted on the
west of the building is, however, in violation. Mr. Licht stated that if the
Commission wished to look further into City signs and the Sign Ordinance, that
possibly a subcommittee should be appointed. After some discussion, it was
concluded that the individual Commissioners .could review the ordinance and
draft possible changes they may wish to suggest.
The Commissioners noted a number of questionable signs including the Acorn
Lodge Motel and a portable sign at the Skelly Station. Also, it was pointed
out that the bus which is stored at the Lumber Jack Shop does not ha~re current
license plates.

Mr. Jerome Schweim appeared and questioned why his application was not being
considered at this meeting. Sid Miller noted the information had been submitted
late and was now scheduled for the 17 December 1981 meeting..
81.201 Motion was made by Rice, seconded by Antolik to adjourn the meeting.
.Voice vote was taken on the motion. Ayes: Unanimous
The Chairman adjourned the meeting at 9:15 p.m.
