ORDINANCE NO. 5 i z
AN ORDINANCE AMENDING ORDINANCE NO. 167, THE LAKEVILLE ZONING
ORDINANCE TO RESPOND TO VARIOIIS GROWTH MANAGEI~NT DIRECTIVES.
THE CITY COUNCIL OF THE CITY OF LAREVILLE, MINNESOTA DOES HEREBY
ORDAIN:
Sectioa 1. Ordinance No. 167, Section 2.2 (Definitions) is
amended to add the following:
19A) Buffer. The use of land, topography, difference in
.elevation, space, fences or landscape plantings to screen
or partially screen-a use. or property from another use or
property or to shield or mitigate noise, lights or other
impacts.
19B) Buffer Yard. A strip of land utilized to screen or
partially screen a use or property from another use or
property or to shield. or mitigate noise, lights, or other
impacts.
89A) Lot Area, Minimum (Lots of Record. and Preliminary Platted
Lots Havinq Leaal Standing Established On 1 January
1994 Except as may be otherwise required by this
Ordinance, .the area of a horizontal plane within. the lot
lines.
89B) Lot Area, Minimum (Lots of Record Established After 1
.January 1994). Except as may be otherwise.. expressly
allowed in this Ordinance, the area of a horizontal plane
within the .lot lines excluding major drainageways, as
defined by the Comprehensive Storm Drainage Plan,
.wetlands,. waterbodies, road rights-of-way, required
buffer strips, regional utility/pipeline easements, and
slopes steeper than .three to one (3:1).
Sectioa 2. Ordinance No. 167, Section 2.2.102 (Definitions)
is amended to read as follows:
102) Lot, Width. For lots of record and preliminary .platted
lots having .legal standing on 1 January 1994, lot width
shall mean the minimum required horizontal distance
between the side lot lines measured at right angles to
the lot depth, at the front setback line. For cul-de-sac
lots of record created after 1 January 1994, lot width
shall mean the minimum required horizontal distance
between the side lot lines, measured along a-straight
line at the midpoint of the front setback line.
Sectioa 3. Ordinance No. 167, Section 9.5 (Drainage Plans) is
hereby amended to add_the following:
6) All residential., commercial, industrial, and
institutional .developments satisfy. the provisions of
Section 10-4-6 of .the. Subdivision Ordinance in regard to
storm .water management.
Section 4. Ordinance No. 167, Section 9.7.3)f (Landscaping
Requirements) is amended to. read as follows:
f) Tree Preservation. Prior to the issuance of :building
permits for all new and/or expanded multiple family
residential, commercial, industrial, and institutional
uses, a tree preservation plan shall be submitted. The
plan and its implementation shall be in accordance with
the City's adopted tree preservation guidelines and
requirements as outlined in the City's Subdivision
.Ordinance and shall be subject to the review and approval
of the City Engineer and Zoning Administrator. The
Zoning Administrator may exempt an applicant from thee.
submission of a tree preservation plan upon demonstration
that such aplan is not considered .relevant to the site
in question.
Section 5. Ordinance No. 167, Section 9.7 (Landscaping
Requirements) is amended to add the following:
5) Buffer Yards.
a) Lot Depth Requirements.' Double frontage
:residential lots shall have an additional depth of
at least twenty (20) feet in order to allow space-
for buffering/screen planting. along the back. lot
line. Except as may be approved by the City
Council, for those lots which abut major collector
or arterial streets, the following minimum lot
.depths shall be required:

b) -Lot Width Rec,~uirements. Except as may be approved
by the City. Council and except for lots of record
and preliminary platted lots having legal standing
established. on 1 January 1994, lots. which border
:major collector or arterial streets on a side yard
shall be increased at least ten (10) feet in
required minimum lot .width. for the .purpose of
- establishing buffers along the lot line bordering
such streets.
c) Screening Plan Required. For applicable
subdivisions, a comprehensive screening plan shall
be submitted. The plan shall identify all proposed
buffer screening in both plan and sectional view.
d) Timing/Responsibility of Installation . Weather
permitting, all buffer,. bermings, and/or plantings
...shall be constructed or planted prior to the
issuance of an occupancy: permit.
e) Maintenance.
1) Maintenance of the buffer strip planting
and/or fence shall be the responsibility of
the individual property owners or if
applicable, the homeowners association
2) Color of the screening wall or fence shall be
uniform along its entire length and shall not
be modified without City approval.
3) All repairs to the fence or wall shall be
consistent with the original fence design in
regard.. to location and appearance.
4) Replacement of .landscape materials or
plantings in a screen area shall be consistent
-with the original screen design.
5) All repair or plant replacement shall be done
within forty-five (45) days of written
notification from the City or if applicable,
.the homeowners association.
f) Design .Standards.
1) Plantings. All plantings within designated
buffer yards shall adhere to the following:
a) Plant material centers shall not be
located closer than three (3) feet. from
the fence line or property line.

b) Landscape screen plant material shall be
planted in two (2) or more rows.
Plantings shall be staggered in rows
unless otherwise approved by the City
staff.
c) Where massing of plants or screening is
intended, deciduous shrubs shall not be
planted more than four (4) feet on
center, and/or evergreen shrubs shall not
be planted more. than three (3) feet on
center.
d) Landscape material sizes shall be
consistent with Section 9.7.3)a. of this
Ordinance.
e) Plantings suitable for buffering/
screening purposes include:

2) Walls and Fences. All walls and .fences
erected within designated buffer yards shall
adhere to the following:
a) At least fifty (50) percent of the street
.side of a screening. fence shall be
landscaped with plant materials. Plant
materials shall be at least. equal to the
fence height.
b) Exposed fences shall run a maximum length
of fifty (50) feet between landscaping
areas or clusters.
c) Fences and landscaping shall. not be
located within .the traffic visibility
triangle as defined in Section 9.8 of the
Lakeville Zoning Ordinance.
3) Earth Berms. Earth berms existing within
designated buffer yards:
a) Shall not exceed a three to one (3:1)
slope unless approved by the City
Engineer.
b) Shall. contain no less than four (4}
inches of topsoil.

Section 6. Ordinance No. 167, Section 11.6 (General Yard, Lot
Area, and Building Regulations) is amended to read as follows:
11.6 Minimum Floor Area Per Dwelling Unit.
1} Single Family Dwelling Units. Except as otherwise
specified in the zoning district provisions, or
except as allowed by conditional use permit based
upon .justifiable cause, single family homes as
classified .below shall have the following minimum
floor areas per unit.
Two'Bedroom 960 square feet abovegrade
Three Bedroom 1,040 square feet above grade
2) Multiple Dwelling Units. Except as otherwise
specified in the zoning district provisions, or
except as allowed by conditional use permit based
upon justifiable cause, living units classified as
multiple dwelling (excepting elderly housngl sha21
have the following minimum floor. areas per unit:
Efficiency Units 500 .square feet
One Bedroom Units 700 squarefeet
Two. Bedroom Units 500. square .feet
.More than Two .Bedroom Units -
an additional 80 .square feet

3) Elderly (Senior Citizen) Housing. Except as
otherwise specified in he zoning district
provisions, or except as allowed by conditional use
permit based upon justifiable. cause, living units
classified as` elderly (senior citizen} housing
units .shall have the following minimum floor areas

4) Double Bungalows. Ouadraminiums and Townhouses.
Except as otherwise. specified in the zoning
district provisions, or except as allowed by
conditional use permit. based upon justifiable
cause, double bungalows, quadraminiums, and
townhouses, as classified below, shall have the
minimum floor area per one bedroom unit.

Section 8. Ordinance No. 167, Section 11.11, Sub-Paragraph 2

as follows:

City sewer or water systems are available:

Section 9. Ordinance No, 167, Section 11.12 (Minimum Lot
Area) is amended to read as follows:
11.12 Minimum Lot Area
1) Unsewered Lots.
a) The minimum single. family lot size is 'ten (10)
acres. This minimum lot size shall not` apply to
separate parcels of record in separate ownership
lawfully existing prior to 7 November 1977,
provided that it can be demonstrated by means
satisfactory-to the City that the smaller parcels
will not result in ground water, soil or other
contaminat-ion which may endanger the public health.
Habitable single family homes constructed prior to
7 November 1977 may. reduce their lot. size-to a
minimum of one acre or larger if .the property
divided off will result in a parcel of ten (101
acres or more if it can be demonstrated by means
satisfactory to the City that the division will-not
result. in ground water, soil or other contamination
which may endanger the public. health.
b) Apartments and multiple family dwellings are not
.allowable uses.
c) .Subject to the other provisions of the Zoning
Ordinance, other uses may be permitted by
.conditional use permit. The minimum. lot size for
each principal use is ten (10) acres. This minimum
lot size shall not apply to smaller separate
parcels of record in separate ownership lawfully
.existing prior to 7 November 1977,. provided the
conditions of the conditional use permit are met.
A conditional use permit shall not be granted
unless it can be demonstrated by means satisfactory
to the City .that the use (1) will not. result in
ground water, soil or other contamination which may
endanger. the public health, (2) will not increase
future City utility service demands and .expense,.
and (3) will not jeopardize public safety and
general welfare.
2) Exceptions for Lots of Record Created After 1 January
1994 (not including preliminary platted lots having legal
standing on 1 January 1994).

a) Steep Slopes. Subject to the approval of the .City
Council, lots containing .slopes steeper than three
to one (3:1) may be included in the 1of area
minimum provided that:
1) If applicable, flood control measures. are
implemented.
2) The construction will not .adversely affect
area storm water drainage.
3) Natural vegetation is protected and preserved
pursuant to applicable tree preservation
policies and regulations and shoreland zoning
district standards.
4) The structure conforms to the natural
limitations presented by topography and soil
so as to create the least potential of soil
erosion.
5) Appropriate measures are utilized to control
erosion subject to approval of the City
Engineer.
3 ) The minimum lot area shall not be required to be expanded
by more than one hundred (100) percent as a result of
excluding major drainageways, as defined by the
Comprehensive Storm Drainage Plan, wetlands, waterbodies,
road rights-of-way, required buffer strips, regional.
utility/pipeline easements, and slopes steeper than three
to one` (3:1) .
Section 10. Ordinance No. 167, .Section 11.13.4 (Single Family
Dwelling Requirements). is amended to read as follows:
4) Receive a Building Permit. The application for a
single family building permit, in addition to other
information required on previously undeveloped
property, shall indicate the height, size, design
and .the appearance of all elevations of the
proposed building, a description. of the
construction materials proposed to be used, and the
delineation of future deck, porch and/or garage
.additions whether or not such construction is
intended. The exterior architectural design of a
proposed dwelling may not. be so atvariance with,
nor so similar to, the exterior architectural
design of any structure or structures already
constructed or in the course of construction in the
.immediate neighborhood, nor so at variance with the

character of the surrounding neighborhood as to
cause a significant depreciation in the property..
values of .the neighborhood or adversely affect the
public health, safety or general welfare.
Section il. Ordinance No, 167, Section 12.3 (Off-Street
Parking. Requirements} is amended to read as follows:
12.3 Site Plan Drawing .Necessary. All applications for a
single family building permits in all zoning. districts
shall. be .accompanied by a site plan drawn to scale and
dimensioned indicating the location of off-street parking
and_loadng spaces in compliance. with the requirements
set forth in this Section. For lots of record
.established after 1-January 1994, all site plans for
single:.family homes shall provide for location of a three
(3) stall. attached garage, whether or not construction is
intended. For lots of record. and preliminary platted
lots having legal standing .established on 1 January 1994.,
all site plans-for singlefamily homes shall provide for
location of a two (2) stall garage, whether or not
construction is intended.
Section 12. Ordinance No. 167, Section 12.4.8.a (Off-Street
Parking Requirements) is amended to read as follows:.
a) Parking Space Size. Each parkingapace shall
be not less than nine (91 feet wide and twenty
(2.01.. feet in length, exclusive of 'access
aisles, 'and each space shall be served
adequately be access aisles.
Section 13. Ordinance No. 167, Section 12.4.8.q (Off.-Street
Parking Requirements? is amended to add the following:
q)- Compact Car Spaces. Up to twenty (20) percent
of the. parking. spaces in a parkinglot may be
permanently marked for compact cars only
..provided that:
1. The parking lot. contains .forty (40) or
more off-street parking spaces.
2 . All compact .car spaces are a minimum of
eight (8) feet in width and sixteen (16)
feet in length.

3. Signs and markings, as approved by the
City, are placed-and maintained in each
compact car space.
4. All required off-street parking aisle
widths are maintained.
5. The compact car stalls not displace
preferred handicap parking stall
locations.
6. The design, layout, and location of
designated compact car spaces shall not
encourage utilization by oversized
vehicles and shall be subject to City
approval.
r) Lot Access. Individual lot access serving
single family, two family, townhome,
quadraminium, and manor home dwellings
directly onto major collector or arterial
streets,. as defined by the Lakeville
Comprehensive Transportation Plan;. shall be
prohibited, unless approved by the City
Engineer.
Section 14. Ordinance No, 16.7, Section 12.8 (1) (Off-Street
Parking Requirements). is amended to read as follows:
1) Single Family and .Two Family Dwellings. Two (2)
spaces per unit.
..Section 15. Ordinance No. 167, Section 12.8 (3) (Off.-Street
Parking Requirements) is amended to read as follows:
3) Townhomes, Ouadraminiums, .Manor Homes. Multiple
Family Dwellings, and Mobile Homes Within Mobile
.Home Parks. At least two and one-half (2.5) rent-
free spaces per uni In projects involving eight
(8) or more units, the City may require additional
clustered guest. parking spaces. based upon
calculation of required demand.
Section 16. Ordinance No. 1.67, Section 25.5 (R-A Lot/Setback
Requirements) is hereby amended to read as follows:

forth in this Ordinance.

a) There is no reduction in minimum lot area ar
minimum lot width.
b)`, In areas qualifying :.for cul-de-aacs which are
judged as being located within environmentally
sensitive areas, a five (5) foot reduction: in front
yard setbacks may be allowed on such streets.
Except as may be specifically approved by the City
Council, front yard setback reductions shall occur
on no more than one (1) of two (2) lots paralleling
and fronting each other on the same street. In
