HomeMy WebLinkAbout00-108 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION Date May 15, 2000 Resolution 2000-108 Motion By Johnson Seconded By Mulvihill RESOLUTION AUTHORIZING TRANSFER OF CERTAIN REAL PROPERTY TO THE HOUSING AND REDEVELOPMENT AUTHORITY IN AND FOR THE CITY OF LAKEVILLE WHEREAS, the City is the owner of the following described real property: All those parts of Lots 5 and 6 in Block 3; Lots 1 througk 5 in Block 6; the vacated street adjoining said Block 3 and Block 6, all in FAIRFIELD, Dakota County, Minnesota, according to the recorded plat thereof, described as follows: • Beginning at the northwest corner of said Lot 5 of Block 6; thence North 89 degrees 20 minutes 00 seconds East, assumed bearing, along the north line of said Lot 5 of Block 6 to the northeast corner of said Lot 5 of Block 6; thence South along the east line of said Lot 5 of Block 6 a distance of 50.00 feet; thence South 89 degrees 20 minutes 00 seconds West a distance of 13.51 feet; thence South a distance of 327.21 feet; thence South 89 degrees 46 minutes 23 seconds West a distance of 136.48 feet to the. west line of said Block 3; thence North along the west line of said Block 3 and Block 6 a distance of 376.16 feet to the point of beginning. Tax Parcel ID Nos. 22-44450-050-06; 22-44450-040-06 and part of 22-44450-010-03, ("Subject Property"); and ` WHEREAS, the Subject Property is the former site of the All Saints parochial .school facility which was conveyed to the City by All Saints Catholic Church on December 2, 1999 in connection with the Arts Center Project; and WHEREAS, pursuant to the December 13, 1999 Memorandum of Understanding ("Memorandum of Understanding"), between the City, the Housing and Redevelopment Authority in and for the City of Lakeville ("HRA") and Independent School DistrictNo. 194. ("ISD 194") the HRA is to own the Subject Property and lease it to ISD194 pursuant to the terms of a Lease Purchase Agreement; and 1 WHEREAS, with the specific exception of reserving permanent public drainage and utility easements over a portion of the Subject Property described as follows: A 15.00 foot wide public drainage and utility easement over, under, and across that part of the following described parcel: All those parts of Lots 5 and 6 in Block 3; Lots 1 through 5 in Block 6; the vacated street adjoining said Block 3 and Block 6, all in FAIRFIELD, Dakota County, Minnesota,. according to the recorded plat thereof, described as follows: Beginning at the northwest corner of said Lot 5 of Block 6; thence North 89 degrees 20 minutes 00 seconds East, assumed bearing, along the north line of said Lot 5 of Block 6 to the northeast corner of said Lot 5 of Block 6; thence South along the east line of said Lot 5 of Block 6 a distance of 50.00 feet; thence South 89 degrees 20 minutes 00 seconds West a distance of 13.51 feet; thence South a distance of 327.21 feet; thence South 89 degrees 46 minutes 23 seconds West a distance of 136.48 feet to the west line of said Block 3; thence North along the west line of said Block 3 and Block 6 a distance of 376.16 feet to the point of beginning. The center line of said 15 foot wide easement is described as follows: Commencing at the southwest corner of said Parcel; thence North 89 degrees 46 minutes 23 seconds East, assumed bearing, along the south line of said Parcel a distance of 96.48 feet to the point of beginning of said centerline to be described; thence North 20 degrees 25 minutes 55 seconds East a distance of 114.58 feet to the east line of said Parcel, and said center line there terminating. The. side lines of said easement are to be prolonged or shortened to terminate at the south line and the east line of said Parcel A 5.00 foot wide public drainage and utility easement over, under, and across all those parts adjoining the west boundary line of Lots 1 through 5 in Block 6; and the vacated street adjoining Block 3 and Block 6, all in FAIRFIELD, Dakota County, Minnesota, according to the recorded plat thereof. maintaining .ownership of the Subject Property by the City would not serve the public interest; and WHEREAS, the proposed transfer of the Subject Property has no relationship to the City's Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville: 1. The requirements of Minn. Stat. § 462.356 are hereby dispensed with as the same relate to the transfer of the Subject Property from the City to the HRA, pursuant to the Memorandum of Understanding. • 2 2. The Mayor and City Clerk are hereby authorized to execute and deliver a Warranty • Deed from the City to the HRA covering the Subject Property, said Warranty Deed to specifically reserve unto the City the permanent public drainage and utility easements over a portion of the Subject Property as more particularly described above.
