HomeMy WebLinkAboutItem 06.qJune 2, 2011 Proposed Action Overview Primary Issues to Consider Supporting Information Human Re urces Manager Resolution Approving Salaries For Seasonal Employees and Instructors Item No. Staff recommends adoption of the following motion: Move to approve the Resolution Approving Salaries for Seasonal Employees and Instructors Passage of this motion will change the classification of certain independent contractors to employees. The Arts Center has previously engaged the services of individuals by executing contracts with them to perform functions such as lighting and sound, class instruction, and community theatre performances. The City, along with the IRS, has reviewed the status of these positions using IRS guidelines and has determined that these individuals should be considered employees — not independent contractors. The resolution establishes these positions as seasonal employees pursuant to IRS rules and regulations. • What guidelines determine independent contractor vs, employee? �► What impact will this change have on Arts Center programs? • What are the costs attributed to the change? 4. The rules and regulations regarding "Employee or Independent Contractor" are defined in IRS Publication 15 -A. The final decision on classification of the positions is based on the IRS directives. What impact will this change have on the Arts Center Programs? There are no significant cost increases to the Arts Center or the fees charged to the customer. What are the costs attributed to the changes? The rates have been adjusted so that there will not be a significant cost increase to the City or the net pay of the empioyee.
