JUNE 19, 2006
Mayor Johnson called. the meeting to order at 7:00 p.m. The pledge of
allegiance to the flag was given.
Roll call was taken. Present: Council Members Bellows, Wulff, Rieb,
Luick and Mayor. Johnson.
Also present:. R. Knutson, City Attorney; S. Mielke, City Administrator; D.
Olson, Community & Economic Development Director; D. Morey, Planning
Director; D. Feller, Finance Director; T. Vonhof, Police Captain; B.
Anderson, Assistant to City Administrator; C. Friedges, City Clerk.
MINUTES
The minutes of the June 5, 2006 City Council meeting and the May 22"a
and June 12th Council. work sessions were approved as presented.
SPOTLIGHT ON BUSINESS
Economic Development Commission member Barry Pogatchnik presented
information on Lakeville Super Target and introduced Store Team Leader
David Klein.

On behalf of the Police Department's crime prevention program, Captain
Vonhof asked the City Council to proclaim August 1, 2006 National Night
Out in Lakeville. Council Member Wulff read the proclamation.
CITIZENS' COMMENTS
Joe Blee, .161.35 Hawthorn Path, expressed a concern regarding .the
significant amount of traffic in his neighborhood and asked the City
Council to consider installing a three way stop at Harvard Lane and
Hawthorn Path in the area of County Road 46 (160th Street). Mayor
Johnson referred the request to the Police and Operations & Maintenance
Departments.
CONSENT AGENDA
06.41 Motion was made and seconded to approve the consent agenda items as
follows:
a. Claims for payment.
b. May Investment Report.
c. Receive minutes of the June 1, 2006 Planning Commission
meeting.
d. Resolution No. 06-73 amending. the 2006 Equipment Fund Budget.

ITEM 9
Mayor Johnson opened the public hearing on the renewal of on-sale
liquor, club liquor, Sunday liquor, wine and 3:2% malt liquor licenses. The
City Clerk attested to legal notice publication.
Sergeant Knutson presented the staff report on the liquor license renewals
and recommended renewal of ali .licenses effective July 1, 2006 through
June 30, 2007. He indicated that the on-sale liquor license for Teresa's

Mexican Restaurant and the club liquor license for VFW Post 210 should
be approved contingent.. upon receipt of a certificate of liquor liability.
insurance prior to July 1, 2006.
There were no comments from the Council members or members of the
audience.
06.42 Motion was made and seconded to close the public hearing on the
renewal of on-sale liquor, club liquor, Sunday liquor, wine and 3.2% malt
liquor licenses.
Roll call was taken on the motion. Ayes, unanimous.
06.43 Motion was made and seconded to renew the following licenses for the
..period of July 1, 2006 through June 30, 2007.

ITEM 10
Mayor .Johnson opened the public hearing on the application of
Papagayos, lnc. for an on-sale 3.2% malt liquor license and a wine license
at Papagayos, 7704 - 160t" Street West. The City. Clerk attested to legal
notice publication.
The applicant, Ms. Kelly Santana, requested Council approval of a wine
and 3.2 malt liquor license for her Mexican restaurant. She stated she
plans to open the restaurant in early July. '
Sergeant Knutson presented the staff report and recommended approval
of the wine and 3.2 malt liquor licenses as requested.
There-were no comments from the Council members or members of the
audience.
06.44 Motion was made and seconded to close the public hearing on the
application of Papagayos for an on-sale 3.2 malt liquor and wine license.
Roll call. was taken on the motion. Ayes, unanimous.
06.45 Motion was made and seconded to grant an on-sale 3.2 malt liquor license
and a wine license to Papagayos, 7704 - 160t" Street West, effective July
1, 2006 through. June 30, 2007.

ITEM 11
Don Uram, representing Insignia Development, requested Council
approval of the. Tullamore preliminary plat.
Planning Director Daryl. Morey presented the .planning report for
Tullamore. The preliminary plat, he stated, consists of 148 single family
residential lots and one outlot on 81.03 acres of land located in the
northwest quadrant of Pilot Knob Road and 170t" Street.. The preliminary
plat is in compliance with the Comprehensive Plan, Zoning Ordinance and
Subdivision Ordinance requirements. The Planning Commission
recommended the preliminary plat be revised to include an eight foot wide
pedestrian trail connection between the northerly and southerly portions of
the plat. The developer has submitted revised plans as recommended.

06.46 Motion was made and seconded to approve the Tullamore preliminary
plat.
Roll-call was taken on the motion. Ayes, unanimous.
ITEM 12
Pastor. Jamie Thompson requested Council approval- of the preliminary
and final plat of Lord of Life Lutheran Church and a conditional use. permit
to allow .the construction of a church in the RS-3 District... Pastor
Thompson asked the City Council to consider their request to delay the
construction of a five foot wide concrete sidewalk from the front of the
church building to the sidewalk being constructed on the east side of Dodd
Lane to a future phase. He indicated that. the sidewalk may interfere with
future construction and ultimately need to be removed. He also stated they
do not anticipate immediate significant pedestrian traffic, and construction
of the sidewalk with the first phase will have a significant impact on their
construction budget. He also listed examples of other churches that do
not have a pedestrian sidewalk from the bike path to the front door.
Planning Director Daryl Morey presented the planning report for Lord of
Life Lutheran Church. The property is located south of Dodd Boulevard,
east of the future extended Dodd Lane and west of Pilot Knob Road. He
explained that the Planning Commission expressed overall support of the
preliminary and final plat and conditional use permit; however, three of the
six Planning Commission members .present.. at the public hearing felt that
the church should be given more flexibility as to when the sidewalk would
be constructed.
Mr. Morey explained that church officials have submitted a revised site
plan to address on-site traffic circulation as recommended by the Planning
Commission and staff. The zoning ordinance requires the construction of
an internal sidewalk for pedestrian circulation. The sidewalk, as shown on
the site plan, is located off of the main .drive isle.
Council Member Luick suggested relocating the sidewalk to the south side
of the property, as he feels most of the pedestrian traffic will come from
the south. He stated he is uncomfortable with eliminating the sidewalk
completely.
Council Member Bellows stated Pastor Thompson has made a good point
with respect to the precedence issue.

Mayor Johnson stated. he feels a decision regarding the. timing and
placement of an internal sidewalk should be made at the property owner's
discretion.
Mr. Morey explained that the policy regarding construction of internal
sidewalks changed a few years ago. He stated Lord of Life Lutheran
Church will be very much a part of the residential neighborhoods
surrounding. it. Because internal sidewalks will be constructed within
those surrounding developments, it makes good planning sense to tie this
property into that sidewalk system.
Council Member Rieb stated that because there will be a sidewalk along
Dodd Lane, she is comfortable eliminating the internal sidewalk on the
church property.
Council Member Wulff stated she feels the internal sidewalk is necessary
.for pedestrian safety.
Pastor Thompson stated that because they have agreed to construct the
sidewalk along Dodd Lane, they would like the decision on the internal
sidewalk to be at their discretion. Because safety is a major concern of
theirs, they may decide to build the sidewalk sooner than mandated.
Mr. Mielke recommended allowing the church additional time to review
their options for timing and placement of the sidewalk.
06.47 Motion was made and seconded to approve Resolution No. 06-79
approving the..preliminary and final plat of Lord of Life Lutheran Church
Addition and a conditional use permit to allow the construction of a church
in the RS-3 District, with. the elimination of Stipulation "i" requiring the
construction of a five foot wide concrete sidewalk on the church property.
Roll call was taken on the motion. Ayes, Johnson, Rieb, Luick, Bellows.
Nay, Wulff. Council Member Wulff stated she feels there should be a
timeline in place for construction of the sidewalk.
