Presentations/Introductions Mr. Michaud presented a resolution naming the Lakeville Performing Arts Theater to honor former Mayor Duane R. Zaun. Council Member Swecker read the resolution. Mr. Michaud presented ~ framed copy of the resolution to Duane and Mary Zaun. 08.85 Motion was made by Swecker, seconded by Bellows to approve Resolution No. 08-125 naming the Lakeville Performing Arts Theater to honor Duane R. Zaun for his dedicated service to the City of Lakeville. Roll call was taken on the motion. Ayes, unanimous. Spotlight on Business -Economic Development Commission member Glenn Starfield presented information on Unimed-Midwest and introduced Chief Operating Officer Chris Robbins. Comments Harley Horsager, 17141 Jaybell Court, presented information and encouraged the City of Lakeville to participate in a county-wide greening initiative focusing on lowering energy consumption and the county's impact on the environment through the Dakota County High Performance Partnership. Consent Agenda 08.86 Motion was made by Bellows, seconded by Swecker to approve the consent agenda items as follows: a. Claims for payment. b. Minutes of the September 2, 2008 City Council meeting. c. Receive minutes of the September 4, 2008 Planning Commission and the August 26, 2008 Economic Development Commission meetings. d. Resolution No. 08-126 calling a public hearing on .proposed assessments for Improvement Project 08-01, portions of Donnay's Valley Park 3rd Addition and Niakwa Village 1st and 3rd Addition street reconstruction. e. Mechanical amusement device license for Leiserv, Inc. for mechanical amusement devices at Brunswick Zone XL-Lakeville. f. Resolution No. 08-127 authorizing the disposal of assets (computers). g. Minnesota Trails Assistance Program agreement with the Minnesota DNR for cross country ski trails. h. Company for Improvement Project 08-04, Well 19. k. Resolution No. 08-129 approving plans and specifications and setting a bid date for Improvement Project 07-16, 205th Street .channel stabilization. I. Amendment No. 4 to Planned Unit Development Agreement for Crossroads 1St Addition. Roll call was taken on the motion. Ayes, unanimous. Item 7 - Conditional Use Permit for T-Mobile at Valley Lake Park Kelly Swenseth of FMHC Corporation requested Council approval of a conditional use permit to allow the construction of a 75-foot tall cellular telephone communications tower on C'rfy-owned property located in Valley Lake Park. Mr. Morey stated the project will also include the construction of a paved driveway with associated technical equipment cabinets on a 25' x 15' enclosed area in the northwest corner of the Valley Lake Park property, located south of 160th Street and east of Garrett Path. He explained that the tower is set back approximately 90 feet from the County Road 46 right of way and at least 250 feet from any residential property. The Planning Commission held a public hearing on the conditional use permi application and unanimously recommended approval subject to nine stipulations. Staff recommends approval 08.87 Motion was made by Bellows, seconded by Wulff to adopt Findings of Fact and approve a conditional use permit for T-Mobile Central, LLC, to allow the construction of a 75-foot tall personal wireless service antenna tower at 16050 Garrett Path. Roll call was taken on the motion. Ayes, unanimous. CITY OF LAKEVILLE COUNCIL MEETING. .SEPTEMBER 15, 2008 Page 4 Item 8 -General Obligation Bonds Mr. Feller presented a resolution awarding the sale of $2,280,000 General ..Obligation Bonds. He explained that the bond issue will provide financing for the Valley Park street improvements, acquisition of police, fire, streets and parks. equipment, and refinancing of the 1997 ice arena bonds. David 1vlacGillvray of Springsted, Incorporated, explained that the City received two legitimate bids, and- the lowest and best bid was from United Missouri Bank of Kansas City at a true interest rate of 3.0181 The bid came insignificantly under Springsted's estimate. 08.88 Motion was made by Swecker, seconded by Wulff to approve Resolution No. 08-130 awarding sale, prescribing the form and details and providing for the payment of $2,280,000 General Obligation Bonds, Series 2008A. Roll call-was taken on the motion. Ayes, unanimous. Item 9 -Presentation of the Proposed 2009 Budget and Tax Levy Mr. Feller presented the proposed 2009 budget and tax levy. He explained that the current economic conditions, which are expected to extend into -the coming year, are guiding factors in establishing the framework for the 2009 budget. The proposed 2009 preliminary tax levy is $23,616,1 18. (A complete copy of the 2009 preliminary budget is on file in the City Clerk's office.) Mr. Feller explained that the County Treasurer/Auditor will mail parcel- specific truth in taxation notices in November. The truth in taxation public hearing will be held on December 8, 2008. The City Council has the ability to adopt a final tax levy on December 15, 2008 that is equal to or less than the preliminary tax levy. Council Member Wulff asked for a clarification in the budget narrative with respect to the use of Municipal State Aid (MSA) funds for the maintenance of City roads. Mr. Feller explained that the state aid money that is allotted to the City is divided between a construction account and a maintenance account. When funds are reallocated from the construction allotment to the CITY OF LAKEVILLE COUNCIL MEETING SEPTEMBER 15, 2008 ,Page 5 maintenance allotment, there is less cash on hand for .any road that the City designates, regardless of whether it is a County or City. road. Council Member Wulff stated she wants to make sure residents understand that the City is using City tax dollars for City purposes. Council Member Bellows voiced concerns with the proposed increase in taxes to commercial/industrial property and stated he would not support this kind of levy when it is voted on in December unless some reductions are made. Mr. Mielke explained that the overall levy increase being proposed is 4.1 Residential property values are declining; therefore, those residential property owners should see a decrease in their taxes. The City's portion of commercial/industrial property will go up roughlyl 0.9~, while the County's portion will go up roughly 8%. City staff will continue to look far additional ways to reduce the budget. 08.89 Motion was made by Wulff, seconded by Swecker to approve the following: ? Resolution No. 08-131 approving the proposed 2009 budget. Resolution No. 08-132 approving the preliminary 2009 tax levy ? New Business - Council Member Wulff asked Mayor Dahl to clarify her position on the Dakota County High Performance Partnerships (HiPP) Greening Initiative. .Mayor Dahl stated that as a member of the HiPP group, she has done research and compiled information, ,and the group will be presenting that information to the cities that are participating.
