Chairman J. Antolik called the meeting to order with Antolik, Campbell., Lutgens,
Baumgartner, Hazel,. and Spande answering roll. (J. Jojade had also been present earlier,
but had to leave.) Administrator P. McGarvey, Planner Steve Ryan, and Attorney Roger
Knutson were in attendance.
76.18 The minutes of the meeting held January 29th were. approved upon motion of
Lutgens-Campbell. Motion carried,
Public hearing of Gary Parker, Frontier Electronics, was begun, He was the
applicant for the renewal of a conditional use permit to operate a repair shop for radios
and TV, at 8710 210th St. W. Atty R, Knutson stated he had reviewed the material and
mailing notices. and publication notices for this hearing and "all legal requirements had
been satisfied, and that it was his opinion that this was a legally called public hearing."
Upon questioning, Mr. Parker said that his business was .not concerned with sales, only
occasionally, when a set would not be repairable.
76.19 Motion by Hazel-Campbell to close Parker hearing. Motion carried unanimously,
Antolik, :Campbell, Lutgens, Baumgartner, Hazel, and Spande all voting "aye".
76.20 Recommendation is to be made to Council, upon motion by Hazel, that Parker
application for conditional use permit be granted, with the provision that the
permit conform to the present sign ordinance. The term of the permit will be
two years. Lutgens seconded. Voting "aye" were: Antolik, Campbell, Lutgens,
Baumgartner, Hazel and Spande.
Public hearin~of an amendment to Ordinance No. ~+2, to allow billards, pool,
• games of amusement, iri B-3 zoning, was read.
Atty R. Knutson stated he had reviewed the publication notices of this hearing,
and, in his opinion, this was a legally called public hearing.
Mr. Chuck Radtke, Valley Park resident, wished to know if this concerned the.
conditional use permit application for property on Cedar Av. Planning consultant S. Ryan
pointed out that there is a problem of no parking requirements in a B-3 zoning, He further
said that acceptance of this amendment was mandatory, or the application of Mr. Gary Huth
for a conditional use permit to operate a recreational center could not be legally granted
in a B-3 zone.
76.21 Motion to close the public hearing of the amendment to Ordinance No. ~+2,
reagarding allowance of billards, pool, and games of amusement, in a B-3
zoning, was made by Campbell-Baumgartner.. Motion carried unanimously--Antolik,
Campbell, Lutgens, Baumgartner, Hazel, and Spande voting "aye".
Public hearing notice was read of the application of Gard Huth for a conditional
use permit to operate a recreation center at 16600 Cedar Av. So., in Valley Park.
Atty R. Knutson attested to the legal notice being published in the official
newspaper and mailed to property owners within 350 feet, as required by law. He stated
in his opinion, that this was a legally called public .hearing.
W. Campbell wished to know how many people would be in this proposed center at
one time. G. Huth answered that approximately 50 were in his center at the present location
and that he would be able to have 6O to 65, if he moved to Valley Park. He also made the
statement that he is present at all times. Mr. Chuck Radtke said he had asked the Apple Valli
Police Dept. about problems they had encountered with a center there called the Corner Pocket
They had had a great deal of difficulty with it. He said he was "opposed to such an operation
in a residential area".

Mr. Don Fanum, Valley Park resident, said his property abuts more of this
area than anyone else's; he said he now has problems with kids and Ole Piper Inn--that his
fence is demolished right now. He is opposed to any additional traffic.
Mr. Mike Giles spoke of a letter from Lakeville Chief Radermacher,--The Bridge
where it is presently located, has had very few incidents, as compared to Apple Valley.
It was brought out that there is no state or local curfew. Lutgens asked if
there had been a problem with beer being brought. Mr. Fanum said "could be the best ideas
in the world, but what happens in the parking lot"?
Mr. Roger Kramer, Valley Park resident, said that the police were within a
half block of the Corner Pocket, but in Lakeville, the police would be approximately 8
miles away. Ole Piper Inn is right next door to the new beation of The Bridge, if
allowed. How can it be controlled?
Chief Radermaeher's letter was read aloud by W. Campbell. A copy of the letter
is filed with these minutes.
76.22 Motion to close the hearing of G. Huth, The Bridge, application for conditional
• use permit to operate at 16600 Cedar Av. location was made by Spande-Campbell.
Motion carried unanimously--Antolik, Campbell, Lutgens, Baumgartner, Hazel,
and Spande voting "aye".
Public hearing of John LaFavor for a conditional use permit to operate
cabinet shop ~t 9~0 -15th St. W.--notice was read. Atty R. Knutson stated he "reviewed
the notice that went out and hearing is legal".
Planner Ryan stated that "under Lakeville's zoning ordinance, this is not an
allowable home occupation--the work will be done in an accessory building.
John LaFavor said he is now operatiog a shop in same zoning. "Why is it O.K.
in one place and not in another?" Planner Ryan said the existing ordinance was adopted in
1970. George F. Handel, neighbor on 185th St., was not present, but had sent a telegram
(copy on file with these minutes), objecting.
76.23 Motion to continue John LaFavor public hearing at the first Planning Commission
meeting in March, (March nth), was made by Lutgens-Campbell. Motion carried--
Antolik, Campbell, Lutgens, Baumgartner, Hazel, and Spande all voting "aye".
76.2+ Motion that recommendations on amendment to zoning ordinance and application
of Gary Huth conditional use permit for Cedar Av. location be taken up at
next Planning Commission meeting February 19th was made by Baumgartner-Spande.
Motion carried--Antolik, Campbell, Lutgens, Baumgartner,. Hazel, and Spande all

Mr. and Mrs. Jack Pessinger and Mr. Barry Eldeen were asking for a discussion
regarding the establishment of a Canine Care Center in NW Lakeville, just west of Jack
Horner property, off of Judicial Road in Orchard Gardens. They wish to build a X250,000
home, etc. There will be no more than 25-30 dogs at one time--only a boarding operation,
with no dogs outside. The zoning of the land in Orchard Gardens would not appear to be
appropriate, as it is now. It was suggested to them that they consider other land in
Lakeville that is zoned correctly, and still is attractively wooded, with a pond--possibly

land that is for sale just north of Mrs. Ella Foulkrod's residence, east service road of
35W.
Question was asked of Mr. Knutson, "what is extent of liability if City
officials give wrong information?" I~lr. Knutson answered that "no one has authority to
waive City ordinance or bind the City--City Council is the only body that can bind the
City."

Administrator P. McGarvey is going to check with Mr. Frigaard on the original
1970 zoning map.
76.25 Motion to adjourn the meeting came at 11:35 PM--Spends and Baumgartner.
Motion carried.
