members--and Attorney R. Knutson, Planner, S. Ryan, and PW Director J. Robinette;

PUBLIC HEARINGS: (1) Applicant City of Lakeville to have property
adjacent to Liquor Store zoning changed so that
there would be more parking spaces. --Recommended
approval, as explained to them by PW Director, .and
as 'Planner's memorandum report dated 25 March, set
forth.
(2) Applicant Mike Gannon was asking for a conditional
use permit to expand underground storage capacity
and make alterationsand improvements to the station
.site located. at the corner of Holyoke Av. and
210th St. --Letter had been received that applicant
was no longer interested in buying thisproperty--
hearing was closed. Motion was No. 76.x+9.
(3) Applicant John Greaves, represented by Glenn Nord,
wished special use permit to park semi-trailer trucks, nc
not to exceed three in number, not to exceed three
years in length, on park of Lot 12, Argonne Farms,
Section 12. --Hearing was closed, Motion No. 76.50,
• restrictions that Planner proposed in his memorandum
.dated. 8 April, were read for the audiences' benefit,
and Attorney Knutson and Planner Ryan are asked to
consider some alternatives for Commission decision,
to be given to them prior to their May 6th meeting.
Wm. J. Markert was the applicant with a request for
variance on rear-yard setback of two feet on Lot 10,
Block 2, Dakota Heights nth Addn. --Recommended
denial of request, for reasons outlined in Planner's
memorandum dated 8 April, by vote of 5-l, Motion
No. 76.53•
(5) R. Henry VantHof was applicant for permit to place a
mobile home on four acres of land on 160th St. W., in
Section 5. Mr. VantHof had been the tenant in a
trailer. at this location for two years. This permit
was obtained by Mr. Steffenhagen. The trailer became
uninhabitable, Mr. VantHof decided to purchase the
land, and also replaced the old home with a new moi~ile
home. --Motion No. 76.55 was to deny this application,
but asked Council's interpretation o~ mobile home ordi-
nance. This motion to deny passed by a ~+-2 vote.
(6) Preliminary plat of Golden Leaf Forest, Mr. Glen
• Gislason, represented by Mr. Ray Brandt, was the next
hearing. This property is located in NGT Lakeville
in Section 2, near. Hwy. 5. There were some objections
to long cul-de-sae and Planner declared other "hurdles"
so no recommendation is forthcoming at present time.
Motion No. 76.57 closed the hearing.
OTHER BUSINESS: (1) Motion No. 76.51 was a recommendation that a
moritorium be placed on eons ru~on of metal
buildings, excluding the ones to be put to
agriculture
use, for a suggested period of six months.
(2) Motion No. 76.58 was to recommend approval of Mrs. E.
Seeley request for renewal of graveTpermit, with thecae
stipulations: {1) area must be c'Leaned~o PW Director's
satisfaction before any gravel is removed, (2) pit
must be brought up to standards of Ordinance No. 13,
(3) limitation to 10,000-yards of gravel to be removed.
(3) Mr. Jim Weitzel showed further plans of his proposed
building on 162nd St. and Hwy 35w. This will be an
agenda item for May 6th.

Chairman J. Antolik called the meeting to order at 8e00 PM. Answering roll
were: Antolik, Lutgens, Jojade, Spande, Hazel and Campbell; Baumgartner, absent.
Present,. also, were: Attorney R. Knutson, Planner S. Ryan.
76.~+~+ Motion to approve minutes of March 18th meeting was made by Lutgens-
Campbell.. Motion carried--all members voting "aye".
76.x+5 Motion to approve the written discussion notes of April lst meeting
was made by Lutgens-Campbell. (There had not been a quorum that
evening for a regular meeting.) Motion carried--all members voting
eye .
76.x+6 Jojade-Lutgens motioned to acknowledge receiving Council meeting
..minutes of three meetings--March 15, March 29, and April 5th.
Motion carried--all members voting "aye".
The notice of the first public hearing of the evening was read. This was
The City of Lakeville applying for a change of zoning from R-3A (single-family)
to a B-3 zoning classification. .This was for property at 20655 and 20665
Holyoke Av., adjacent to Municipal Liquor Store. The property is intended for
additional off-street parking for the Liquor Store.
R. Knutson attested to the legality of the hearing. J. Robinette explained
what the situation was at the present time and used a diagram showing the re-
• maining trees on the property and how they hoped. to be able to save them and park
around them. Decorative shrubbery is planned for the Holyoke Av. side of the
property, and also ornamental plantings. A probable, 6 ft., cyclone fence
will be located to the west side of the lots, taking into consideration the
slight jog that there is in this boundary line. An exit is planned onto 206th
St., which will allow for a better flow of traffic on and off the lots. 2~F
additional parking places are planned. The lot is approximately 150' x 115'.
Concrete bumpers will be utilized and as many trees as possible will be saved.
Two rows of cars' parking are. planned at the present time, and possibly a third,
later on. These plans are within the City's centralized parking plan.
76.x+7 Hazel-Spande made motion to close the public hearing of The City of
Lakeville's application for a change of zoning for vacant lots
at 20655 and 20665 Holyoke Av., to provide additional off-street
parking. Motion carried. All members voted "aye".
76.x+8 Hazel-Campbell motioned to recommend approval of the plans for
parking and re-zoning as explained to them and as set forth by
Planner in memorandum report dated 25 March. Voting "aye" were,
Antolik, Lutgens, Jojade, Spande, Hazel, and Campbell. Motion
carried.
76.x+9 In regard to the application of Mike Gannon for a conditional use
permit to expand underground storage capacity and make alterations
and improvements to the station site on the corner of Holyoke Av.
and 210th St., a letter had been received from James and Dorothy
Gannon that Mike Gannon would not be purchasing the property after.
all. Lutgens-Jojade motioned to close this hearing. All members
voted "aye".
Mr. Nord, acting for Mr. John Greaves, also present, explained why Mr. Greaves
was the applicant at a public hearing for a special use permit to park semi-trailer
trucks, not to exceed 3 in number, not to exceed 3 years in lengthon part of Lot
12, Argonne Farms, in Section 12, R21W.
Mr. Greaves had been the owner of the property for 17 or ~ years, had been the
owner of the property before the Comprehensive Plan was passed and still owns it
today. His home is immediately to the east of the property being considered, and
there is a total of three homes in this family's possession in this very area.
He particulary needs to store the trailers over the winter months when they are
not being used at all. The spot where Mr, Greaves. wishes to store these trailers
is very low. Mr. Greaves is asking for a small area where 3 trucks could be put
for a 3-year period. Planner has stated that this request has not been unreasonable.
L. Hazel asked the question, "does he wish to conduct any other business there?"
Answer was--only asking for Mr. Greaves, not his brother-in-law. K. Lutgens wished
to know, "can you explain why they are not used for 6 months?" Answer--"used to
haul carnival equipment". J. Antolik asked, "do you want to park them where. they
are now, close to white picket fence?" "No, going to be back of that quite a lot."
G. Spande, "do you agree to the Planner's restrictions?" "Yes".

(R. Knutson will write a draft which the Planning Commission will review, then
send it on to Council for action.). Voting "aye" were: Antolik, Lutgens, Jojade,
Spande, Hammel, and Campbell. Motion carried.
• R. Knutson testified to the legality of public hearing for Wm. J. Markert to
consider request for variance on rear-yard setback on Lot 10, Block 2, Dakota Hgts
nth Addn.
Planner Ryan said "when there is a way to build, really does not need a variance."
Neighbor R. Clark spoke, "do not agree that house should be put where Markert
intends, the trees that are worthwhile are where he wants to put his house."
Time was devoted to examining Mr. Markert's plans. J. ~'ntolik suggested
putting the 2 ft. to other side of home, but Mr. Markert objected stating of
specs, blueprints, etc. have been done this way and this is the way he really
wants to have the home. Diseizssion followed on disease of oaks here, also.
76.52 Campbell-Lutgens motioned to close the above Markert hearing.
All members voted "aye", Motion carried.
76.53 Motion to deny the Markert request for variance to rear yard setback
2 ft., for reasons outlined in memorandum received from S. Ryan,
dated 8 April, was made by Lutgens-Spande. Voting "aye", were:
Antolik, Lutgens, Jojade, Spande, and Campbell--Hazel voting "nay".
Motion to deny carried, by vote of 5 to 1. Chief reason outlined
by S. Ryan was that"this particular variance is requested to aceomodate
a particular house shape, rather than to correct an unreasonable
• situation or hardship."
Public hearing of R. Henry VantHof for permit to place a mobile home at 160th
St. W. on ~ acres of land, in Section 5, was begun. Mr. VantHof stated that the
trailer home he had been renting from Mr. Steffenhagen had become unlivable, he had
lived in it for two years. He now has been buying the property from Mr. Duffy,
has a purchase agreement, and is in process of obtaining a contract for deed.
However, he had been in a severe ear accident, had had to dig a well, fix his
septic tank, expense of changing electric voltage, and had not been able, finan-
cially, to do more at this time. He said he had moved the new trailer onto the
property last fall. He had thought the permit for the "old" trailer did not
expire until the end of 1976, and had been told that there would be'no problem
with using the same, existing permit. The septic tank problem had'"been rectified--
it had been ~ to a sticking valve in the toilet.
It was pointed out that the permit on the Steffenhagen mobile home expired
Dec X50, 1975, and had been issued for only one year, because Mr. Steffenhagen was
going to move it. A letter had been written by Plumbing Inspector Langord saying
septic tank did not meet municipal or State standards and it was his opinion it
needed to be re-done, if permit was granted. A memo from Mr. McGarvey stated,
Feb 2, that Buss had told him to apply for a permit, and if he was turned down, he
would have to move the mobile home.
76.5+ Motion to close VantHof hearing was made by Lutgens-Jojade. All
members voted "aye". Motion carried.
76.55 Lutgens-Jojade made motion to deny VantHof application, but asked
advice from Council on intrepretation of mobile home ordinance.
Voting to deny: Antolik, Lutgens, Jojade, Spande, (stating, with
great reluctance), Hazel, "nay", and Campbell, "nay". Motion to
deny passed by to 2 vote.
Mr. Ray Brandt, representing Mr. Glen Gislason, was present for public
hearing for preliminary plat of Golden Leaf Forest, situated: in Section 2,
near Co. Rd 5.
76.56 Motion by Jojade-Campbell to extend the meeting. Motion carried,
each member voting "aye".
Mr. Brandt stated they would like to begin building here next summer.
Both Planner and Public Works Director were objecting to length of long cul-
de-sac--fire trucks, etc., snowplowing, would have difficulty here. 9y
grade also met opposition, somewhat. Planner stated, "plus other hurdles.
There are some concerns that warrant some further inspection".
76.57 Hazel-Spande motion to close Gislason hearing. All members voted
"aye". Motion carried.

76.58 MRS. E. Seeley was requesting an excavating permit renewal. PW
Director Robinette explained the circumstances and showed pictures
of the pit. There is wood at the bottom of the pit, does not have
proper sloping, does not conform to Ordinance No. 13 at present
time and shape.
Motion by Lutgens-Jojade to recommend that the area must be cleaned
to PW Director's satisfaction before any gravel is removed,
must be brought up to standards of Ordinance No. 13, and limited to
10,000 yards of gravel. All members voted "aye", Motion carried.
Mr. Jim Weitzel showed further plans of his proposed building on 162nd St.
This will be an agenda item for May 6th.
76.59 Motion to adjourn the meeting by Jojade-Lutgens. All "aye",
motion carried. Time 11:35 P.M.
