Roll call was taken. Present, Hazel, Spande, Campbell, Antolik, Jojade, Lutgens. • Also present, Patrick McGarvey, City Administrator, Roger Knutson, City ' Attorney and Dave Licht, Planning Consultant:, 76.73 Motion was made by Lutgens, seconded by Jojade to approve the minutes of the May g Planain~ Commission meeting. Motion carried, The City. Administrator reviewed with the Planning Commission the preliminary plat of Golden Leaf Forest. As a result of a meeting between Mr. Brandt, _ Engineer for the developer and the. City Engineering Consultant it was recom-. .mended that the grade oa the road coming into the plat. be set at lOX sad $X on the downward side of the crest of the cul-de-sac. This would require a variance from the 8x maxiumum allowed by Citq ordinance. The road would be asphalt street built .on a 60 foot right-of way.< There would be no water or sewer in this plat due to the distance from existing City utility system. Therefore, each lot must contain, and does, a minimum of 3 acres. 76,7y Motion was made by Hazel, seconded by Spande to recommend approva3~of the preliminary plat of Golden Leaf Forest to the City Council with the lOX grade on the cut--de-sac as it enters the plat and on the length of the cut- de-sac._ Roll ca13 was taken on the motion. Ayes, Hazel, Spande, Campbell., Antolik, Lutgens and Jojade. The Chairman opened the public hearing oa-the proposed amendment to the Zoning _ Ordinance which would provide for a conditional use permit for a canine care center in an R-lA zone. The City Administrator, presented as affidavit of publication and the City Attorney attested to the legality of the hearing. The City. Administrator read the proposed ordinance amendment and explained why the amendment was before the Planning Commission. The Chairman asked if there was anyone present wishing to speak or comment on the amendment, Mr. Gordon Lekson questioned the reason for the proposed `.canine care center amendment and also questioned if this was an appropriate use in an R-2A resi- dential zone. He stated he felt it was placing a commercial use is a resi- deatial area, although he .agreed that the conditions set forth seem stringent. q'wo other residents, Joesph Enright and Henry Rice also questioned as to whether or not this .was att appropriate area for a canine care center and questioned the scope of the operation. Mrs. Pennsinger explained briefly what their .intentions were ff such an amend- went were approved and they were granted a conditional use permit to operate a canine care center. 76,7§ There being no further comments or discussion, motion was made by Jojade, . seconded by Spande to close the public hearing. Roll call was taken on the motion. Ayes, Spande,'Hazel, Campbe33, Anto3ik, Lutgens, ~ad.JOjade. 76.-76 Motion was made by Hazel, seconded by Campbell to recommend adoption of the amendment to the zoning ordinance with one change by adding the words "As recommended by the City Engineer is condition #6". d Roll call was taken oa the motion. Ayes, Hazel, Spande, Anto3ik, Campbell. Nays, Lutgens,. Jojade. Both Mr. Lutgens and Jojade explained there no vote by stating they felt it was putting a commercial use in s residential'zaae g~ The... staff then reviewed with the Plaaning•Commission the draft'of an ordinance to amend the zoning ordinance requiring the placement of a new house on a Idt so that~a normal size double garage could be built within `the setback require- meats. After some discussion, the Commission asked the staff to'make some changes in the ordinance and bring it back at the next Planning Commission meeting. _ -1- w CITY OF LAKEVILLE MINUTES OF THE PLANNING COMMISSION MEETING JUNE 3, 1976 • The City Attorney then .reviewed with the Planning Commission the final draft. of the proposed Home Occupation Ordinance. The City Attorney outlined the changes he had made in the third draft which had been submitted to the Planning. Commission on May 20th. The City Administrator advised the Planning Commission that a public hearing would-have to be called on the adoption of the .Ordinance as it was amending the Zoning Ordinance by taking Home Occupation out of that. Ordinace. It was. decided to call the hearing on the proposed Home Occupation Ordinance for the first meeting in July, July 1, 1976. The City Administrator then reviewed with the Planning Commission two items which would appear on the June 17th meeting agenda. The first would be the proposed preliminary plat along with a rezoning to multiple residential as submitted by Mutual Land .Development, the northwest corner of Section 10. The other is a request for a variance set-back submitted by Engineering Spe- cialties to construct a warehouse and office addition on the north side of their building on 207th Street. 76.77. There being no further business, motion was made by Jojade, seconded by Hazel to adjourn the meeting. Roll call was taken on the motion. Ayes, Hazel, Spande, Campbell, Antolik, • Lutgens, and 3ojade.
