Antolik called the meetin to order g g weres Antolk, Lutgens, Jajade, Spande, and Asmus;'C-ampbell, and Hazel were absent. Attorney R. Knutson and Building Inspector D.'Goodermont;attended this meeting also. Planner Dave Licht came at 8:15 P.M. 76.102 Lutgens and-Jojade moved and seconded'to approve the minutes of the last meeting, July 15th. Motion carried--hntolik,'Lutgens, Jo jade, Spande, and lismus voting ,,aye,, ~ reviewal of Council meeting minutes of July 19th was made. Roger Knutson attested to the legality of the first public hearing, which; was Noel T~~cGuire's application for a variance to set house lower than one foot above canter fine of street on Lot, 5, F31ock 1, ~~Jechselbaum's 1st ~~.ddition, 10125 205th Street. Jerry Spande wished to know if this land had sewer lines available. i~nswered 11yes" 76.103 P'~oton by Spande-Lutgens to close McGuire public hearing. Voting "aye" were Lutgens, Jo jade, Spande, and Asmus,.and ~~~sitolik. Motion carried. 76.10 T~otion by Spande-and~Lutgens to approve variance for one foot elevation for,appl~ant i~Toel McGuire. Voting "aye" were Jo jade:, :..Spande, r~ mus, s~ntolik, and Lutgens. Motion carried. NCTE: Because of its size, 'it is asked to have the McGuire's return with a public hearing on their garage.. Public hearing of,Eruce and Frances Person, applicants for a variance of theten- foot side setbacks was begun. Planner Licht gave the information that DiJR will soon require property on Lakeshore to have a 150' frontage before any construction can be done--within six months its possible. that it will-not be a conforming use. K. Lutgens remarked "besides all Dave-has. brought up, ti~re have to show a hardship to recommend avariance." It was.. the.. opinion of; J. l~ntolk that another .typed house would be better-suited to the lot.. Dave Goodermont also spoke of his concerns about the shoreline. J. ~smus wondered if this could be`mposed on individuals,-at this time when it has not yet :become a law. He showed more concern-about the setbacks of the sideyards.- 76.105. Motion to close Person public hearing was made by.Lutgens-Jo jade. Doting "aye" were Spande, Asmus, 1lntolk, Lutgens, and Jojade. Motion carried: 76.106 Motion to deny the Person application for a variance was made by Spande and°Lutgens. Reasons for denial recommendation were: "no hardship involved-- and another house-can be designed to fit." Voting to deny application were Asmus,:G.ntolk, Lutgens, Jojade, and Spande, Recommendation to deny carried. Fence amendment proposal was read and discussed and public hearing begun.' Roger i Knutson felt Subd. 7 should be better defined, Asmus questioned Subd. 6. Dave;Goodermont wondered if and ''6" conflicted. Dave Licht questioned the word "hedge'°, saying that` some communities considered its use as a wa1l.Vsibility was a major concern on corner lots. Large evergreen trees were mentioned as being dense, Dave explained that a ruling "base of the tree that is 6' up could be allowed'-'-and that visibility on the 'triangle' (z) 5 X976 r. Asmus wished a statement added to the sentence concerning. fencing on the triangle piece so people would know that it was because of thevsibilit~ safety factor that that wording was used. 76.107 Lutgens-Jojade motioned and seconded to close the public hearing on the fence amendment deletion and separation. Voting "aye" were I?ntolik, Lutgens, Jojade, Spande, and Asmus. T~~Totion carried. 76.108 Potion to table the matter of fences until next meeting, ?ugust 19th,... was made by Lutgens and Jojade. Voting to do so were Lutgens, Jojade, Spande, Asmus, and Antolk. 'Piotion carried. Dave Licht spoke on item 6 of the agenda which-dealt with urban services concept. Information that he has been waiting for from Pietro Council will now be due mid-Sept. or Oct. A big question is what to do about large area of property west of 35~~7-which is non-sewered presently, with not much hope of it becoming 'piped'. He referred to material dated June 29th which he had had sent to Planning Commission members. In it he suggested, as an interim policy, to declare a mora,torium'of one year of any construction, whatsoever., in this area, on less: than ten acres. 76.109 "lotion by Ltutgens-Asmus to recommend to Council su~rh a moratorium as outlined in Planner Licht's suggestions dated June 29, 1976. (See. above paragraph.) It was further added, "and forward. this policy to P'~etro Council'°. Voting "aye" were Jojade,'Spande, Asmus, ~'intolik, and Lutgens. T~'Iotion carried. In view of the.fact that there will be a joint meeting of Lakeville civic personnel, -etro Council people, etc., on'Au~ust 26th 12:30'PM, Metro Square Building, in St: Paul (all are urged to attend), Jerry Spande suggested that each one list questions, beginning • this evening, of things to ask he Pietro Council members. The list, as begun, is on a separate sheet of paper attached_to these minutes. There. will be room emough for each to write a few more questions, as they are thought of, and bring them to the next meeting, r'~ugust l9th.__ Dave Licht said he would have a list of questions by Aug. 19th, also, regarding statistics. Both o~zE local newspapers have good articles on Lakeville's sewer financing problems. T.~embers are asked to read them, thoroughly. It was also suggested that local newsreporters might wish to attend the meeting on the 26th. Nir. Charles Holen, who lives. on the corner of .Judicial Road and 168th..Street, Orchard Lake, was present, T~~r, Holen had been unaware of Lakeville's ordinances regarding the moving of buildings into the City, and the further locat~;an of them. He had recently moved a one-car garage on"to his.property, to take the place of one that was alreac~rthere which .needed repairing. H~e estimated the building to be 122 feet x 20 feet, anc'.~ that it .was built in 1967: 'T'here is no other garage on theproperty.. Mr. Holen was asked to do three things: (1) obtain a letter from.Lakeville's Building Inspector stating how well it is constructed, (2) pictures of the. building and where it is to be located, and (3) letter from adjoining property owners as to its compatibility. These items are to be brought to the next Planning meeting, August 19th. Public hearings and matters that will be on the agenda for the evening of 'August 19th were discussed. .They include preliminary plat of Dick Sullivan's, preliminary plat of Denny Dunham for Lakeville Industrial Park ~dest~ Variance for below grade lot for Robert E. Hoff for Lot 13, Block 1, Oak Shores 3rd Addition; request of ti~lilliam Jackson for special use permit-to'conduct~a commercial use in a commercial zone (B-~+)', without sewer, on a lot of less than 3 acres, and a request fora conditional use permit for an amuse- • meat/recreational center in the former Yamaha Building on Cedarlwenue, zoned B-~F. 76.110 ~'iotion to adjourn the meeting came at 11 PTi--Spande and Jojade.
