Hazel came fifteen minutes .,later. Building Inspector Csoodermont and.Attorney R, Y,nutson, Planner Mark Johnson in attendance. 7b.111 Motion by Lutgens-Jojade to approve the minutes of the August 5th meeting. T~Zotion carried--l~ntolik, Lutgens, Jojade, Spande, :hsmus voting "aye". A revewal of Council meeting minutes of hugust 2nd was made. Nothing was found pertaining to Planning. Commission direction from Council. Roger Knutson attestedto the legality of the up blc hearing of Denn Dunham fbr preliminary plat of Lakeville Industrial T'ark TSest, 1st t~.ddition, to be located on SE4 of N'ti~Tµ, and SW4 of 1'TE, Subject to Hwy Easr_~nt, See. 36. C~,uestions asked werec Asinus--"why only platting 3 acres, not 5?"--and 'asked for a legal opinion. Planner A,ark Johnson noted that according to the zoning ordinance., no less than 5 acres can be developed into an industrial park--there is no se~n7er and water here.. Denny's answer was °if you sold 5 acres,you would h~.ve to plat it." Asmus--"there should be ome consideration of what the growth pattern is going to be" and "is it in violation with the zoning ordinance?" There wa.s a comment made that industrial. growth in Lakeville is approved in the present industrial center at ~^;irlake. 76.112 P.'Iotion to close tT•ie public hearing was made by Spande and 1lsmus . "Voting "aye" were Lutgens, Jojade, Spande, Hazel, Asmus, ~~tolik. T!~otion carried. • Asmus stated that he objected to Outlot A because it might become an eye ore if it is someday unbuilable. Hazel commented that Outlot A was used for the convenience of .legal description, and seconded in this thought with Surveyor Gene Jacobson. The thought was to drop 0utlot A and make it all Outlot B, and going to show the street with a cul-de-sac description, only, as a drawn cul-de-sac is not allowed by the Co. Engineer, in situations like .this. 76.113 Lutgens-Jojade motioned. to table ~his,~tatterc:of ~~~?lication for an Industrial Park 'Test Lakeville. of Denny Dunham, public hearing, until ne:a meeting, September 2nd. Voting--Jojade, "aye"; Spande, "nay"; Hazel, "aye"; w?smus, "aye"; Antolik, "aye"; and Lutgens, "aye". T=Matter tabled.' Spande voted "nay" because "I personally don't see any reason for not sending .the<plat on to 'Council, with the stipulations of approval that we might. make tonight". Public hearing of Tfr. Robert E. Hoff for variance to build 2~+" below street level on .Lot 13, Block 1, Oak Shores 3rd Addition, was begun. The attorney"attested to the legality of the public. hearing. T~2r. Hoff think it will be a variance of less- than 2~+" and application should have read 'a maximum of 2~+"'. 76.11+ Hazer-T-Lutgens motioned to close Hoff public hearing. Voting "aye" were Spande, TTazel, l_smus, r~ntolik, Lutgens, and Jojade. T~`Totion carried. 76.115 T?iotion to recommend approval of Hoff variance was made by Lutgens-Asmus. Voting."aye" were Hazel, Asmus, ~'~ntolik, Lutgens, and Jojade--Spande abstained, for business reasons. Motion. carried. Fublic hearing of Russell Streefland and ?7illiam Jackson for variance from the 3-acre minimum lot size, and special use permit to conduct a corrnnercial-use in a commercial zone without sanitary sewer on part of 1.12 of N?d4 of NEB, Sec. 1, R21, was begun. Attorney R. Knutson attested to the legality of the public hearing. (1} Planning Commission 19 Aug 76 i ` PLAT'aING C~ 1~~wISSION 19 AUGUST .1976: P.'GE 2 NIr. Streefland explained that ~-Jilliam Jackson was his client and the applicant at this public hearing.."Mr. Jackson is selling his home on 162nd St. to Lutheran Digest Magazine and the intent is to use the house and 2.5 acres for their .business. • Although this property is zoned B=~,, , `Ordinance No. 68 states there can be no sub- division without public water and sewer--and Ordinance No. 69 says we should have 3 acres of land without water and see>rer" explained Mr. Streefland. Asmus wished to know if R. F,nutson ~~aould recommend conditional use permit that. has to be renewed annually--or .what? Spande wanted to know how old the present:. septic system was:? Bill replied that it was 13 years old and the largest tank available. T~s.`Gordon Dhein, publisher of Lutheran Digest, said he did not intend to reside in this home. 76.116 Hazel-Jojade motioned to close public hearing of Streefland-Jackson. Voting "aye°' were ~lsmus, ~~ntolik, Lutgens,, Jojade, Spande, and Hazel. Piotion carried. 76.117 Jojade-Hazel motioned to recommend approval of conditional use, or special use, permit request. of tidm. Jackson for residencelocated on -.162nd-St. Voting "aye" were ~?ntolik, Lutgens, Jojade,. Spande, Hazel and _"smus, t~iotion carried. 76.118 Asmus-Jojade motioned to recommend approval of 2.5~+ acres land size of private septic system, instead of the 3-acre size, at residence of G7m. Jackson on. 162nd St. Voting "aye" were Lutgens, Jojade,. Spande, Hazel, Asmus, and Antolik. T'lotion carried. Concerning Motion No. 76,118, ^ttorney R. Knutson spoke, saying "justas a` measure to avoid trouble further down the line," lic hearing of Gary Huth and Todd Hulbert f or a recreation center, consist- ing o~--rarious games of amusement, on premises known as Yamaha Building on Cedar Av. and 190th St. was-begun.-h~ttorney R. F~nutson attested to the legality 'of ,the public hearing. Jojade wished to know how much frontage there was at this location from the front of the building to the right of way? Huth replied that 5th`Nti~t Bank, Mpls., would have the plan of the building, etc., as they`are now the owners, but there .would be plenty-of room for fifty cars to park, and he plans to put in crushed white rock in the driveway. Antolik wanted to know "are. you purchasing this property?" Huth replied, "n.o, we are leasing it". Jojade wished to know from Building Inspector Goodermont, "have you been out there"? Dave replied "yes, there are some water problems that will be corrected". R. Knutson wanted to know if the lease would be in both names, Huth and Hulbert? 1~n. wer--yes, they are partners-. Hazel wished to see a building plan, perking, etc. Huth had presented plans he had drawn, earlier in the meeting. Hazel was given one. Huth stated, again, has done, and wishes to do, everything that he is asked to do. Antolik wished to know if Huth was still doing business at "The Bridge"? "no", replied Gary.. "The Bridge" is now closed,"due to the fact that Gary has a broken ankle, presently. The lease could run as long as three years, but Gary was again made aware that it could possibly be every six months. Ian Anderson, asked to speak, He said he was a resident, living near the Yamaha Building, and he brought c~rith him a petition signed by 37 people concerned who are opposing the opening of Hlzth's recreation center. near them. 76.119 Asmu -Lutgens-motioned to accept the Anderson petition. T~ioton carried. l~nderson raised the fdlowing ques ions: < (1) v°That about 'the increased traffic on Cedar Av.? Hazel replied that everyone feels that. their street is noisy and that, he could sympathize with a noise problem,.howeverthis is a B-T+ zone. He further said that the planner has outlined 8'stipulations, should this applicant be recommended for approval.. Hazel read the s ipulatons;these stipulations are found on memorandum dated August 16, 1976,-from P~2ark-Johnson, Midwest Planning and Research, to Lakeville Planning Commissan. He also read a letter from Lakeville Police Chief to the tldminstrator, approving of G. Huth's operation in the past. Per. Phil Kalweit asked where 'Gary-is going to get customers from, and how is he -going to make-a living at this type of business?' Also, what age bracket? G. Huth replied that he expects to keep the same customers he now h~.s and also draw from .Farmington and Valley Park. He .operates `a family center, all ages, no liquor-- soft drinks,_sandwiches, and this type ofhhing-, NTss. 3arb-Kelly, resident on 190th St., asked questions concerning le ter from Police thief--chiefly meaning: of "less friction here"? Lutgens said the first time he sat on the Planning Commission was the re-zoning for the piece of property .the Yamaha Bldg is located on, and not one person showed up to object. NTrs, Cal Thomas, resident, said that she :felt the reason for that .was that. "these were our neighbors and we would not wish to object?" Nlrs. James Higgins,; resident, asked how many people-.knew about this (hearing)? Lutgens answered her cTueston by staying it is published in the paper,' and residents living within 350 feet are notified: by mail: G. .Huth spoke., asking the people if they':rnew a movie theater. or. other. types of things, a dance hall, .etc., could go .into this building as_it is-now zoned? Kalweit, asked Muth why he'is moving from. his present location? "r or financial. reasons," was thereply, "the lease will be 1/3 of what he is now paying". A. Vogen asked about the letter that was sent. R, Knutson said "all it means is that. Gary is,going to be located at this property": Vogen again related his bade experiences he had had (with patrons of a teen center) while he was in Valley Parka .Huth spoke saying Chief Radermacher has had no probblems with him at his present location. Hazel quoted statistics, saying there. had been ~~F culls to the police in Valley park, :(Apple Valley ";The Pocket" patrons), 'as opposed to 6 police calls in trio years to Gary's. Spande asked "where would you Like to-put a family recreation center"~' J.-:Higgins, "right downtown'". Mrs. Vogen,"are there people in Lakeville who really want this?" i~Zrs. J. Higgins, ""I do,,I really do". (Further discussion on a place for teen agers to go.) Opinion of R. Vogen: "people in Valley Park did not want him". R. Knutson: "he was intending to amend an ordinance at that time". P~~1rs. Thomas: "will he be able to use a,ny more of the land?" R. Knutson: "only. the part zoned B-~+." P. Kalweit: "suggest that each of you would go out to Reisnger's and go into their driveway." G. Huth: "I plan on changing the whole driveway--it will be all open." G. Spande: "does Midwest really feel that the parking lot has to be paved and stiped.'- We are .only going to give a,permit for one year (recommend, intended) J. Jojade: "we have an ordinance concerning surfaces." G. Huth: "I have offered to put up a fence to keep kids off Resnger's lawn." 76.120 Close public hearing motion by Hazel-Spande. Voting '°aye", Jojade, Spande, Hazel, Asmus, Antolik, and Lutgens. -Notion carried:. 76.121. T~Zove to recommend that we table any decision until September. 2nd by Hazel, seconded by Lutgens.. --a plan of parking and access from Gary. was desired by Hazel. Asmus asked-if we met again before Council? Yes, Planning Gommission will meet 2 Sept, Council, 7th. Voting as follows; Hazel, "nay", tismus, "aye", 1"~ntolik, "aye", " Lutgens,."aye", Jojade, "aye", Spande, "nay". Motion to table carried. Reasons for voting "nay" were,"reconsidered, would recommend approval subject to definitizing conditions." "Would move the matter on us opposed to holding over until September". --we have been through it all before. recess of five minutes was taken. Mr. C. Nolen showed additional materials an garage which he had moved to his property on 168th St. Building Inspector wishes conditions to be met before the garage can be approved. (They are written in his memorandum to Planning Commission dated 19 August 1976.) D. Goodermont further said, "I~s. Holen_is making an honest attempt to clean up the place, this is a much better .building than the one that was here.'° 76.122 Asmus-Spande motioned to approve the G. ~iolen ~ara~e subject to the ..approval of the Building Inspector. Voting "aye', l~smus, 1lntolk, Lutgens, Jojade, Spande, and Hazel. Lotion carried. Regarding the pr%~posal for fence amendment, R. Knutson said that Planner D. Licht has not finalized his opinions as yet, and he is asking to have this matter tabled for two weeks. 76.123 Spande-Lutgens motioned to tabl8 the matter of the fence amendment JojadeneSpande,1HazelepandbAsmus~. ~otiongcarried~tolik, Lutgens,: Note waa made of the upcoming meeting with Metro Council members to be August 26th 12:30-F1~ i~~etro Square, St. Paul. Those sure of going are: Spande, ~°sntolik, ' Asmus (but he will :need a ride home from St. Paul),.. Hazel, Campbell, and Lutgens want to attend but are unsure at this time; Jojade is not able to come. The plans are to meet"at'City Hall, on 207th St., at 10:30 Pt~1, with the possibility of having lunch. Asmu 'will meet with the others at Metro Square at 12:15 PM. Commission asks that reminder cards be sent. Pair. Jim Berg, Eagan Construction, appeared for approval of a building permit fore construction of block building for Pdavural Pipelines on 215th St. The question was raised if previous construction which had been done last year, not connected with Eagan ou Const., however, had been done according to plans.
