The meeting began at 8:00 PM when Chairman J. ~1ntolik called the meeting.to order.
Present were: ~ntolik, Lutgens, Campbell, Jojade, Spande, Hazel, and Asmus. Also present
were Administrator McGarvey, Planner D. Licht, and 1lttorney R. Knutson.
76.125 Motion was made, seconded, carried to approve the minutes of the last
meeting held August 19th.
P. McGarvey attested to the legality of the first public hearing of the applica-
tion of Dick Sullivan for preliminary plat on th® land lying west of Jacquard Av. and
north of Hwy 70. Presenting the plat were Gene Jacobson and Pat T~Iurphy, in the absence
of Dick who will be out of town for the next month..
Additional monies need to be spent to develop this land--curbing of streets,
sidewalks, question of streets themselves--which led to the decision to continue
this hearing until the applicant. can be present in person. The date will be Thursday
October 7th.
76.126 Piotion to continue Sullivan plat hearin until October 7th by Jojade-Lutgens.
Voting "aye""Antolik, Lutgens, Campbell, Jojade, Spande, Hazel, .and Asmus.
Motion carried.
Gerald E.,Toberman was the applicant at a public hearing for conditional use
permit fora mobile home lot on approximately 2~ acres of land at the old "76"
station, junction of Hwy 5 and 351^7. He explained he would like to park 16 singles
and 3 doubles (trailers) here to offer for sale. There may be a few used trailers
from time to time, that have been taken in trade, but the majority of the trailers
will be new stock.
B. Campbell wished to know how far these trailers would be located from the
apartments. (They will be at least 100 feet.) Planner was concerned VTith signing.
..(Agree to do as ordinance requests.) Campbell wished to know if the building would
be used for sales? (Yes..) Spande: "Is there going to be any work where the tanks
are?" (No.)Planner: "Have to pull those (tanks) out if they are not used in a period
of time." Toberman stated that he also operates !^!ueen Anne Terrace.
TTeighboring resident,. Bob Rystrom, spoke saying he was concerned that the
location was on the wrong side, perhaps creating a traffic hazard, and. does not wish
to have queen Anne expanded. T~cGarvey said (the last statement) would be a total
separate question. Toberman stated he expected to use the frontage road for moving
his trailers, not Highway 5, and he did not anticipate any traffic problems.
Spande asked if the zoning was B-~+. (Yes.) Asmus tiaished to know if they were
going to clean up the site. (I{irst thing we and going to do is paint, etc.) Toberman
spoke saying he had been in the mobile home business for 30 years.
Asmus asked about time of day the trailers would be moved.(There are restrictions
placed on the time of day that trailers can be moved by the State of Mn.--can't come
in between and 6 PT~1, nor before 8 AM.) Asmus expressed concern about the tanks.
John Wren spoke from the audience and said there were no tanks on this particular piece
of property being considered.
76.127 Motion by Lutgens-Jojade to close the hearing of Gerald E. Toberman.
Voting "aye": Lutgens, Campbell, Jojade, Spande, Hazel, Asmus, and ~intolik.
Motion carried.
76.128 T~Zotion by Hazel-Spande to recommend to Council that they approve the
Toberman application for conditional use permit for mobile home lot at
junction of Hwy 5 and 35W, 24 acres of land, with several conditions--
(1) lot should never contain more units than shown on the plan, don't
want it overcrowded, (2) use as a sales place, not a storage place, (3)
subject to all the regulations and rec!uirements for moving such vehicles,
and subject to the storage tank problem. Voting '°aye": Campbell, Jojade,
Spande, Hazel, Asmus, Antolik, and Lutgens. Motion carried.
Tim Berg of Eagan Construction Co. showed building plans for a building to be
located on Natural Pipelines property, corner of 215th St. and Hwy 65.
76.129 Lutgens-Jojade motioned to approve building plans of Eagan Const. Co. for
Natural Pipeline building. Voting "aye": Jojade, Spande, Hazel, Asmus,
~ntolik, Lutgens, and Campbell. T<Ztion carried.
The tabled public hearing of Denny Dunham, Tu2otion No. 76.113, for preliminary
plat approval. of industrial park on land near 215th St, and Iiwy 65 was re-opened.
Planner said. that the 3 acres Denny was wishing to develop was not enough according to
our ordinance--it should be a minimum.. of 5 acres. He said the application should be

denied, basically, for two reasons: (1) present policy is not to develop area without
sewer and water, and (2) he is bringing 3 acres to develop, rather than 5. The Planner
did not wish to have a 3-acre plot, without knowing what is going to happen to the rest
of the land. A moratorium is now being proposed which will last for one year, that the
land can be sold, but no building permit will be issued.
P. McGarvey questioned the road. An 80' fight of way is shown, 9 ton road, then
you would later have to dig up the road to put in utilities. Planner stated that "most
recommend showing this in easements".
76.130 Motion by Jojade-1"~smus to deny the Denny Dunham application for preliminary
plat for industrial park at 215th St and Hwy 65, based on present planning
policies, asking for development of less than 5 acres, and no sewer and water
presently. Voting to deny were: Spande, Hazel, ~smus, Antolik, Lutgens, Campbel
and Jojade. P~Zotion carried. D. Dunham was told this would be a Council matter
on September 7th. Hazel commented to Dunham "do believe you have not done
enough planning on this."
Tabled matter of application of Gary Huth and Todd Hulbert public hearing to conduct
a family recreation center in former Yamaha Building. on Cedar Av. was re-opened.
Gary Tjuth showed a plan of how parking for 35 ears is proposed around the building.
P. McGarvey said he would wish a site grading plan. Gary was told that car spaces
need to be 9' x 20'.
There is a 30' existing driveway. Planner said their recommendation as to paving
and striping has been changed to "surfaced". Jojade said ordinance specifies "water
. sealed", Hazel suggested two 30' driveways to help the traffic flow. -The Planner.
did not believe the County would object to a driveway "in'° and one "out", situation.
Resident Tim Kelly wished to know about the fence that is proposed bordering
Reisinger yard. Huth replied it would be a redwood woven type. Bernard Murphy asked
about zoning. He was told it was zoned B-~+. .Planner spoke about the '°grandfather'°
clause which would allow a 1~usiness to go in once again, even though the land was re-
zoned as residential.
Murphy asked about perculation tests. Planner said it would have to be according
to State codes.. l~r'urphy also wished to question the safety of the driveway, and asked
about the land having been surveyed.
A. Vogen asked about the visibility of cars coming from the driveway. McGarvey
said he had driven it today and could see approximately 250' to the north. Vogen
wanted to know if we wished 16 year old kids going out of this driveway,
B. P~Turphy questioned the acreage that is concerned with this building. Knutson
said the applicant would only have the zoning on the building.
76.131 Upon motion by Hazel-Spande, a second petition for City rezoning this property
was acknowledged. ifotion carried.
76.132 Hazel-Ga~pbelmotioned to recommend approval of G. Huth and T. Hulbert public
hearing application to operate family recreation center in former Yamaha
Building with conditions as outlined in Planner's letter dated August 16th;
also conditional use permit being granted for one year, and renewal permit
for one year after that, adequate parking, wanted assurance that an adult
would be managing the center during operation hours, owner would be responsible
to see no drugs were being used, staff must be satisfied as to the conditions
of the center, B-~+ zoning must. be this designated area, and contingent upon
them suppoying the City with a copy of their lease, and is granted to the land.
The permit should be issued to both b!Ir. Huth and Mr. Hulbert. Voting Aye":
Hazel. Asmus, rintolik, Lutgens, Campbell, Jojade, and Spande. P~~otion carried.
The operators of Interstate 2-Gday Communications, corner of Hwy 5 and 35tid were
present seeking information on possibility of constructing building near "Tom Thumb"
Shopping Center on this corner, also. They understood the restrictions that P1Lr. Dunham
had been told.
Corrections were made in the present version of the proposed fence amendments.
76.133 P~~otion by Jojade-Asmus to accept the fence amendments, with the proposed
changed, and. send this corrected version to Council for their approval,
Voting."aye" weres Asmus, 1>ntolik, Lutgens, Campbell, Jojade, Spande, and
Hazel. T~lotion carried.
A discussion of members' feelings and thoughts of meeting with members of
l~?etro Council last Thursday took place. ~iccording to Planner there are areas of
concern at Metro Council presently: 35'E, open spaces, airports, and water and sewer.
