X11 members were present; ,~ntolix, Lutgens, .Campbell, Jojade, Spande, Hazel, ~psmus. The PC minutes of pctober 7~~ were discussed and the Council meeting minutes of October 18th. 76.149 ,Upon motion of Lutgens-Spande, the minutes of the meeting held pct. 18th were approved. Motion carried. Public hearing of text amendment to the zoning ordinance to permit operation of a veterinary clinic and hospital as a conditional use in an i-l~ zone on land in `Section 36, Parcel 010-58-22=03600, was begun. Planner Dave Licht spoke saying tnat in three or four months we want to establish a whole new ordinance; and that the Minnesota Pollutien ,agency and Lakeville City codes would have too be considered. 76.150 Motion to .close. the above pa;blic 'hearing was made by Hazel-Campoell. Voting Naye~~, were; Lutgens, Campbell, Jojade,. Spande, Hazel, ,~smus, and ~ntolik. Motion carried. 76.151 motion to recommend approval of text amendment to the zoning ordinance concerning operation of a veterinary clinic, and hospital as a conditional use • in an T-la zone on specified el and in section 36,.was made by Hazel-Campbell. Voting n~eN were; Campbell, Jojade, Spande, Hazel, ~smus, ~ntolik and Lutgens. Motion. carried. Public hearing was commenced to consider the application of Dr. y,~illiam H. Sweeney for conditional use permit to operate a veterinary clinic and hospital on land described at Motion No. 76.151. .76.152 Motion by ~smus-Spande to close public ne-axing of Dr. W H. Sweeney for conditional use permit to operate a veterinary clinic and hospital as outlined in above. paragraph. Voting Hoye?~ were Jojade., 'Spande, Hazel, ,~smus, ~ntolik, and Lutgens, and Campbell. :..Motion carried. 76.153 Hazel made mo ion to recommend. approval of request of Dr. Sweeney, as above, for .conditional use permit, on the land described, subject to Planner Licht~s reviewal and recommendations. Voting ~ray~i were 5pande, Hazel, Qsmus, ~ntblix, Lutgens, C~?pbe11, and Jojade. Motion carried. Dr. W. H. Sweeney showed building plans for a proposed addition to the present block building at this site. He was advised that this, too, would have to be a block addition. 76.1y+ Jojade-Spande made motion to include a reviewal of Sweeney building plan on .this nights,agenda, as it had been: inadvertently missed. Voting,~~ayen were Hazel, Asmus, ,~ntolik, Lutgens, Campbell, Jojade, and Spande. Motion carried. 76.•155 Spande-Campbell motioned to approve proposed Sweeney building addition, subject . to Building Inspectors s approval.. C. ~ ~ i~UV~'i~;R 1976 attorney Roger Knutson attested to the legality of tie public hearing of application of 7bm Thumb Stores to operate aself-service gas station in a &-4~ zone at the High- view Shopping Center on 210th Street. • Mr. Stan Biggin was present. He said he is with Pump Service and would be making the installation, if the conditional use permit was allowed. There would be dispensing from three hoses, one unleaded gasoline and two .regular. The dispensing island would be 12 feet. Hazel asked Mr. Biggin if he had examined .the site as to flow of traffic? rlr. Biggin replied that he had--both on a Sunday morning and again on Monday. Mr. Leibfried, owner of the Shopping Center, stated that more cars could be parked at the Center than the spaces as saown--po ssibly 120 total, instead of 89. Mr. Biggin wished to pass along the safety record of these self-servicing statio ns-- there have been no accidents to date. Dave Licht wanted the additional land designated as parking. He considered the pattern. of the flow of traffic to be somewhat troublesome. .~smus wanted to know why the gas pumps had .been located where they were? Jerry and John Enggren were present. Jerry replied that the ~~gas pumps have to be -where the girl can see the operation". John IIzggren spoke saying "think it is a better situation than any around town'. K. Lutgens asked, "do they have safety .shut offs on these?' Mr. Siggin, 'Yes"--then he showed a letter from the State Fire Marshall to him, dated pctbber 13th, outlining all the requirements they would be expecting. (The letter is in the file accompanying. these minutes.) • Bill .Campbell asked, nis it feasible to move these pumps further East and still have them visible7" Mr, Biggin replied, t~we could put them here". Mr. Gary Parker, in the audience, asked, "where is the underground storage?" Mr. Biggin, "right under the island'. ~ discussion ensued about interests of other companies renting in this Center. 76.156 Hazel-Jojade made motion to close the public hearing concerning Tbm Thumb self-service gas pumps in Highview Center. Voting "ayes' were ,pntolik, Lutgens, Campbell, Jojade, Spande, Hazel, and ~smus. 76.157 Campbell-Spande motioned to have a special meeting on Thursday, November 11th, 8;00 PM, Municipal Building, concerning Tom Thumb application far conditi oval use permit for self-service gas pumps at Highview location. This will allow another plan to be drawn to show more parking and change in visibility for attendant. Voting uayeu were Lutgens, Campbell, Jojade, Spande, Hazel, ~smus, and ;~ntolik. Motion carried. Public hearings of applications of Paul Dbnnay for re-zoning Lots 2 and.3, Block 1 of Donnay's qth addition from R-3C. multiple family, to R-1D, single family, and-- preliminary plat approval, of Donnay's Valley Park qth .;~dditian of putlot C~ Donnay Valley Park were heard, after R. Knutson attested to their legality. Upon scrutiny it was found that proposal for Lot 1 left it sq ft short of having what is considered minimum by Lakeville~s ordinances. There was a large group of i Valley Park residents in the audience. They seemed to be overwhelmingly in favor of re-zoning the two lots to allow for single-family dwellings--and some allowance be made to enable the duplex to be located on the corner, within legal means. 76.158 Hazel-Lutgens motioned to close the public hearing concerning re-zoning, OUtlot C, Valle Park. Voting '~ayen: Jojade, Spande, Hazel, ~smus, ;~ntolik, Lutgens, and Campbe7-1• Motion carried. 76.160 Motion to close the public hearing of preliminary plat proposal of Dannay's Valley. Park 9th ;addition was made by ,panda, 2nd by Hazel.. Voting "aya~~; Spande, Hazel, ~smus, ;~ntolik, Lutgens, Campbell, and Jo jade. Motion carried. 76.161 Motion was made by Hazel-Spande to recommend approval. of preliminary plat of Donnay's Val]ey Park 9th ;addition. Voting "aye's: Hazel, Asmus, ,~ntolik, Lutgens, Campbell, Jojade, and Spanda. Motion carried. letter concerning raquir~nents for discontinuing ~bld~~ gasoline and oil tanks had been received by Planning Commission. L. Hazel wished to recommend that the. Building Inspector sand copies of this letter to the owners of no-longer-used tanks Mr. McGarvey said copies ware already being sent. Planner Licht said B. Watscha is gutting his materials ready for a PUD of land on Hwy 50 at 185th Street, and will be making an application for hearings before the planr,.ing Commission. Upcoming business was discussed.. Building Inspector is to be asked to coma to spacial meeting November 11th to discuss extended moratorium on metal 'pole-type' buildings in the City of Lakeville. The time at present will expire November 17th, the day before the next regular Planning meeting. 76.162 Motion to adjourn the meeting came at 10;30 PM, by Hanel and Campbell, Motion carried.
