THURSDAY 8:00 PM 16 DECEMBER 1976

When Chairman J. Antolik called the meeting to order, the following members
answered roll: Antolik, Lutgens, Jojade, Spande, and Hazel--absent were Campbell and Asmus.
76.172 Minutes of the meeting held 2nd December were approved upon motion by Lutgens
and Hazel.
76.173 The public hearings of applicant Mr. Brad Johnson, (1) to re-zone land from
76.17 B-~+ to R-3C, and (2) variance on lot size--both the same location: Lots 7, 8, 9,
Block 1, Town of Fairfield, were opened.
It was stated that the applicant, Brad Johnson, had requested that these hearings
be continued until the meeting to be held 20th January 1977, because all of the materials
he neede~were not compiled at this time. However, Fred Taft, Ruth Baker, and Margaret Hobbs
had atte d the meeting this evening to voice an opinion on these hearings--plus Mr. John
Byrne also came a little later.
Mr. Taft: "No objection to apartment house, but I do not want another entrance
on the lot, on this street."
Ruth Baker: "I have the lot in the corner, next to his. What effect would .the
re-zoning have on the taxes? I also do not want another entrance on this street; I do
not want him. to build on my line, either, as he has said he would like to do."
. Margaret Hobbs: "I do not want another entrance on this street, either".
Mr. Byrne: "He (Brad Johnson) had said he would put up a screen between the
(present) apartment house and my house, when it was first built--and it isn't done yet.
What assurance do we have that this won't be done again, not living up to promises?"
Margaret Hobbs: "Will the taxes be higher or lower?"
G. Spandex "Actua~;ly, (re-zoning from com¢nercial to multiple housing) would be
to your benefit."
Mr. Taft wondered about Brad providing a playground for children in this apartment
complex. The Planner, D. Licht, said that this provision does not apply unless the land
has been subdivided. Mr. Taft further said, "he has three buildings already, of 8 to 10
units each. One is mainly housing for old people now, but this could change. overnight."
.Ruth Baker: "How far from the lot line can he build?"
Planner Licht: "Twenty to thirty feet, or more, depending upon the use of the
building."
Ruth Baker asked about the drain pipe. on present building that drains onto her
lot. She was told that a builder could not change the original flow.
76.175 Motion by Lutgens and Spande to continue the two public hearings of Mr. Brad
Johnson until the 20th of January, as the applicant had requested. Voting "aye"
were Antolik, Lutgens, Jojade, Spande, and Hazel. Motion carried.
An examination of material provided by the Planner, pertaining to the final
plat hearing of Sullivan's Estates, was begun. This material is dated December 15th.
Dick Sullivan provided a hardshell copy of the property.
J. ~ntolik commented, "he has complied with our requests".
76.176 Hazel and Lutgens moved and seconded to recommend approval of final plat of
Sullivan's Estates, located on Jacquard Av. and CR 70, subject to fulfillment
of conditions of development contract. Voting "aye" were: Lutgens, Jojade, Spande,
Hazel, and Antolik. Motion carried.
According to Planner Licht, Metro staff will be receiving Statements information
next. There will be a meeting of City staff before this. He further said that until the
Systems Statements are clarified, we will not know where we're at. By the first or second
week in January, we will have a document out to you.
As far as terms of office of members, G. Spande and W. Campbell will serve another
three-year term of office.
76.177 Upon motion by Lutgens and Jojade, a recommendation is to be made to Council

76.177 con't that Wilmot Campbell and Gerald Spande be re-appointed as members of
the City of Lakeville Planning Commission for another 3-year term of .office.
Voting "aye": Jojade, Spande, Hazel, Antolik, and Lutgens. Motion carried.
Selection of Chairman and Vice-Chairman for Planning Commission will take place
the first meeting in January..
The question was raised if the fence had been taken down that is located in the
"Old Village" of Lakeville, that does not comply with City ordinance.
76.178 Motion was made by Spande-Jojade, to recommend to Council that the City of
Lakeville prosecute the owner of the property in the "Old Village" of Lakeville
where a fence has been erected that does not comply with City Ordinance. `Voting
"aye" were: Spande, Hazel, Antolik, Lutgens, and Jojade. Motion carried.
A request was made that conditional-use permit of Judy's Beauty Shop in Valley
Park be checked for adverse happenings. of on-street parking.
Discussion of Home Occupations Ordinance offender(s). will be held on 6th of
January meeting night.
It was re-determined that City Staff can renew existing trailer permits.
76.179 Upon motion by Lutgens and Jojade, a request is made that the Building Inspector
attend-the Planning Commission meeting date, the first meeting of each month.
Voting "aye" were: Hazel, Antolik, Lutgens, Jojade, and Spande. Motion carried.
• Motion to adjourn the meeting came at 9:3Q PM. Motion carried..
