Baumgartner was absent. Present also were Roger Knutson. F. Farrell, Mayor Maka, and PW Director Robinette were at the meeting part of the time. Planner Steve Ryan attended the meeting and give hi.s thoughts and opinions on a number of ..matters during the evening, Dakota Heights 7th, PUD prdinanae, public- use signs, and, Urban Service Area Concept,-which he accompanied with a talk on an overlay he had prepared. With the correction of a name, property owner concerned with Fortune Realty public"hearing held on June 25th, the minutes of this meetingwereapprovedas read,:. on motion by Lutgens- Haglund. Motion carried. 341.. Public-hearing on PCTD Qrdinance was begun.. The attorney said he had looked at it and thought it was whatwas desired. Planner Ryan said this is the first tame. that Lakeville has had .such an ordinance. Motion to open the public hearing was by Lutgens-Jo~ade. Motion carried. 342. Jo3ade motioned to recommend to Council that they approve the ~JD Ordinance. Lutgens .seconded. aAys", Lain: Antoli.k, Haglund, Campbell, Lutgens, and Jo jade. Motion carried. A group of sautwest Lake Marion residents had come to this meeting in accordance with Council"s dixective at their meeting of June 16th, Motion 75.424. The first spokesman far the group was Mr. Wally Potter. He presented picture copies of where the old road had run on top of the hill. (It nor runs along the shoreline, and it was stated that it has done so for more than twenty years.): The residents wish 2a2nd Avenue vacated, in part, because 'of a_number of reasons, such as: tires and .asphalt pieceshave..been dumped here,. people come. and camp despite the signs, and tear down the signs,. people trespass and burn'the residents wood--steps, eta.,,Mr. J. Pavlike said his fences have been cut and horses let out, residents, have to pick up trash and fish cleanings even. after asking the people responsible for putting it there to do it, Mr. Geier said people have even"came in his.. yard with guns hunting squirrels, and Mr. Mike Keegan stated the mad at his house has gone from 30 ft. to bd ft. Mrs. Thelma Geier and Mrs. R. cxerrald listed abuses and said they agree with everything...that has been said. Mr. Stanley Kroon, a lifetime reside¢~t, showed maps,. dat~i 191Q, which show"tan- broken shoreline here, and the road at the top of the hill,. Mr. Farrel.? said nif a road is maintained for six years, or move, it is apublic road. The only way to get rid of it is at a public..hearng.." He also read paragraph,160.n5 in bookaf statutes regarding dedication of public roads-- "dedi.cation is wo zeds from the center line." Mr. Wade Lawry. was present and wondering when a vacated road, (at what date), returns to the residents. Committee member, Lutgens, wished to know about school bus routes, orail route, gaxbage hauling, etc., connected with this vacating. Committee member,. W Carapbe2l, wished to iu~ow if r€~sidents would still use this road if it waa sacated. Answer was "no". 343• Lutgens made oration, seeing we have no re rt Pram sehoo pa 1, police, or fire offieials,;andseengwe have na objections from people living in thearea, and all residents seem to be in favor, recommend approval of Vacating this road.N Haglund seconded. Matter of Dakota Heights 7th Addition was re-opened, thiswas a public hearing for rezoning three parcels of land at 175th. St. and Ipava Av. fr+o~n '~=R to B 2, R 3G, .and R >2, whicl~i had been sent back to Planning Gcm~m.sson from Couicilfor reconsideration. 344. Motion b,~ Jo~a~de and Ragland to reconsider the rezoning re3mendations of Dakota Heights 7th. Addition. Motion carried. 345. Motion by Haglund. to deny the ra-zoning cm all .parcels (3) of property at Dakota Heights 7th.Addn, bassi on th® following reasons=. (1 .plat oonta.ins only ~ street, making for inade~uate> access (2~ There has baen a mayor change in tha Dakota tbtanty Tt?oroughfare Plan, which affects this prnperty. (185th St. to be developed, not i'75th St. ) (3) B 2 zoning. is inconsistesntwith neighborhood-commercial, as put forth in the ordinance (4) The pomprehensiva Quide Plan is under review at this time Lau seconded.
