Lau. gntolik, Lutgens, Haglund, Campbell, Jo jade, and Baumgartner ware all present. Haglund and Jo jade moved and seconded motion to approve minutes of meeting held July 14th, as presented. Motion carried. Reviewal of July 21st Council meeting was made by J• Haglund. Items applying to Planning Commission had bean tabled. 348. Public hearing for applicant Mr. Thomas Mousing was held for variance to build be7.ow-grade on Lots 2 & 3, Block 2, of Kingswood Estates. Haglund-Antolik moved and seconded to recommend approval of this variance. Motion carried. 34+9. Mr. Thomas eras the applicant at a public hearing, aski:ag for a sideyard set-back of 4-ft. on Lot 5, Block 4, Dakota Heights 6th Addis. Lau-Antolik moved and seconded to recommend approval of this variance.. Motion carried. 3~• Mr. Thomas +quam was also the applicant at a public hearing, asking for a variance to build an over-size garage. (Same property description as at Motion X349.) Cam~pbsll-Lutgans moveri and sscor:ded motion is r®caaamend approval of this variance. Motion carried. • 351• The proposed Home pcaupation 4rdinanas was read by J. Haglund. Lutgens-do jade moved and seconded motion to recommend approval of this ordinance. Motion carried. This was a public hearing. .The proposed mobile home ordinance am+~ndment was. read; the public hearing on this matter was opened. Residents and owners of mobile homes that wars present and objecting to the amendment ware: {1) Mr. Jim Dunham, owns a mobile home and has an elderly man living in it who ~t®lps ham. It was Mr. Iltunham's belief that the old man could not afford to ].ivs anywhere elms= (2) Mr. and Mrs. Simoaes tirho live ixi a trailer on the Ryland Simones farm, ware present, both objecting to mobile home amendment. Mrs. Simosss did not feel they would be able to move in thr~ years time. Mr. Si.mones said +'siace living in a mobile boon®, they feel it is as nice a. home as anyone can have and it is their homes; (3) Mr. and Mrs. John Raplinger ware objecting to the ordinance amendment. Planner Ryan wanted to know, "does a new mobile home hays to confozm with 3-acts :limitation on sewer?" Mr. Ackerman replied that "our ordinance does not allow mobile hoes in a platted area". In answer tcs Mr. Walt H3.aig, J• Haglund spoke, "this is the reason why ws have a publics hearing, so you can voice your opinion". Mr. R+ogsr Ifinutson, attorney, present said that he and Plan~asr Ryan had devised the ordinance and that it is legally efficient. He also said that "you caveat distinguiah between a ~ tine ~ trailer and a rental on®". J. Mr. Watsehks was present and • turned over the prssesatation to Mr. Carl Dale. Mr. Dale said he was talking for almost all the property owners who are considering PttD developaent on this piece of property, as wall as Pbrtune Realty--having only this same afternoon gotten affirmnation from one more. Haglund.wantsd to know, "dQ we look at this as a single PUDY" Planner Ryan answered, "everyone, all the owners, are tied to the concept--how they develop after that is on an individual basis". Run-off water is recogni$eal as being a problem in the area. Mr. Dale said they plan to retain all the water with (~3) ponds, as decnonstratsd on his map. Mr. Watsche said he believes it unfair to have to gait for all, all he wants at this time, is approval of concept. Mrs. L• der said that she hopes a long look will bs taken at furthest SW corner of Proposed developaent, because of its natural wild-state. Mr. Johnson asked, chow does this affect church signsYx The F].anner answered leis question by saying the 3 church signs, as Proposed, could be allowed only i.f (1) Purchase the Property they wish to put them, (2) re-zcrae the Property: and (3) ask for a variance. It was said that a special use amendment could not legally be written into the signs amendment. Mr. Cram; Loftquist, Ataegele Signs, spoke of the si~a amendment as "generally favorablee.
