RESOLUTION AMENDING THE
EMPLOYEE VACATION LEAVE POLICY
Staff recommends adoption of the following motion: Move to approve Resolution
amending the employee vacation leave policy.
Passage of this motion will bring parity to the vacation benefits between union and non-
union employees.
The 2011 union negotiations resulted in additional accrued vacation hours for
employees. Staff believes it to be appropriate to provide similar accruals to eligible non-
union employees.
The Personnel Committee of the City Council has reviewed the change to the policy
and is recommending approval. The new schedule will gradually increase the accrual
hours over a twenty year schedule.

The vacation accrual schedule will be amended as follows:

There are no direct costs. The additional vacation time will be managed in the same
fashion as current accruals.
WHEREAS, the City Council has, from time to time, established by resolution
certain conditions and employment benefits for employees of the City of
Lakeville; and
WHEREAS, the City Council believes it to be appropriate to provide similar
benefits to both union and non -union employees; and
WHEREAS, the 2011 labor contract negotiations provided an increase in
vacation accrual hours to employees;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lakeville:

EMPLOYEE VACATION LEAVE POLICY
The Vacation Leave Policy is hereby revised and adopted with the
attached effective January 1, 2011 for eligible employees of the City of
Lakeville.

VACATION LEAVE
1.01 The vacation year will be the calendar year, and each employee will earn vacation
computed on a bi- weekly basis, or every two weeks. Employees are encouraged to take
consecutive days rather than one day at a time.
1.02 During the first six months of the probationary period new hire employees will not be
entitled to vacation leave. After completion of the first six months of the probationary
period the employee will be entitled to vacation leave accrued from the start of
employment.
1.03 The vacation schedule for full -time employees is as follows:

1.04 Request for vacation leave must be initiated on forms submitted to the department
director and the City Administrator, as appropriate, at least two weeks prior to anticipated
vacation absences. Exceptions to this policy are granted on a very limited basis, taking
into consideration the good of the service provided by the City.
1.05 If the nature of the work makes it necessary to limit the number of employees on vacation
at the same time, the employee with the greater seniority will be given the choice of
vacation period if the employee's request is made thirty (30) days prior to the vacation
time desired. When requests are made less than thirty (30) days prior to the vacation time
desired, vacation will be granted on a first come first served basis.
1.06 Except as specifically approved in writing by the City Administrator and the City
Council, employees will not be allowed to carry over more than the number of hours they
earned in the two previous calendar years for vacation leave.
1.07 Any employee leaving City employment in good standing, after giving proper notice of
such termination of employment, will be compensated for vacation leave accrued up to
the maximum amount permitted and unused to the date of separation. An employee who
leaves employment will be given prorated vacation pay for that part of the year worked.
1.08 No employee will be permitted to waive vacation leave for the purpose of receiving
double pay.
1.09 Employees using earned vacation leave will be considered to be working for the purpose
of accumulating vacation or sick leave.
