September 1, 2011 Item No. SEPTEMBER 6, 2011 CITY COUNCIL MEETING MCDONALD'S CONDITIONAL USE PERMIT AMENDMENT Proposed Action Staff recommends adoption of the following motion: Move to approve the McDonald's conditional use permit amendment and adopt the findings of fact dated September 6, 2011. Adoption of this motion will allow McDonald's restaurant to make site plan and building exterior improvements on the property. Overview Representatives of the McDonald's restaurant located at 20158 Icenic Trail submitted an application for an amendment to Conditional Use Permit No. 95 -08 to allow modifications to the drive - through vehicle queuing area in addition to proposed modifications to the building's exterior. The Planning Commission held a public hearing and recommend approval at their August 18, 2011 regular meeting subject to the six stipulations in the planning report plus a seventh stipulation requiring that the site plan be revised prior to City Council consideration to allow for two way traffic movement in the parking lot east of the building and to add concrete curbing to segregate the parking lot from the drive - through vehicle queuing area. There was no public comment at the public hearing. Since the Planning Commission meeting, McDonald's has submitted revised plans that addressed the Planning Commission's recommended seventh stipulation to address Planning Commission comments regarding the queuing lane backing up into the shared driveway with Kwik Trip and onto Icenic Trail. Staff recommends approval of the McDonald's conditional use permit amendment subject to the stipulations listed in the conditional use permit amendment form which includes a requirement that the site plan be amended to provide parking stall and drive aisle dimensions in compliance with the Zoning Ordinance prior to building permit approval. Consistent with the Planning Commission's recommendation, the northerly egress for the parking lot area east of the McDonalds building was modified to allow two -way traffic movements and this parking lot area was segregated from the drive - through lanes by curbing and landscaping instead of striping as was originally proposed on the site improvement plans. In addition, the plans were revised to increase the amount of vehicle queuing area away from the shared driveway with Kwik Trip in order to improve vehicle movement in this area of the site. This site plan modification was in response to concerns raised by Commissioner Grenz at the public hearing. Staff supports the proposed site plan revisions. 2 (Reserved for Dakota County Recording Information) CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA CONDITIONAL USE PERMIT AMENDMENT NO. 11- 1. Permit. Subject to the terms and conditions set forth herein, the City of Lakeville approves an amendment to Conditional Use Permit No. 95 -08 for McDonald's Corporation to allow modifications to the approved site plan and exterior building materials at the McDonald's restaurant located at 20158 Icenic Trail. 2. Property. The permit is for the following described property located in the City of Lakeville, Dakota County, Minnesota and legally described as follows: Lot 2 and that part of Lot 3 lying northerly of Minnesota Trunk Highway No. 50 as described in Final Certificate Document No. 1106252, Block 1, Viking Square, according to the recorded plat thereof, Dakota County, Minnesota. 3. Conditions. The permit is issued subject to the following conditions: a) The stipulations of the planned unit development conditional use permit dated April 17, 1995 shall remain in full force and effect except as modified herein. b) The site and building improvements shall comply with the plans approved by the City Council. c) All new signage shall meet the requirements of the Zoning Ordinance except as allowed by this amendment. A sign permit is required prior to the installation of any signs. 1 d) A building permit is required prior to commencing any building construction or remodel activity. e) The proposed site improvements are subject to the review of the City Engineer. f) The site plan shall be amended to provide parking stall and drive aisle dimensions in compliance with the Zoning Ordinance requirements prior to building permit approval. 4. Termination of Permit. The City may revoke the permit following a public hearing for violation of the terms of the permit. 5. Criminal Penalty. Violation of the terms of this conditional use permit amendment is a criminal misdemeanor. The Planning Commission conducted a public hearing on the proposed conditional use permit amendment preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following: 1. The property is currently zoned C -3, General Commercial District. 2. The property is located in Planning District No. 5 of the 2008 Comprehensive Plan, which guides the property for commercial land uses. 3. The legal description of the property is: Lot 2 and that part of Lot 3 lying northerly of Minnesota Trunk Highway No. 50 as described in Final Certificate Document No. 1106252, Block 1, Viking Square, according to the recorded plat thereof, Dakota County, Minnesota. 4. Section 11 -4 -3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria and satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The modifications to the drive- through queuing area and the remodeled building exterior is consistent with the current C -3 District zoning and guided commercial use of the property. b. The proposed use is or will be compatible with present and future land uses of the area. 1 The drive - through queuing lane improvements and building exterior modifications will be compatible with existing and future land uses in the area. c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. The restaurant with drive - through service and the proposed drive - through queuing lane and building exterior modifications will conform with all performance standards contained in the Zoning Ordinance and the City Code except as al /owed by CUP No. 95 -08 and this amendment. d. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. The property is served with city sanitary sewer and city water. MCDONALD'S CORPORATION Planning Commission Meeting August 18, 2011 Page 2 Chair Davis opened the public hearing to consider the application of McDonald's Corporation for an amendment to Conditional Use Permit No. 95 -08 to allow modifications to the existing drive through service lane and the building exterior, located at 20158 Icenic Trail. The Recording Secretary attested that the legal notice had been duly published in accordance with State Statutes and City Code. Brian Johnson, Architect and Planner with Reprise_. Design, representing McDonald's Corporation at tonight's meeting, presented an overview of their project. Mr. Johnson indicated that this is part of McDonalds' national re- branding program that hopes to change the look of their restaurants over the next six years. He indicated that the look will be more upscale and will appeal to the aging population of customers. Mr. Johnson stated that McDonald's is also looking at its operational aspect including speeding up the drive - through by installing a side by side ordering configuration which will require ; a_ conditional use permit amendment. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey commented that McDonald's narrative states that the current volume of drive through sales is almost 64% of total sales and could increase another 5% upon the new branding elements. Mr. Dempsey stated that should the Planning Commission recommend approval of the CUP amendment, Planning Department staff recommends approval subject to the 6 stipulations listed in the August 12, 2011 planning report. Chair Davis opened the hearing to the public for comment. There were no comments from the audience. 11.46 Motion was made and seconded to close the public hearing at 6:12 p.m. Ayes: Lillehei, Davis, Maguire, Grenz, Drotning, Boerschel. Nays: 0 Chair Davis asked for comments from the Planning Commission. Discussion points were: • Commissioner Grenz feels that the McDonald's proposal for the drive through lane does not solve the current problem of the drive through queuing sometimes backing up onto Icenic Trail. McDonald's has a lot of extra property adjacent to the current building and Commissioner Grenz was disappointed that McDonald's did not use this land to address the vehicle stacking problem. Mr. Johnson stated that with the proposed modifications Planning Commission Meeting August 18, 2011 Page 3 modifications allowing a greater number of vehicles through the queuing area and the three alternative ways of entering /exiting the site, the back up of traffic should be improved. • The Planning Commissioners confirmed that there are two order boards proposed and they are still meeting the parking requirements of the Zoning Ordinance. • Commissioner Lillehei commented that he thought this proposal was a significant improvement to the existing site by allowing more vehicles into the queuing area. He thanked Mr. Johnson for bringing this project forward. Chair Davis agreed. • The Planning Commissioners agreed that a raised curb along the south side of the drive through aisle would be safer by segregating the parking lot from the drive through lanes. • The Planning Commissioners agreed that the site plan should be revised so there is room for two lanes of traffic 'to access the parking spaces on the east side of the building south of the drive - ;through aisle. The following additional stipulation was suggested by Mr. Morey for the Planning Commission's consideration: 7. In 1995, the Zoning Ordinance allowed the approval of a commercial planned unit development by conditional use permit. The original Planned Unit Development /Conditional Use Permit (PUD /CUP) was approved in 1995 in conjunction with the Planned Unit Development /Conditional Use Permit for the Kwik Trip convenience store and motor fuel facility. The proposed McDonald's redesign requires an amendment to the original conditional use permit. The 1995 PUD /CUP allowed the use of shared access between McDonald's and Kwik Trip as well as additional wall signage and off -site freestanding signage for McDonald's. The proposed building and site improvements are part of a national rebranding effort on the part of McDonald's Corporation. The following exhibits are attached for your information: EXHIBITS A. The property is zoned C -3, General Commercial District. Restaurants with drive - through facilities are allowed by conditional use permit in the C -3 District. Surrounding Land Uses and Zoning North — Icenic Trail and office buildings (C -3 District) South — Kenwood Trail (CSAH 50) East — Kwik Trip motor fuel and convenience store (C -3 District) West — Icenic Trail and office buildings (C -3 District) Lot and Building. The McDonald's property is a 2.76 acre parcel that meets the requirements of the Zoning Ordinance and is in compliance with the conditional use permit 95 -08 approved in 1995. The north portion of the property abutting Icenic Trail includes enough area that could allow it to be subdivided and developed in the future with access from Icenic Trail. The existing building exterior includes painted split concrete block and painted plywood siding, a maroon metal roof and tall wall height windows on the north, south and east sides of the Playplace area of the building. The proposed new building exterior will retain the existing split concrete block which will be painted brown. The existing painted plywood siding will be replaced with two shades of brown EFIS (synthetic stucco). The maroon roof will be replaced with a new roof and wall to match the rest of the building fascia and wall height as well as additional screening for the roof -top mechanical structures. Metal sunscreen louvers will be installed over the windows of the Playplace 2 area of the building. New yellow corporate wall elements will be installed on the south and west sides of the building. Drive - Through Expansion. McDonald's project narrative states that drive - through service at this restaurant has increased from 45% to 68.3% and is expected to increase an additional 5% in the future. There have been occasions when vehicles in the existing drive - through queuing have extended into Icenic Trail. The proposed lane reconfiguration is expected to increase efficiencies and reduce vehicle waiting time in the drive - through queuing area. A freestanding light fixture will be relocated in conjunction with the new drive - through queuing area configuration. Parking. The existing restaurant requires 72 parking spaces. A total of 83 parking spaces are proposed. The propose site plan will include the elimination of two parking spaces in order to accommodate the proposed site plan changes. The proposed design exceeds the Zoning Ordinance parking requirements for a restaurant with drive - through service. The plans for the handicap accessible parking spaces on the south side of the building will include a slight change to the grade slope in that area to meet current Americans with Disabilities Act (ADA) requirements for those spaces. Landscaping. The plans for the expanded drive - through queuing area include the removal of three existing crab apple trees, one spruce tree, shrubs and ground cover. The proposed landscape plan includes three ornamental serviceberry trees and three Black Hills Spruce trees. New ground cover landscaping will be installed in the center raised island and the south side of the queuing lane and in the revised parking lot island. There are no perimeter overstory trees on the west and south sides of the McDonald's property. Zoning Ordinance Sections 11 -21 -9B and 11- 73 -71-13 requires that plantings be included and emphasizes at the perimeters of the property and parking lot. Similar recommendations are outlined in the Corridor and Gateway Design Study for properties adjacent to Dodd Boulevard (CSAH 9) and Kenwood Trail (CSAH 50). Staff recommends including the planting of trees on the west side of the drive - through lane and along Kenwood Trail (CSAH 50) adjacent to the McDonald's parking lot. Staff will work with the McDonald's architect on the appropriate locations for the trees. The landscape plan should be revised prior to City Council consideration of the conditional use permit amendment. Signs. Conditional Use Permit No. 95 -08 allowed McDonald's to install three wall signs up to 127.5 square feet each, six directional signs, a menu board sign and one monument - style freestanding sign shared with Kwik Trip. The three walls signs were McDonald's and Playplace on the south wall and Playplace on the east wall. Two new 44 square foot menu board signs will also be installed in the drive - through area. The Zoning Ordinance allows two menu board signs up to 50 square feet in area each and eight feet in height. 3 The McDonald's remodel would reduce the total square footage of wall signs located on the existing building. The Playplace sign on the east wall of the building will be removed and replaced with a 12.65 square foot golden arches logo. The south wall will include a 44 square foot McDonald's sign and a 12.65 square foot golden arches logo in addition to a new, reduced 28.34 square foot Playplace sign. There will be no signage on the north or west walls of the building. The program dramatically reimages the exterior appearance, refreshes the interior decor, updates any deficiencies in site and building accessibility, and improves operational characteristics relative to menu item changes, product delivery, and client service. Records indicate that drive through traffic volume has increased disproportionately with overall sales at the location.
